[3.1. Application for Zoning By-Law Amendment - 42 Oakland Boulevard]
REPORTS. 3.1 APPLICATION FOR ZONING BYLAW AMENDMENT.WE DID ORIGINALLY HAVE TWO PUBLIC MEETINGS SCHEDULED FOR THIS EVENING.
ONE ZONING AMENDMENT REQUEST WAS WITHDRAWN.
MEETING IS TO CONSIDER PROPOSED ZONING BYLAW AMENDMENTS TO THE CITY OF ELLIOT LAKE ZONING BYLAW 18-36 AND NOTICE OF CIRCULATION AND APPEAL STATEMENTS IN ACCORDANCE WITH THE REQUIREMENTS OF THE PLANNING ACT.
NOTICE OF THE PUBLIC MEETING WAS PROVIDED IN THE ELLIOT LAKE STANDARD.
IF A PERSON OR A PUBLIC BODY WOULD OTHERWISE HAVE AN ABILITY TO APPEAL THE DECISION OF THE CITY TO THE ONTARIO LAND TRIBUNAL, BUT THE PERSON OR PUBLIC BODY DOES NOT MAKE ORAL SUBMISSIONS AT PUBLIC MEETING OR MAKE WRITTEN SUBMISSIONS TO THE CITY BEFORE BYLAWS PASSED.
THE PERSON OR PUBLIC BODY IS NOT ENTITLED TO APPEAL THE DECISION.
IF A PERSON OR PUBLIC BODY DOES NOT MAKE ORAL SUBMISSIONS AT A PUBLIC MEETING OR MAKE WRITTEN SUBMISSIONS TO THE CITY BEFORE THE BYLAWS PASSED, THE PERSON OR PUBLIC BODY MAY NOT BE ADDED AS A PARTY TO THE HEARING OF AN APPEAL BEFORE THE ONTARIO LAND TRIBUNAL.

THE PROPOSED ZONING BYLAW AMENDMENT IS TO REZONE THE PROPERTY LOCATED AT 42 OAKLAND BOULEVARD FROM COMMERCIAL C-1 TO TOURIST HIGHWAY COMMERCIAL EXCEPTION 8 C2-8 TO PERMIT A BUILDING SUPPLY OUTLET WITH LIGHT MANUFACTURING ASSEMBLY AS PERMITTED USES ON SUBJECT PROPERTY. APPLICANT'S COMMENTS.

THE CITY PLANNER FROM JL RICHARDS AND ASSOCIATE HAS PREPARED A REPORT AND RECOMMENDATION FOR COUNCIL'S REVIEW ON THE APPLICATION.CORRESPONDENCE COMMENTS RECEIVED.
WE HAVE NOT RECEIVED ANY WRITTEN SUBMISSIONS ON THE APPLICATION FROM MEMBERS OF THE PUBLIC.

THE PURPOSES, AS YOU MENTIONED, OF THE PROPOSED ZONING BYLAW AMENDMENT APPLICATION WOULD BE TO REZONE THE SUBJECT PROPERTY FROM CENTRAL COMMERCIAL C-1 TO TOURIST HIGHWAY COMMERCIAL EXCEPTION 8 C2-8 TO PERMIT A BUILDING SUPPLY OUTLET WITH LIGHT MANUFACTURING ASSEMBLY AS PERMITTED USES ON THE SUBJECT PROPERTY.
THE OWNER OF THE SUBJECT PROPERTY IS PROPOSING TO OPERATE AN ELECTRICAL CONTRACTING SHOP WHICH COMPRISES OF AN OFFICE SPACE STORAGE SPACE FOR INVENTORY AS WELL AS RETAIL OF LIGHT FIXTURES AND RELATED ITEMS. FURTHER, THE OWNER INTENDS TO SHARE THE BUILDING WITH A WOODWORK CONTRACTOR WHO WILL BE UNDERTAKING LIGHT MANUFACTURING AND SALE OF CABINETS ON A PART OF THE PROPERTY.
SO THE PROPOSED ZONING BYLAW AMENDMENT IS CONSISTENT WITH THE INTENT AND POLICIES OF THE PROVINCIAL POLICY STATEMENT, THE GROWTH PLAN FOR NORTHERN ONTARIO AND CONFORMS TO THE CITY OF ELLIOT LAKES OFFICIAL PLAN.
AND AS SUCH, THE AMENDMENT IS RECOMMENDED BY OUR PLANNERS FOR APPROVAL.
