IT'S ED PEARCE. I DON'T KNOW IF YOU CAN HEAR ME OR NOT. YES. I HAVE DIFFICULTY HEARING YOU. AND I WASN'T AWARE THAT WE WERE DOING QUITE WHAT YOU DID. I NEED TO DECLARE ON THIS PARTICULAR ITEM. OK. OK. SO. LOST COUNCILLOR FINAMORE ALREADY? OK, I'M IN FAVOR SO THAT'S CARRIED TO CLOSED. COUNCILLOR PEARCE CAN COME BACK. THERE HE IS. OK. OK, IS THERE A SECONDER FOR SUSPENDING THE PROCEDURE BY LAW IN ORDER TO ADD AN AGENDA ITEM REGARDING THE SKI HILL? SECONDED BY COUNCILLOR PATRIE. SO WE'LL VOTE ON THAT IF THERE'S ANY DISCUSSION ON THAT. NO DISCUSSION. ROLL CALL ONCE AGAIN, COUNCILLOR PEARCE, DO DID YOU HEAR WHAT THE MOTION [00:05:02] WAS? YEAH, OK, I'M IN FAVOR. OK COUNCILLOR TURNER. IN FAVOR. COUNCILLOR PATRIE. IN FAVOR. COUNCILLOR MANN. IN FAVOR. I'M IN FAVOR. SO THERE YOU GO. YOU CAN PUT FORWARD THE MOTION NOW, COUNCILLOR TURNER. IT WOULD BE A MOTION TO PERMIT THE SKI HILL TO OPEN IMMEDIATELY WITH THE CONSENT OF COUNCIL AND I SO MOVE. CLARIFICATION ON THAT MOTION. PLEASE. THE WORDING. CAN YOU CLARIFY A BIT? PERHAPS YOU CAN TELL ME WHAT IT IS YOU'RE LOOKING FOR. YOU JUST PUT A MOTION ON THE FLOOR TO PREVENT THE SKI HILL FROM OPENING ON THE CONSENT OF COUNCIL, IS WHAT YOU SAID. I SAID, PERMIT. NO PERMIT. OK, LOOKING TO PERMIT THE SKI HILL TO OPEN IMMEDIATELY. THAT'S MY CLARIFICATION. THANK YOU. IS THERE A SECONDER? SECOND BY COUNCILLOR PATRIE THE ONLY, I GET TO SPEAK, FIRST OF ALL, I'LL ASK A QUESTION, I'M OK WITH THEM OPENING IMMEDIATELY, AS LONG AS THE ALL SAFETY PROTOCOLS ARE FOLLOWED IN REFERENCE TO SKI HILLS THAT HAVE BEEN PROVIDED BY THE SKI HILL THEMSELVES. I'LL GO OVER TO COUNCILLOR TURNER AND THEN WORK OUR WAY AROUND. COUNCILLOR TURNER. YES YOUR WORSHIP, THE SKI HILL HAS A PLAN IN PLACE ACTING PREVENTIVELY. THEY'RE FOLLOWING THE ONTARIO SKI RESORTS MAJOR PLAN, AND IT SEEMS TO BE FAIRLY COMPREHENSIVE AND THEY'RE VERY CONSCIOUS OF WHAT THEY'RE DOING AND FULLY INTEND TO FOLLOW THE INTENT OF THE PROVINCE AND OF COUNCIL IN MAINTAINING A SAFE PLACE FOR PEOPLE TO ENJOY RECREATION OUTDOORS. COUNCILLOR PATRIE. I'D LIKE TO ADD A FRIENDLY AMENDMENT TO THE MOTION BASED ON THE COMMENTS OF THE MAYOR, ADD THAT PROVIDING THAT ALL APH AND PROVINCIAL MANDATES FOR SKI HILLS ARE FOLLOWED FOR SAFETY REGULATIONS DUE TO COVID. YOU OK WITH THAT FRIENDLY AMENDMENT? OK. ANY FURTHER DISCUSSION, COUNCILLOR PATRIE? I'M IN FULL FAVOR OF THE SKI HILL OPENING. THE PROVINCE HAS OPENED EVERYTHING BACK UP. I UNDERSTAND THAT WE DO HAVE A CLUSTER IN TOWN, BUT PROVIDING THAT WE DO FOLLOW ALL SAFETY MEASURES OR THE SKI HILL FOLLOWS ALL SAFETY MEASURES BECAUSE THEY ARE ON THE MUNICIPAL INSURANCE POLICY, I WOULD WANT TO MAKE SURE THAT THEY ARE ADHERING TO ANY SAFETY PRECAUTIONS THAT ARE REQUIRED. I WOULDN'T WANT OUR CLUSTER TO EXPAND IN ANY WAY, SHAPE OR FORM. WE'VE BEEN DOING WELL THE LAST FIVE DAYS AND I WOULD LIKE TO KEEP IT STAYING IN THAT POSITION. THANK YOU, COUNCILLOR MANN. THANK YOUR WORSHIP. I WOULD PROBABLY DISAGREE WITH COUNCILLOR PATRIE'S ASSESSMENT THAT WE'VE BEEN DOING WELL OVER THE LAST FIVE DAYS. BUT IN ANY EVENT, TO THE MATTER AT HAND, I THINK I THINK IT'S A LITTLE UNFORTUNATE THE WHAT'S GONE ON BETWEEN MOUNT DUFOUR AND THE MUNICIPALITY OVER THE LAST COUPLE OF DAYS. I DON'T BELIEVE ANYONE AROUND THIS TABLE, NOR AT THE SKI HILL IS INTERESTED IN ARGUING ABOUT WHEN TO OPEN AND WHAT TO OPEN. BUT WE CLEARLY CREATED BY RESOLUTION AT OUR LAST COUNCIL MEETING THE FACT THAT WE WOULD OPEN AND REVIEW EVERYTHING ON THE 22ND AT OUR NEXT COUNCIL MEETING. THAT BEING SAID, WE ARE NOW ASKED AT THIS MEETING TO APPROVE THEIR OPENING. INITIALLY, IT WAS IMMEDIATELY, AS WAS COUNCILLOR TURNER HAD SUGGESTED, AND THEN IT'S NOW BEEN AMENDED TO APPROVE. BUT WE HAVE NO PLAN IN FRONT OF US. AND IT WOULD BE REALLY NICE IF THE MUNICIPALITY ACTUALLY SAW THE PLAN, CONSIDERING, AS COUNCILLOR PATRIE INDICATED. IT IS OUR INSURANCE, WE ARE PAYING THE FREIGHT ON THAT, AND I THINK FOR THE TRANSPARENCY OF THE RELATIONSHIP BETWEEN THE MUNICIPALITY AND THE SKI HILL, AND WE ARE TRYING TO STILL RESOLVE THOSE COMPONENTS. I THINK WE NEED TO WORK WITH MOUNT DUFOUR OVER THE NEXT COUPLE OF DAYS. THEY ARE CLEARLY IN THE MEDIA TALKING ABOUT OPENING ON THE 19TH. [00:10:03] THAT IS THEIR WISH. I DON'T NECESSARILY DISAGREE WITH THAT INTENT. HOWEVER, I NEED TO SEE SOMETHING NOT AS A SKI HILL BOARD MEMBER, BUT AS A MUNICIPAL REPRESENTATIVE TO ENSURE THE SAFETY OF THE COMMUNITY. THERE'S BEEN LOTS OF DISCUSSION REGARDING OPENING JUST FOR MEMBERS, OPENING JUST FOR INDIVIDUALS IN THE COMMUNITY. I NEED TO SEE SOMETHING IN WRITING FROM THE HILL TO INSURE ME AS A COUNCILLOR OF THE MUNICIPALITY THAT THE OTHER RESIDENTS OF THIS COMMUNITY WILL NOT HAVE TO CONCERN THEMSELVES WITH PEOPLE TRAVELING TO OUR HILL OVER THE NEXT COUPLE OF DAYS OR WHATEVER THAT TIMEFRAME SHALL BE. AND I DON'T THINK IT'S UNREASONABLE FOR US TO ASK FOR SOMETHING IN WRITING SO THAT WE HAVE IT BEFORE US. SO I'D BE LOOKING FOR ANOTHER SUBTLE AMENDMENT. I DON'T THINK NECESSARILY THE HILL NEEDS TO OPEN IMMEDIATELY. THEY TYPICALLY CLOSE AT FOUR O'CLOCK EVERY DAY ANYWAY, SO THEY'RE NOT OPENING FOR THE NEXT TWO HOURS CLEARLY. SO I THINK I THINK REASONABLY. IF WE CAN GET EVERYTHING TO EVERYONE'S COMFORT AND SATISFACTION RESOLVED BEFORE THE WEEKEND, THEY COULD POTENTIALLY OPEN FOR THE WEEKEND, WHICH I THINK WOULD BE REASONABLE. SO THAT WOULD BE WHAT I'D BE LOOKING FOR FROM THIS COUNCIL. YES, WE HAVE A HILL AND YES, THEY'RE ANXIOUS TO OPEN. AND I DON'T WANT TO BLOCK THAT. BUT LET'S DO IT SAFELY, PLEASE. OK SO JUST A QUESTION, COUNCILLOR MANN THEN THE FRIENDLY AMENDMENT THAT COUNCILLOR PATRIE PUT FORWARD THAT WOULD ENSURE THAT PRIOR TO THEM OPENING THAT THEY'RE FOLLOWING THE APH GUIDELINES AND THE PROVINCIAL PROVISIONS FOR SKI HILLS AND RESORTS. IS THAT SATISFACTORY? ARE YOU LOOKING FOR AN ADDITIONAL STEP? I THINK THANK YOU, YOUR WORSHIP. I THINK WITH ALL DUE RESPECT, THOSE AMENDMENTS DON'T HAVE ANYTHING TO TIE IN OUR FIDUCIARY RESPONSIBILITY FOR INSURANCE COVERAGE OF THE HILL, PUBLIC HEALTH. NOR DOES THE PROVINCE OR THE PROVINCIAL SKI ASSOCIATIONS HAVE ANYTHING TO DO WITH THE INSURANCE, THE MUNICIPALITY OF THE CITY OF ELLIOT LAKE DOES. SO I NEED SOMETHING REGARDING THE MUNICIPALITY IN THAT AMENDMENT FOR ME TO BE COMFORTABLE IN A REVIEW PROCESS OVER THE NEXT COUPLE OF DAYS. DO I GET A TURN TO SPEAK? YEDID YOU TELL ME TO GO AHEAD? [INAUDIBLE] ACCORDING TO ACCORDING TO PUBLIC HEALTH. THEY ARE STILL REQUESTING THAT PEOPLE DO NOT TRAVEL THROUGH ZONES. PEOPLE DO NOT TRAVEL TO ANY COMMUNITY UNLESS IT'S ESSENTIAL [INAUDIBLE] AT THIS TIME. I DON'T THINK THAT SKIING IS ESSENTIAL. WE STILL ARE [INAUDIBLE] OF THE CITY [INAUDIBLE] AND I WANT TO KNOW HOW THEY ARE GOING TO REGULATE THAT NOBODY NORTH OF HIGHWAY 17, NOBODY [INAUDIBLE] HIGHWAY 17 WILL BE HERE. AND I KNOW THERE'S PEOPLE WHO HAVE [INAUDIBLE] AND ADDRESS THAT DON'T LIVE HERE THAT CAN USE THOSE ADDRESSES THAT MIGHT HAVE SKI PASSES AND I JUST [INAUDIBLE] DO NOT TRAVEL UNLESS IT IS ESSENTIAL AND I'M SURE AT THIS POINT, I DON'T THINK ESSENTIAL TRAVEL IS TRAVEL AND I DON'T THINK THAT I'VE SEEN A GOOD ENOUGH PLAN FOR [INAUDIBLE] SKI HILL. I'M HOPING BY MONDAY THEY CAN PUT THAT TOGETHER AND PRESENT IT TO US AT A MEETING ON MONDAY WHERE WE'RE DISCUSSING ALL THE OPENINGS AND HOPEFULLY WE'LL HAVE A REPORT FORM APH AT THAT TIME AS TO WHERE WE'RE SITTING WITH OUR OUTBREAK. BECAUSE AT THIS POINT, NOBODY KNOWS. YESTERDAY THEY ADDED A PERSON TO THE LIST OF PEOPLE AFFECTED, BUT THEY GAVE NO STATEMENT TO US TO WHAT THAT ISSUE WAS, SO I THINK THERE'S JUST TOO MANY UNKNOWNS TO MAKE A RUSH DECISION AND I'D BE HAPPY TO DISCUSS THIS ON MONDAY. SORRY, I GOT INFORMATION. WE'RE HEARING THEM ON STREAMS. OK. TINKER WITH HOW WE CAN MAKE THAT. THANK YOU, COUNCILLOR FINAMORE. COUNCILLOR PEARCE. THANK YOU. YOUR WORSHIP, THROUGH YOU. I THINK I AGREE 100 PERCENT WITH COUNCILLOR FINAMORE. AND I SAY THAT RECOGNIZING THE IMPOSITION IS GOING TO BE ON MEMBERS OF THE SKI HILL, BUT I FIND IT DIFFICULT TO BELIEVE THAT WE WOULD OPEN THE SKI HILL. BUT CLOSE THE MINERS MEMORIAL PARKING AND THE SHERIFF'S CREEK. WE EITHER OPEN EVERYTHING OR WE LEAVE EVERYTHING CLOSED. WE TREAT EVERYBODY THE SAME WAY. I DON'T. I THINK I'M A BIT SURPRISED THAT THIS HAS EVEN COME UP. I MEAN, THREE MEMBERS OF COUNCIL, INCLUDING THE MAYOR, SIT ON THE BOARD OF THE SKI HILL. THIS SHOULD HAVE BEEN DISCUSSED WITH THE MEMBERS OF THE SKI HILL QUITE A WHILE AGO AND [00:15:01] MADE SURE THAT THEY FOLLOWED THE SAME RULES AS EVERYBODY ELSE. THANK YOU. COUNCILLOR TURNER. THANK YOUR WORSHIP. PERHAPS I MIGHT BE AT FAULT HERE, BUT IN THE RECENT BOARD MEETINGS THAT I'VE ATTENDED AT THE SKI HILL FOR SEVERAL MONTHS NOW, THE SKI HILL HAS BEEN WORKING DILIGENTLY ON PLANS TO DO WHATEVER THEY COULD POSSIBLY DO TO MAKE THE SKI HILL A SAFE PLACE FOR OUTDOOR RECREATION. I HAVE SEEN ON PAPER THOSE PLANS DISTRIBUTED TO MEMBERS OF THE BOARD FOR COMMENT FOR ADDITION. AND AS RECENTLY AS YESTERDAY, SEEN THE HILL'S COMMITMENT TO MAINTAINING A STANDARD ABOVE AND BEYOND WHAT MIGHT BE REQUIRED BY THE PROVINCE, PUBLIC HEALTH AND THE RECOMMENDATIONS OF THE ONTARIO SKI HILLS ASSOCIATION. WHETHER OR NOT WE LIMIT PEOPLE COMING INTO ELLIOT LAKE OR IF IT'S NECESSARY, I'M NOT SURE WE HAVEN'T DONE ANYTHING ABOUT SNOWMOBILES OR ATVS OR ICE FISHING. WE ARE ALSO AWARE THAT THE SKI HILLS IN THE SUDBURY AND [INAUDIBLE] MARIE AREAS ARE OPENING. AND. I DON'T KNOW HOW MUCH OF A DRAW MOUNT DUFOUR HAS OVER ALL OF THEM, BUT I SUSPECT IT'S IT'S NOT CERTAINLY NOT A HUGE NUMBER, THAT'S FOR SURE. I BELIEVE THAT THE FRIENDLY AMENDMENT BY COUNCILLOR PATRIE. PRETTY MUCH COVERS ANYTHING THAT WE COULD WANT AS A CITY, THE ISSUE OF INSURANCE. WELL, IF YOU'RE. IF YOU'RE LOOKING FOR A WAY NOT TO DO SOMETHING, USUALLY YOU CAN FIND THE ANSWER BY ASKING EITHER YOUR LAWYER OR YOUR INSURANCE AGENT. THEY ARE BY NATURE, RISK AVERSE. WE HAVE TO WE DO FIND OURSELVES IN THE POSITION WHERE WE ARE RESPONSIBLE FOR CREATING A REASONABLE BALANCING ACT. RISK MINIMAL. MOVING FORWARD AS BEST WE CAN, AND I THINK THAT I THINK WE SEE OURSELVES IN A POSITION WHERE WE CAN MOVE FORWARD, JUST ABOUT EVERYTHING ELSE IS WE'VE ALLOWED TO REMAIN OPEN. THE PROBLEMS WE'VE HAD IN THOSE PARKING LOTS AND THE LIKE IS MAINLY BECAUSE. PEOPLE WERE IGNORING OUR BYLAWS AND THEIR REQUESTS FOR COMPLYING WITH WHAT THE WHAT COUNCIL AND THE PROVINCE PUT FORWARD TO THEM. SO COUNCIL ACTED ON THAT. WE DIDN'T SPECIFICALLY ACT ON THE SKI HILL. I THINK OUR MOTION AS IT STANDS NOW WITH THE AMENDMENT FULFILLS WHAT WE NEED, AND PERHAPS WE CAN ASK STAFF TO INSPECT AND EXAMINE THE STANDARDS THAT THE SKI HILLS PUT IN PLACE, THEIR PLAN, AND IF THEY FIND SOME OBJECTION TO IT, BRING IT TO THE ATTENTION OF THE SKI HILL AND HAVE IT RECTIFIED. I'M SURE THAT CAN BE DONE BY FRIDAY. THANK YOU. COUNCILLOR PATRIE. FEW ITEMS. I AGREE WITH COUNCILLOR MANN AND COUNCILLOR FINAMORE'S PERSPECTIVE AND ISSUES. I WOULD LIKE TO SEE POTENTIALLY AN ADDITIONAL ADDENDUM TO ANOTHER ADDENDUM TO THE ADDENDUM OR ANOTHER FRIENDLY AMENDMENT, SORRY, THE I AGREE WITH THE ASPECT THAT, YES, WE DON'T WANT PEOPLE MOVING FROM ZONE THE ZONE, ESPECIALLY IF YOU HAVE PEOPLE COMING FROM THE ORANGE ZONE TO THE YELLOW ZONE. WE ARE YELLOW. AND I DON'T WANT TO GO TO ORANGE. I WANT US TO GO TO GREEN AND GET CLEARED. [00:20:03] I AGREE. AND I DON'T KNOW IF WE CAN AS A COUNCIL. PUT AN ONUS ONTO STAFF. IF WE WERE TO PUT AN AMENDMENT IN STATING THAT THERE IS A PLAN IN PLACE THAT STAFF CAN APPROVE, OTHERWISE WE'RE GOING TO END UP HAVING TO DO A LAST MINUTE EMERGENCY MEETING ON FRIDAY, WHICH WOULD TIE THE HANDS OF THE SKI HILL WITH TIME TO ACTUALLY OPEN. WHEN YOU GO BACK TO THE LAST MEETING THAT WAS BROUGHT UP ABOUT PEOPLE DISOBEYING IN THE PARKING LOTS, I DIDN'T GET TO BE AT THAT MEETING. AND I FOLLOW THE RULES. AND WHEN COUNCIL SAYS AS A MAJORITY THAT THEY WANT TO CLOSE THOSE UNITS, I HAVE TO ABIDE BY IT. I DIDN'T AGREE WITH IT. THE COMMENT MADE BY COUNCILLOR TURNER THAT PEOPLE ARE MEETING IN THE PARKING LOTS. WELL, WHEN YOU CLOSE SHERIFF CREEK WALKING TRAILS PARKING LOT, PEOPLE DON'T CONGREGATE IN THAT PARKING LOT. YOU MAY HAVE FIVE TO 10 VEHICLES PARKED THERE, BUT THOSE PEOPLE COULD BE POTENTIALLY A HALF A MILE APART, NEVER MIND TWO METERS. THE MAJORITY OF THE PEOPLE THAT WERE WALKING IN SHERIFF CREEK ARE WALKING AS FAMILY COUPLES, THEY'RE NOT GROUPS OF PEOPLE. SO PEOPLE WERE NOT DISOBEYING THE RULES AND THERE'S A LITTLE BIT OF AMBIGUITY IN THE LETTER THAT WAS DRAFTED TO GIVE TO THE MEMBERS OF THE MUNICIPALITY WHO THOUGHT THAT THEY WERE BEING. CONVICTED OF BREACHING THE RULES BY RECEIVING THE LETTER ON THEIR VEHICLES, I UNDERSTAND AND I AGREE WITH STAFF. PUTTING A LETTER ON AND ASKING PEOPLE TO PLEASE CONTACT THE BYLAW TO MAKE SURE THAT YOU'RE ADHERING TO THE RULES, A LITTLE BIT OF THE WORDING MADE AN AWFUL LOT OF PEOPLE A LITTLE SCARED AND SO FORTH, BUT. IT'S DONE, IT'S OVER. IT'S TOO LATE, WE'VE ALREADY DONE IT, SO THE ASPECT OF CLOSING NATURE OFF TO PEOPLE WHERE THEY CAN SOCIAL DISTANCE, I DO HAVE AN ISSUE WITH AS WELL AS NOT BEING ALLOWED TO OPEN THE SKI HILL WHEN THE PROVINCE IS SAYING IT'S SAFE, PROVIDING YOU FOLLOW PROPER GUIDELINES. BUT I DO AGREE WITH COUNCILLOR MANN. WE SHOULD SEE THAT PLAN. AND I DON'T KNOW, I WOULD WANT DIRECTION FROM THE CLERK IF WE COULD PUT AN AMENDMENT ON THERE THAT WOULD ALLOW US TO GIVE THAT DIRECTION TO STAFF TO BE ABLE TO MAKE THAT FINAL CALL, THAT THEY HAVE FOLLOWED PROTOCOLS WELL ENOUGH. BECAUSE IT'S OUR BYLAW, PEOPLE THAT ARE GOING TO HAVE TO ENFORCE THAT, THERE IS NO BYLAW THAT WILL ENFORCE THIS ANYWAY BECAUSE THE PROVINCE SAID THAT THEY CAN LEGALLY OPEN. SO WE'RE A CHICKEN AND EGG HERE BECAUSE THERE'S NO PENALTY IF THEY DO OPEN. BUT I UNDERSTAND THAT BOARD, THOSE ARE LOCAL PEOPLE AND THEY'RE GOING TO WANT TO FOLLOW THE WISHES OF COUNCIL. SO I DON'T THINK THAT THEY WILL BREAK OR GO AGAINST OUR FINAL DECISION THAT WE MAKE HERE TODAY, BUT I WOULD LIKE TO SEE THE MEMBERS PUT SOMETHING ON THE TABLE THAT. WOULD SUFFICE TO MAKE THEM HAPPY. THEY FOLLOW THAT THE SKI HILL WOULD FOLLOW ENOUGH STUFF TO MAKE US FEEL COMFORTABLE, SIMILAR TO, LIKE I SAID, COUNCILLOR FINAMORE SAYING WE DON'T WANT PEOPLE FROM OTHER ZONES SO THAT IT IS A DIRECTION OR A REQUEST OF APH. BUT IT'S NOT A RULE. IT'S NOT A LAW. SO IF WE WANT TO PUT THAT ON OUR AMENDMENT, THAT THEY CAN DO THAT UNDER THOSE PRETENSES AND MAYBE THEY CAN PUT A PLAN IN PLACE PRIOR TO FRIDAY THAT THEY CAN MAKE SURE THAT THAT WERE TO HAPPEN, I DON'T KNOW IF THAT WOULD APPEASE THE COUNCILORS THAT ARE HAVING THAT FEAR. I'LL LEAVE IT AT THAT FOR NOW. THANK YOU, COUNCILLOR PATRIE, I WAS TRYING TO THINK OF A WORDING FOR A FRIENDLY AMENDMENT THAT WOULD INCLUDE SOMETHING THAT KEEPS EVERYTHING LOCAL. AS YOU SAID, IT'S APH AND THE MINISTRY OF HEALTH IS, YOU KNOW, PUT OUT WORDING AROUND NONESSENTIAL TRAVEL, STAY HOME. BUT IT'S NOT ANYTHING THAT HAS TEETH. IT'S A REQUEST, UNFORTUNATELY. AND WE SEE A LOT OF TRAVEL STILL GOING ON AND SPEAKING ABOUT OUR MINERS MONUMENT, SHERIFFS' CREEK, EVERYONE THAT LIVES IN ELLIOT LAKE PRETTY MUCH LIVES HERE BECAUSE WE'RE ON NATURE'S DOORSTEP. AND UNFORTUNATELY, 99 PERCENT OF OUR COMMUNITY ARE FOLLOWING THE RULES. IT'S THAT ONE PERCENT THAT THAT DON'T LISTEN, THAT CAN'T WAIT A LITTLE BIT LONGER THAT ARE THAT ARE CAUSING THE ISSUES FOR US TO TAKE THESE DIRE STEPS IN ORDER TO PROTECT THE REST OF THE POPULATION. I'VE SEEN IT PERSONALLY GOING DRIVING BY THE MINERS MONUMENT. I'VE SEEN IT PERSONALLY AT THE BEACH WHERE THERE'S BIG GROUPS STANDING A LITTLE TOO CLOSE [00:25:04] TOGETHER, NOT WEARING MASKS. AND UNFORTUNATELY, THEY'RE THE PEOPLE OUT THAT ARE AT GREATEST RISK. THEY'RE ALL, YOU KNOW, ABOVE 65. AND I DON'T UNDERSTAND IT. I'VE HAD SOMEONE LITERALLY COMPLAINING TO ME THAT THEY'VE SEEN OTHER PEOPLE DOING IT WHILE DOING IT. SO I YOU KNOW, IT'S JUST THAT ONE PERCENT, UNFORTUNATELY, IT'S AND ALL WE'RE TRYING TO DO IS PROTECT THE POPULATION. WE HAVE A CLUSTER NOW. NOBODY SEEMS TO KNOW WHERE HOW IT INFILTRATED, HOW IT GOT HERE. WELL, THE VIRUS DOESN'T TRAVEL ON ITS OWN AND SOMEBODY HAD TO GO SOMEWHERE OR HAVE A VISITOR FROM SOMEWHERE. COUNCILLOR MANN YOU WERE UP NEXT. THANK YOUR WORSHIP. YOU KNOW, CLEARLY FOR FOR EVERYONE IN ATTENDANCE TODAY, SUPPORTING THE SUSPENSION OF THE PROCEDURAL BYLAW TO GET THIS ON THE AGENDA. CLEARLY, I DON'T I DON'T THINK THERE'S ANY OPPOSITION IN THE HILL OPENING. HOWEVER, IF I WAS TO COME TO YOU IN DECEMBER AND SAY, I'VE TALKED TO THE TREASURER, WE'RE GOING TO DO A TWO POINT FIVE SEVEN PERCENT INCREASE, BUT I HAVE NO PAPERWORK IN FRONT OF ME, SO JUST TAKE ME AT MY WORD. I DON'T THINK ANYONE WOULD SUPPORT THAT BUDGET. AND WITH RESPECT TO THE COMMENTS BEING MADE, I THINK THE SEVEN MEMBERS OF THE COUNCIL, THREE OF WHICH DO SIT ON THE SKI HILL BOARD, THERE HASN'T BEEN A MEETING THIS YEAR. YES, THERE'S WORK BEING DONE AND I DO THANK THOSE MEMBERS THAT HAVE BEEN DOING THAT WORK. HOWEVER. BECAUSE OF THE RELATIONSHIP WITH THE MUNICIPALITY, I THINK EVERYONE AROUND THIS TABLE NEEDS TO SEE SOMETHING BECAUSE ULTIMATELY WE'RE RESPONSIBLE. WE ARE THE STEWARDS OF THIS COMMUNITY. THEY'RE THE STEWARDS OF THE HILL. OK, SO I THINK. IT SHOULD OPEN, BUT LET'S DO IT RIGHT, LET'S GET A PLAN, LET'S LOOK AT THE PLAN AND IF WE'RE GOING TO PROVIDE DIRECTION THAT THROUGH THE ADMINISTRATION THAT THEY'RE COMFORTABLE AFTER THEY'VE SEEN IT. SO THAT APH HAS THEIR SIGN OFF. AND AGAIN, IF THIS WORK HAS ALL BEEN DONE, IT SHOULD BE EASY, RELATIVELY EASY TO HAVE IT PROVIDED TO MUNICIPALITY IN THE NEXT DAY. SO I DON'T NECESSARILY NEED TO COME BACK TO A MEETING, BUT I NEED DIRECTION TO BE THAT THERE IS AN APPROVAL PROCESS THROUGH THIS MUNICIPALITY TO GIVE THE BLESSING FOR THE HILL TO OPEN PRIOR TO THIS RULE. AND I DO APPRECIATE COUNCILLOR PEARCE'S COMMENT ABOUT WHY SHOULD IT BE ANY DIFFERENT. HE'S RIGHT. THERE ARE STILL PEOPLE CONGREGATING. THEY'VE JUST MOVED THEIR CONGREGATIONS. IT'S HAPPENING ALL OVER TOWN, AND THAT'S PEOPLE'S FREE CHOICE, AND I RESPECT THAT AND THAT'S FINE. HOWEVER, IF IT'S OUR PROPERTY AND WE ARE TRYING TO KEEP INDIVIDUALS SAFE, I THINK WE NEED TO DO WHAT'S BEST. THERE IS GOING TO BE PROBLEMS WITH THE MEMBERSHIP BECAUSE THERE ARE MEMBERS FROM OUTSIDE THE COMMUNITY. AND THAT HOW DO WE WHERE ARE OUR ASSURANCES AROUND THIS TABLE THAT DO WE AS A COUNCIL SAY ONLY PEOPLE FROM ELLIOT LAKE AS A PERMANENT RESIDENT OF THE COMMUNITY CAN SKI FOR THE NEXT WEEK UNTIL WE GET SOME FURTHER INFORMATION? YOUR WORSHIP, YOU'RE CORRECT. THE VIRUS DOESN'T MOVE. PEOPLE DO. AND THAT'S WHAT'S HAPPENING HERE. IT'S ALL THROUGH TRANSMISSION. AND I'M SORRY, BUT I'M A LITTLE TOO CLOSE TO THIS PANDEMIC TO, FRANKLY GIVE UP AND SAY, WELL, THEY'VE DONE IT. I THINK WE NEED TO SEE IT. AND I'VE SEEN IT. I'VE SEEN THE WORK. I SPOKE TO MEMBERS OF THE BOARD THIS MORNING. THEY'RE 90 PERCENT. THE HILL IS 90 PERCENT COVERED, WHICH IS A CREDIT TO THEM IN THE LAST WEEK TO GET THAT DONE. I JUST WANT TO SEE THE PLAN AND THEN OPEN. SO MS. BRAY, WHAT'S THE WORDING OF THE MOTION AGAIN? THAT MOUNT DUFOUR SKI HILL BE PERMITTED TO OPEN IMMEDIATELY, PROVIDED THAT ALL [INAUDIBLE] PUBLIC HEALTH AND PROVINCIAL SAFETY MEASURES ARE FOLLOWED. AND THAT A SAFE REOPENING PLAN BE PRESENTED BY MOUNTAIN DUFOUR SKI HILL THAT STAFF CAN APPROVE PRIOR TO OPENING. COUNCILLOR MANN. THAT YOUR WORSHIP, IN ITS CURRENT FORM DOES NOT ENCOMPASS ANYTHING RELATING TO MEMBERSHIP WHO CAN ACCESS THE HILL AND ANYTHING REGARDING WHAT ARE, YOU KNOW, ANY OTHER CONCERNS THAT THIS MUNICIPALITY WOULD HAVE. SO THOSE WOULD BE THINGS THAT I THINK IF WE'RE GOING TO TAKE A POSITION THAT IT'S ELLIOT LAKE PROPER THAT ARE SKIING OR MEMBERS ONLY OR WHATEVER THE CASE, WE CANNOT SAY MEMBERS ONLY BECAUSE THERE ARE POTENTIALLY INDIVIDUALS OUTSIDE OF THAT. AND I APOLOGIZE TO THOSE MEMBERS. BUT AGAIN, I NEED TO CONCERN MYSELF WITH THE SAFETY OF THE RESIDENTS OF THIS COMMUNITY RIGHT NOW, JUST AS I'M ASSUMING ANY OTHER MUNICIPALITY WOULD DO THE SAME. SO IF IT'S GOING TO BE MEMBERS ONLY, THEN I CAN'T SUPPORT THAT IF IT'S RESIDENTS OF THE COMMUNITY, PERMANENT RESIDENTS OF THE COMMUNITY, AND A REVIEW AND CONFIRMATION OF ALL PROCEDURES TO BE FOLLOWED BY PUBLIC HEALTH AND THE PROVINCE OF ONTARIO, BY THE [00:30:03] MUNICIPALITY THAT I WOULD SUPPORT. AND MAYBE THAT'S WHAT I'M ABOUT TO AMEND. IS THAT AS A FRIENDLY AMENDMENT COUNCILLOR MANN? IF WE CAN IF SOMEONE ELSE CAN REMEMBER EXACTLY HOW I SAID IT YOUR WORSHIP. SOUNDED GOOD, BUT I DON'T KNOW IF I RECOUNTED OR RETELL IT. SO WE'VE ALREADY GOT PROVINCIAL GUIDELINES, APH GUIDELINES. TO BE REVIEWED BY STAFF PRIOR TO OPENING AND THE FRIENDLY AMENDMENT WOULD INCLUDE TO ELLIOT LAKE PERMANENT RESIDENT ONLY. PERMANENT RESIDENTS OF ELLIOT LAKE. OBVIOUSLY, FOR THAT, FOR THE TIME BEING, ARE YOU OK WITH THAT AS A FRIENDLY AMENDMENT, COUNCILLOR TURNER, COUNCILLOR PATRIE? I'M FINE WITH THAT AS A FRIENDLY AMENDMENT, MY PREDICAMENT BECOMES, ARE WE GOING TO TIME DATE THIS? SO THAT I THINK COUNCILLOR MANN IS GOING TO PUT SOMETHING IN THERE. MY FEAR IS WE'RE GOING TO HAVE TO REVISIT THIS AND I DON'T KNOW IF WE REVISIT IT MONDAY OR DO WE REVISIT IT ON MARCH 8TH, WHICH. BUT I THINK THIS WILL HAVE TO COME BACK IN THE VERY NEAR FUTURE TO AMEND THIS RESOLUTION . COUNCILLOR MANN. THANK YOUR WORSHIP. WOULD MR. [INAUDIBLE] BE COMFORTABLE BASED ON THE DISCUSSION THAT WE'VE HAD TODAY ABOUT WITH THE INTENTION OF WHAT THE MUNICIPALITY OR WHAT I'M ASKING FOR TO SAFEGUARD THE MUNICIPALITY, BE SUFFICIENT TO WORK WITH MOUNT DUFOUR IN ORDER TO REVIEW THEIR WORK, IN ORDER TO PROVIDE THEM A BLESSING TO OPEN ON THE WEEKEND AS AN EXAMPLE, WHICH WOULD BE THE I THINK THE DATE THAT'S FLOATING AROUND IS THE 19TH, 19TH, NOPE SORRY, 20TH. OH, 19TH. OK, SO THEY WANT TO OPEN ON THE 19TH. OK. I THINK THE SHORT ANSWER IS YES, NONE OF THIS IS PARTICULARLY COMFORTABLE. BUT WHAT WE'RE WHAT YOU'RE ZEROING IN ON IS THEIR PERMANENT RESIDENT ANGLE. AND THAT WAS THE MAIN CONCERN THAT I HAD. AND I THINK THAT'S SHARED BY STAFF. THE MOUNT DUFOUR SENT US A REAMS OF SKI ASSOCIATION, ONTARIO AND ALL KINDS OF GUIDELINES. AND MOST ARE VERY STRAIGHTFORWARD. AND I'VE NO DOUBT THAT THEY WON'T THAT THEY WILL IMPLEMENT THEM. SIGNAGE AND, YOU KNOW, FLOW AND, YOU KNOW, DISTANCING. THE QUESTION I STILL HAVE. AND THAT'S WHAT WE CAN REFINE BASED ON THE MOTION IS WHAT DO THEY DO WHEN A MEMBER FROM SUDBURY OR [INAUDIBLE] AN ORANGE ZONE, SHOWS UP SAYING, I PAID GOOD MONEY AND I'D LIKE TO SKI, THANKS. WE'RE GOING TO HAVE TO SAY NO. AND WE HAVE TO NARROW DOWN THE LEGALITIES OF THAT AND THE PRACTICE OF HOW THAT'S GOING TO BE ROLLED OUT. BUT OR WEDNESDAY. WE CAN LIKELY GET THAT SORTED OUT BECAUSE NOW IT'S FAIRLY CLEAR IF THE MOTION PASSES, THAT COUNCIL IS OPEN TO ALLOWING THE SKI HILL TO BE OPERATING AS OF THIS WEEKEND, WHILE AT THE SAME TIME THE DOG PARK IS CLOSED AND THE MINERS MONUMENT, ET CETERA, FOCUSING ON THE LOCALS UNTIL SUCH TIME THAT WE HAVE ANOTHER CONVERSATION ABOUT WHETHER WE WANT TO OPEN UP OR NOT. I THINK I THINK A LOT OF THAT COMFORT MR. [INAUDIBLE] COMES FROM THE FACT THAT YOU HAVE INDIVIDUALS AT THE SKI HILL WHO WILL BE MONITORING THE SITUATION, WHEREAS AT THE MINERS MONUMENT, THE DOGS PARK, SHERIFF'S CREEK, YOU DON'T HAVE ANYONE MONITORING THE GATHERING OF INDIVIDUALS AND MAKING SURE THAT SAFETY PROTOCOLS ARE BEING FOLLOWED AT THE SKI HILL WITH THEIR VOLUNTEERS. I THINK THERE'S ENOUGH PEOPLE IN ALL DIFFERENT AREAS TO ENSURE THAT THERE IS SOME SET OF SAFETY BEING FOLLOWED. IF WE CAN HAVE A LITTLE ARMY AT EACH ONE OF OUR CITY SPACES DOING THE SAME, IT WOULD BE. IT MAKE ME FEEL A LOT BETTER, THAT'S FOR SURE, COUNCILLOR MANN. I WAS JUST GOING TO SAY, FOR THE BALANCE OF COUNCIL. THE BEGINNING PLANNING FOR THIS SEASON, THE BOARD KNEW THAT MEMBERS WOULD TAKE ON FAITH, THAT THERE MAY BE OR MAY NOT BE A SEASON. AND THERE WAS DEFINITELY A LEAP OF FAITH IN ORDER TO DO THAT. CLEARLY, THOSE PEOPLE NOW SEE THE LOCKDOWN AND THE STAY AT HOME ORDER BEING LIFTED AND OBVIOUSLY WANT TO BE ABLE TO USE THEIR MEMBERSHIP. AND CLEARLY THAT'S REASONABLE. I THINK THERE MIGHT BE A DIFFERENT VIEW IN MY MIND IF WE WOULDN'T HAVE HAD THE SITUATION THAT'S OCCURRED IN THE COMMUNITY RECENTLY. BUT NONETHELESS, THAT, THE VARIANT, IT'S ALL AROUND US. THIS DOES TRAVEL OUTSIDE IN THE WINTER. WE'RE NOT WE'RE NOT IMMUNE FROM ALL THIS. AND THAT'S QUITE EVIDENT. SO ALL I WANT IS ASSURANCES THAT THE HILL CONTINUES TO WORK WITH THE MUNICIPALITY IN A VERY TRANSPARENT BASIS. AND AGAIN, IF EVERYTHING IS AVAILABLE, THEN IT SHOULD BE A RELATIVELY QUICK PROCESS, YOU KNOW? AND AGAIN, I DON'T WANT TO PUT MR. [INAUDIBLE] IN A DIFFICULT SITUATION. AND THAT'S WHY, YOU KNOW, WE'VE SAID AS COUNCIL THERE ARE DECISIONS TO MAKE. SO IF THEY'RE GOING TO, WE'RE GOING TO LET THEM OPEN. [00:35:02] IT'S OUR DECISION AND THEN WE MOVE FROM THERE. I JUST WANT TO MAKE SURE THAT EVERYTHING'S BEEN APPROVED AND WE CAN SEE SOME ASSURANCES OF THAT AND THEN OPEN AND BE SAFE AND ABSOLUTELY BE SAFE. BUT THERE'S STILL SOME PIECES, I THINK, THAT WE NEED TO SEE ON A LOCAL LEVEL IN ORDER TO PROVIDE SOME ADDITIONAL COMFORT. AND I'M STILL FINE WITH STAFF REVIEWING THAT AND NOT HAVING IT COME BACK IF THEY ARE. MR. [INAUDIBLE]? YES, THAT'S FINE, ONLY IN SOME STRANGE SCENARIO WHERE WE'RE STILL AT ODDS WOULD WE REQUIRE COUNCILS INTERVENTION AGAIN, BUT IT'S PRETTY QUITE CLEAR THAT COUNCILS OPEN TO IT FOR LOCALS ONLY. AND NOW WE JUST NEED TO MAKE THAT A REALITY BETWEEN THE BOARD AND CITY TO SATISFY OURSELVES. ANY OTHER COMMENTS OR QUESTIONS? COUNCILLOR PATRIE. JUST ONE REQUEST, WHEN IS THIS GOING TO COME BACK TO COUNCIL, SO ARE WE GOING TO. BECAUSE WE'RE NOT ADDING THIS TO THE MOTION THAT THIS IS TIME STAMPED, SO ARE WE GOING TO BRING THIS BACK ON THE 22ND OR THE MARCH 8TH? I JUST WANT TO MAKE SURE THAT THIS IS CLEAR THAT WE BRING THIS BACK, BECAUSE IF THINGS DO CLEAR UP AND WE'RE GOING TO ALLOW MORE THAN JUST LOCAL RESIDENTS, I JUST WANT CLARIFICATION OF WHEN WE'RE GOING TO HAVE THIS DISCUSSION AGAIN, BECAUSE I DON'T THINK THIS RESOLUTION STATES THAT STAFF CAN CHANGE ANYTHING IN IT. SO IT'S LOCAL RESIDENTS UNTIL COUNCIL APPROVES OTHERWISE. AND I IMAGINE THAT WOULDN'T BE BY THIS COMING MONDAY, MOST LIKELY HAVE TO BE BY MARCH 8TH. I WAS JUST GOING TO SAY THAT THE REPORT FOR ALL OUTDOOR FACILITIES IS TO COME BACK ON THE 22ND AS PER THE PREVIOUS RESOLUTION OF COUNCIL. OK, COUNCILLOR MANN. YOUR WORSHIP. I DON'T THINK THERE'S ANY REASON WHY IT COULDN'T COME BACK ON THE 22ND, WE MAY NOT HAVE A DIFFERENT OUTCOME, BUT I THINK WE COULD KEEP IT ON AS WE HAVE HAD SOME OTHER ITEMS AND REVIEW IT ON A ON A ON A ON A REGULAR BASIS. YOU KNOW, TO BE HONEST, WE'RE AT THE ALMOST THE END OF FEBRUARY. THERE'S NOT UNFORTUNATELY, THERE'S NOT A LOT OF SEASON LEFT. COUNCILLOR FINAMORE. YOU SEE THIS COME BACK HERE ON 22ND WHEN WE HOPEFULLY WE'LL HAVE MORE INFORMATION FROM APH AS TO WHAT'S GOING ON WITH THE COMMUNITY AND ALSO. I YOU KNOW, I WANT TO SUPPORT THE HILL AND I WANT TO SUPPORT THEIR ENDEAVORS, BUT WE'VE HAD INCIDENCES WHERE THEIR MEMBERS HAVE BEEN BOARDING, SKIING ON THE HILL WITH THE NOT EVEN BEING OPEN. SO. I JUST AT THIS POINT, I JUST DON'T SEE THE EVIDENCE THAT THEY CAN CONTROL WHO'S COMING IN AND OUT OF THAT HILL TO USE IT. SO I WOULD LIKE TO BE ABLE TO REASSESS IT ON MONDAY TO SEE HOW THE WEEKEND WENT. COUNCILLOR TURNER. I HAVE TO SAY, I'M IN AGREEMENT WITH THE THE IDEA THAT WE BRING IT BACK, BRING IT BACK SOON FOR REVIEW. I SUPPORT THE. YEAH, THE IDEA OF KEEPING IT OPEN TO LOCAL ONLY. I THINK ON MONDAY WE MIGHT ADDRESS THE FACT THAT THE YELLOW ZONE, AS WE KNOW IT, IS BIGGER THAN JUST ELLIOT LAKE AND CONSIDER WHO WE INCLUDE THERE. AND THANK YOU. OK, COUNCILLOR PEARCE. THANK YOU. I'M SORRY, BUT I'M HAVING DIFFICULTY HEARING SOME OF THE CONVERSATION. I JUST WANT TO CLARIFY SO WHAT WE'RE TALKING ABOUT THEN IS WE'RE GOING TO OPEN THE SKI HILL, BUT LEAVE THE DOG PARK CLOSED AND THE TRAILS CLOSED AND SHERIFF CREEK CLOSED AND THE BEACH IS CLOSED, BUT THEY THE SKI HILL CAN OPEN. IS THAT IT? YES, WITH ESSENTIALLY WITH THE PROPER SAFETY PROTOCOLS IN PLACE AND ENSURING THAT THERE'S VOLUNTEERS MONITORING. I'M SORRY. I FIND I FIND THAT ASTOUNDING THAT YOU WOULD EVEN CONSIDER THIS, THAT YOU WOULD EVEN. SO YOU'RE GOING TO PENALIZE PEOPLE WHO CAN'T USE THE SKI HILL, BUT YOU'RE GOING TO ALLOW THE SKI HILL BECAUSE, WELL, YOU KNOW, THEY TOOK MEMBERSHIPS AND THEY GOT TO [INAUDIBLE] MEMBERSHIPS BACK. I'M SORRY, I'M ABSOLUTELY OPPOSED TO THIS. AND I SAY THAT RECOGNIZING THAT MR. BURNETT IS GOING TO BE SHOWING UP IN MY HOUSE TOMORROW TO REPLACE MY BROKEN FURNACE. BUT YOU KNOW WHAT? NO, I CANNOT VOTE FOR THIS. ANY OTHER QUESTIONS, COMMENTS, MS. BRAY, YOU READ THE. COUNCILLOR TURNER. JUST A QUICK COMMENT. COUNCIL IS GOING TO ADDRESS ON MONDAY COMING, ALL THE CLOSURES THAT IT PUT IN PLACE. SO IT'S A MATTER OF ANOTHER FIVE DAYS AND THE ISSUE WILL BE ADDRESSED. ALL THIS DOES IS IF THE PLAN IS IN PLACE AND EVERYTHING IS ACCEPTABLE, ALL THIS DOES IS [00:40:09] ALLOW THAT SKI HILL TO BE OPEN FOR THIS WEEKEND. THEY HAVE A PLAN IN PLACE AND VOLUNTEERS WORKING TO KEEP IT, OR SO WE'VE BEEN TOLD, THERE IS NO PLAN IN PLACE FOR PARKING LOTS AND GATHERING POINTS. AS COUNCILLOR MANN POINTED OUT, THEY JUST GATHER SOMEPLACE ELSE, THERE'S NOT MUCH WE CAN DO ABOUT THAT. WE DO HAVE OTHER OUTDOOR ACTIVITIES THAT ARE OPEN AND HAVE BEEN OPEN SINCE DAY ONE, SO IT'S NOT REALLY A RIDICULOUS MOTION BY ANY MEANS. IT'S A PRACTICAL ONE. COUNCILLOR MANN. I BETTER STOP YOUR WORSHIP. OK. MS. BRAY, CAN YOU READ THE MOTION ONE MORE TIME, PLEASE? YES, THANK YOU. YOUR WORSHIP. THAT MOUNT DUFOUR SKI HILL BE PERMITTED TO OPEN IMMEDIATELY TO PERMANENT RESIDENTS OF ELLIOT LAKE ONLY PROVIDED THAT ALL [INAUDIBLE] PUBLIC HEALTH AND PROVINCIAL SAFETY MEASURES ARE FOLLOWED AND THAT A REOPENING PLAN BE PRESENTED BY MOUNT DUFOUR SKI HILL FOR CITY STAFF REVIEW AND APPROVAL PRIOR TO OPENING. THANK YOU. [INAUDIBLE] NO. OK, I THINK WE'RE GOOD TO CALL FOR A ROLL CALL VOTE, I'LL START WITH COUNCILLOR PEARCE. OPPOSED. COUNCILLOR FINAMORE. OPPOSED. COUNCILLOR TURNER. FAVOR. COUNCILLOR PATRIE. IN FAVOR. COUNCILLOR MANN. IN FAVOR. AND I'M IN FAVOR, THAT'S CARRIED. THANK YOU. OK, BACK TO, NO COUNCIL REPORTS ON ANNOUNCEMENTS, NO ADDENDUM, NO CONSIDERATION OF BYLAWS, NO PUBLIC QUESTION PERIOD, CLOSED SESSION. [17. CLOSED SESSION (if applicable)] I NEED A MOTION TO APPOINT MR. [INAUDIBLE] CLERK PRO TEMP FOR. LIKE TO PUT A MOTION TO DEFER ON THE FLOOR BEFORE WE CAN GET THAT FAR. A MOTION TO DEFER. THE CLOSED SESSION MATTERS. OK. SO I WANT TO PUT A MOTION TO DEFER ALL CLOSED SESSION MATTERS AS PER THE PREVIOUS REQUEST OF THE MAJORITY OF COUNCIL, THAT CLOSED SESSION NOT BE HELD UNTIL MEMBERS ARE ALL ONLY IN PERSON, WHICH POTENTIALLY I WOULD DEFER THIS TO MARCH 8TH. AND THAT NO PARTICIPATION VIA ZOOM BE PERMITTED. IS THERE A SECONDER FOR THAT MOTION? SECONDED BY COUNCILLOR MANN. DISCUSSION AND I GOT QUESTIONS ALL AROUND THIS, SO ACCORDING TO THE MUNICIPAL ACT AND OUR PROCEDURAL BYLAW, ELECTRONIC PARTICIPATION IS ALLOWED, INCLUDING CLOSED SESSION. SITTING ON VARIOUS OTHER OUTSIDE BOARDS AND COMMITTEES. WHO PARTICIPATE HAVE CLOSED SESSION PARTICIPATION VIA ZOOM. THERE HASN'T BEEN ANY BREACHES SO MY QUESTION. FOR YOU, MR. PATRIE, IS THERE SOME KIND OF TRUST ISSUE WITH INDIVIDUALS WHO ARE NOT IN THE ROOM BECAUSE CURRENTLY WE HAVE QUORUM IN THE ROOM? I HAVE NO ISSUES PROVIDING IT'S IN THE ROOM, ONLY I DO NOT WANT ANYBODY ATTENDING VIA ZOOM THERE ARE TRUST ISSUES WITH THAT MATTER. YES, I DO HAVE THAT TRUST ISSUE. BUT IF WE'RE WILLING TO MEET AND SO THE LEGAL OPINION THAT STAFF SAW IT WITHOUT COUNCIL'S APPROVAL TO MOVE FORWARD. AGAINST THE RESOLUTION OF COUNCIL. I DON'T AGREE WITH. I HAVE NO ISSUES WITH THE LEGAL OPINION THAT WAS PROVIDED, I HAVE NO ISSUES WITH THE COMMENT THAT YOU JUST MADE, THAT IT IS LEGAL TO HAVE CLOSED SESSION ZOOM MEETINGS DURING THIS EMERGENCY. I NEVER DENIED THAT I HAD CONVERSATIONS WITH THE CAO STATING THAT. THE RESOLUTION WAS THAT WE WERE TO BE IN PERSON ONLY, AND SO I'M PUTTING IT BACK ON THE FLOOR THAT ALL CLOSED SESSION MATTERS BE DEALT WITH IN PERSON ONLY NOT TO BE DEALT WITH WITH ATTENDANCE VIA ZOOM. I'M NOT SAYING IT'S NOT LEGAL. IT IS LEGAL, THE PROVINCE HAS SAID THAT WE CAN MEET VIA ZOOM OPEN OR CLOSED. [00:45:03] I DON'T WANT IT TO HAPPEN. I HAVE ISSUES. THERE'S STUFF ON THIS AGENDA THAT I WANT DONE FACE TO FACE. AND I DON'T WANT MEMBERS ATTENDING TO VIA ZOOM THERE IS STUFF THAT WILL NOT BE SAID IF THERE ARE MEMBERS PARTICIPATING VIA ZOOM THAT IF IT WAS STRICTLY AN IN-PERSON MEETING. SO I WOULD LIKE THIS DEFERRED TILL THE MARCH 8TH MEETING AND THAT JUST FOR THE ASPECT THAT COUNCILLORS HERE WOULD BE ABLE TO ATTEND, WHO THIS MEETING WAS SCHEDULED AT A TIME WHERE EVERYBODY KNEW HE IS NOT AVAILABLE. SO HE DOESN'T EVEN HAVE A CHANCE TO PARTICIPATE IN THIS MEETING. AND THE TWO MEMBERS THAT ARE ATTENDING VIA ZOOM HAVE THE OPPORTUNITY TO BE IN CHAMBERS SO THAT WE CAN MEET FACE TO FACE. COUNCILLOR MANN. THANK YOU WORSHIP. SO I SECONDED IT ONLY FOR THE PURPOSE OF. OF HAVING AN OPPORTUNITY TO SPEAK ON IT, THE INITIAL DEFERRAL, MY CONCERN ABOUT CLOSED SESSION MATTERS DURING A PANDEMIC ARE MORE TIME SENSITIVE IN NATURE, AND I HAVE BEEN SATISFIED BASED ON THE INFORMATION I'VE RECEIVED ON THESE MATTERS, THAT THEY'RE ALL TIME SENSITIVE. SO I DON'T HAVE AN ISSUE WITH THAT. I'VE MADE TIME OUT OF MY REGULAR DAY TO BE AVAILABLE THIS AFTERNOON. WE'VE ALREADY SPENT 45 MINUTES ON AN ITEM THAT WASN'T EVEN ON THE AGENDA. SO AGAIN, SO THIS IS GOING TO RUN LONGER THAN WE ANTICIPATED AND THAT'S WHAT WE ALL SIGN UP FOR. BUT AT THIS POINT, WE HAVE AN AGENDA. WE NEED TO GET THROUGH IT. SO I'M PREPARED TO GET THROUGH IT. SO I'M GOING TO RETRACT MY SECONDING OF THE MOTION. BACK TO YOU, COUNCILLOR PATRIE. WE'RE IN A CONUNDRUM AT THE MOMENT, COUNCILLOR FINAMORE. SO COUNCILLOR FINAMORE, COUNCILLOR MANN HAS RETRACTED HIS SECONDING OF THE MOTION TO DEFER ALL CLOSED SESSION ITEMS. SO WE'RE BACK. NO FURTHER DISCUSSION? YEAH, OK. SO AGAIN, I'M GOING TO PUT FORWARD I NEED A MOTION TO APPOINT MR. [INAUDIBLE] CLERK PRO TEMP FOR ITEM SIX POINT ONE. WHICH WOULD BE THE CAO PERFORMANCE EVALUATION. MOVED BY COUNCILLOR TURNER. I CAN'T ACTUALLY SEE THE SCREEN, SECONDED BY COUNCILLOR MANN, ANY DISCUSSION ON THAT? SEEING NONE. I'LL CALL FOR A ROLL CALL VOTE. COUNCILLOR PATRIE. OPPOSED. COUNCILLOR MANN. IN FAVOR. COUNCILLOR TURNER. FAVOR. COUNCILLOR PEARCE. HAVING MUTE ISSUES JUST GIVE HIM A MINUTE. LOVE WHEN YOU HIT THE VIDEO BUTTON INSTEAD OF THE MUTE BUTTON. THERE THANK YOU. I'M IN FAVOR. COUNCILLOR FINAMORE. FAVOR. I'M IN FAVOR SO THAT CARRIED. MOTION TO GO INTO CLOSED SESSION. MOVED BY COUNCILLOR TURNER. SECOND BY COUNCILLOR PEARCE. QUESTIONS QUALMS, QUERIES? COUNCILLOR PATRIE. IS THE MOTION TO GO INTO CLOSED SESSION? YES, I WILL NOT BE ATTENDING THE CLOSED SESSION MATTER. THERE IS A RESOLUTION OF COUNCIL ALREADY ON THE TABLE THAT THIS IS IN BREACH OF. WE HAVE A RESOLUTION THAT SAYS THAT WE WILL NOT MEET IN CLOSED SESSION UNLESS IT IS IN PERSON. AND THE WISH OF THE MAJORITY OF COUNCIL FROM THE PREVIOUS COUNCIL MEETING WAS THAT WE DO THIS IN PERSON. I AM FOLLOWING THE WISHES OF COUNCIL AND THE RESOLUTION THAT WAS PUT FORWARD AT THE TIME, AND I WILL NOT ATTEND CLOSED SESSION MATTERS IF THERE'S MEMBERS ATTENDING THE VIA ZOOM. THANK YOU, COUNCILLOR PATRIE. I WILL POINT OUT AGAIN THAT THAT MOTION WAS ACTUALLY NOT LEGAL ACCORDING TO OUR PROCEDURE BYLAW, WHICH STATES A TIME CERTAIN AND A REASON FOR WHICH NEITHER WERE GIVEN. SO WE'RE FOLLOWING PROVINCIAL RULES. WITH ALL DUE RESPECT, THE MOTION WAS PASSED. IT IS A RESOLUTION OF COUNCIL. THE RESOLUTION STILL STANDS UNLESS YOU RESCIND THAT RESOLUTION. SO I'M NOT WILLING TO DO IT. IT'S A CHICKEN AND EGG AND I DON'T CARE ABOUT THE SEMANTICS AND I DON'T CARE ABOUT THE FACT THAT OUR STAFF HAS GONE OUT TO GET A LEGAL OPINION. BASED ON YOUR REQUEST TO DO THIS MEETING, THE MAJORITY OF COUNCIL PUT A DECISION FORWARD [00:50:05] AND COUNCIL SHOULD BE, ACCORDING TO OUR CODE OF CONDUCT, FOLLOWING THE WISHES OF COUNCIL, SIMILAR TO WHAT I STATED THE LAST. CONVERSATION ABOUT THE SKI HILL. IF COUNCIL SAYS THAT YOU'RE GOING TO DO IT, YOU'RE GOING TO DO IT. WE CAN'T CHANGE WHAT WE'RE GOING TO DO. SO IT DOESN'T MATTER YOUR REASONING WHY YOU'RE DOING IT TODAY, I THINK IT'S UNFAIR. COUNCILLOR CYR DOESN'T EVEN HAVE THE OPPORTUNITY TO ATTEND BECAUSE WE ALL KNOW THAT HE WORKS DURING THE DAY AND DOESN'T HAVE THE AVAILABILITY TO ATTEND DAYTIME MEETINGS WASN'T SCHEDULED AT A TIME THAT'S EVEN POSSIBLE FOR HIM TO BE HERE AND. COUNCIL SAID, LET'S DO THIS ALL IN PERSON AND WE'RE GOING AGAINST THE RESOLUTION OF COUNCIL. THE RULES ARE THE RULES. [INAUDIBLE] A POINT OF PERSONAL PRIVILEGE, PLEASE. SURE COUNCILLOR FINAMORE. I'M FEELING VERY DISCRIMINATED AGAINST AT THIS POINT. I HAVE THE RIGHT AS A COUNCILLOR, AS A MUNICIPAL ELECTED OFFICIAL TO FOLLOW THE GUIDELINES OF ONTARIO HEALTH AND [INAUDIBLE] PUBLIC HEALTH. AND IT IS UNSAFE FOR ME AT THIS TIME TO BE OUT IN THE PUBLIC, ESPECIALLY WHEN WE HAVE AN OUTBREAK IN THE COMMUNITY. SO I'M FEELING DISCRIMINATED AGAINST. I DON'T KNOW IF IT'S A NECESSABILTY ISSUE OR WHAT ISSUE IT IS THAT I SHOULD BE PRECLUDED AT THE SUGGESTION OF COUNCILLOR. I SHOULD BE PRECLUDED FROM ANY MEETING BECAUSE I'M ATTENDING BY ZOOM WHEN I HAVE A LEGAL RIGHT TO DO SO. THANK YOU, COUNCILLOR FINAMORE. NOW, THAT IS ANOTHER ONE OF THE POINTS THAT I WAS HOPING TO MAKE. COUNCILLOR PEARCE HAVE HIS HAND UP ALSO. COUNCILLOR PEARCE. YES, THANK YOU. I WOULD ECHO COUNCILLOR FINAMORE'S STATEMENT. I'M PHYSICALLY UNABLE TO ATTEND AND AT MY AGE I AM IN A HIGH RISK CATEGORY AND I HAVE NO INTENTION OF COMING TO SATISFY THE WHIM OF A PARTICULAR COUNCILLOR. I HAVE THE RIGHT TO ATTEND IN CAMERA MEETINGS THIS WAY. I HAVE DONE SO IN THE PAST THAT I INTEND TO DO SO IN THE FUTURE. ONE OF THE POINTS I WANTED TO MAKE ON THIS WHOLE POINT, AND I THINK COUNCILLOR FINAMORE HIT PART OF THE ACCESSIBILITY ISSUES ON THE HEAD, IS AS AS ELECTED MEMBERS OF MUNICIPAL COUNCIL. ONE OF OUR DUTIES ACTUALLY, UNFORTUNATELY, IS THE DUTY AS HEAD TO COUNCIL IS TO ENSURE THAT THE BUSINESS OF THE MUNICIPALITY IS CONDUCTED IN AN EFFECTIVE AND EFFICIENT MANNER, SOMETHING THAT IS TIMELY. IF WE ARE WAITING UNTIL THE PANDEMIC ENDS IN ORDER TO CONDUCT CITY BUSINESS, THEN WE'RE NOT. FOLLOWING OUR DUTY AND OUR RESPONSIBILITY TO THE MUNICIPALITY, THE CORPORATION OR THE RESIDENTS, WE HAVE BUSINESS TO TAKE CARE OF. WE HAVE BUSINESS THAT HAS BEEN PILING UP SOME THINGS FOR FOUR MONTHS NOW, HAVE BEEN WAITED, WAITING TO BE LOOKED. ALL DUE RESPECT, NOTHING ON HERE IS FOUR MONTHS OLD. ACTUALLY, THE LEASE OF THE AIRPORT IS FOUR MONTHS OLD. WE'VE BEEN NEGOTIATING THAT FOR. NEW BUSINESS DEFERRED FROM THE 25TH. AND IT WAS DEFERRED BEFORE THAT. IT'S FROM NOVEMBER, NOVEMBER, DECEMBER, JANUARY, FEBRUARY. WE HAVE A DUTY TO TAKE CARE OF BUSINESS IN AN EFFECTIVE AND EFFICIENT MANNER, AND THAT'S WHAT I'M LOOKING FOR HERE TODAY. SO I'M GOING TO CALL AGAIN, ROLL CALL VOTE TO GO IN A CLOSED SESSION. I'LL START WITH COUNCILLOR FINAMORE. SORRY TRYING TO UNMUTE. IN FAVOR. COUNCILLOR PEARCE. IN FAVOR. COUNCILLOR TURNER. IN FAVOR. COUNCILLOR PATRIE. OPPOSED. COUNCILLOR MANN. IN FAVOR. AND I'M IN FAVOR. THAT'S CARRIED. WE'RE NOW CLOSED SESSION. OK, WAS MOVED BY COUNCILLOR MANN SECOND BY COUNCILLOR TURNER, THAT WE COME OUT OF CLOSED SESSION AT THE TIME OF FOUR FORTY FIVE PM. ALL ITEMS TAKEN CARE OF WITH DIRECTION TO STAFF, I'D LOOK FOR A. MOTION TO APPROVE EIGHTEEN POINT ONE BYLAW, TWENTY ONE DASH ZERO ONE TWO BEING A BYLAW [18.1. By-Law 21-012] CONFIRMING THE PROCEEDINGS AT COUNCIL AT ITS MEETING HELD FEBRUARY 17, 2021. MOVED BY COUNCILLOR MANN, SECOND BY COUNCILLOR TURNER, ALL IN FAVOR. THAT'S CARRIED, COUNCILLOR PEARCE YOU'RE IN FAVOR? THANK YOU AND A MOTION TO ADJOURN. MOVED BY COUNCILLOR TURNER, SECOND BY COUNCILLOR MANN, WE'RE NOW ADJOURNED, THANK YOU FOR TAKING THE TIME TODAY. * This transcript was compiled from uncorrected Closed Captioning.
