THIS IS A SPECIAL MEETING OF COUNCIL THE CITY OF ELLIOT LAKE MONDAY, JULY 25TH, 2022, AND THE TIME IS 6:30 P.M..

AS FAR AS ROLL CALL MEMBERS ARE PRESENT THIS EVENING, WITH THE EXCEPTION OF COUNCILLOR CYR.

[3.1 Application for Zoning By-Law Amendment - 26 Ontario Avenue]

REPORTS, 3.1 APPLICATION FOR A ZONING AND BYLAW AMENDMENT 26 ONTARIO AVENUE.

THIS IS A PUBLIC MEETING HELD BY COUNCIL UNDER SECTION 34 OF THE PLANNING ACT.

THIS MEETING IS DECLARED OPEN.

THE PUBLIC MEETING IS TO CONSIDER A ZONING BYLAW AMENDMENT TO THE CITY OF ELLIOT LAKE ZONING BYLAW 18-36.

THE PROPOSED ZONING BYLAW AMENDMENT APPLIES TO THE PROPERTY DESCRIBED AS PLC 4664 SCC AESLT 179-182 PLM151 GUNTERMAN ELLIOT LAKE KNOWN MUNICIPALLY AS 26 ONTARIO AVENUE.

THE EFFECT OF THE PROPOSED ZONING BYLAW AMENDMENT IS TO AMEND THE PROVISION OF CENTRAL COMMERCIAL SPECIAL EXCEPTION TWO C1-2 ZONE TO PERMIT A CHURCH OR PLACE OF WORSHIP ON THE SUBJECT PROPERTY.

NOTICE OF CIRCULATION AND APPEAL STATEMENTS IN ACCORDANCE WITH THE REQUIREMENTS OF THE PLANNING ACT.

THE PUBLIC MEETING IS A REQUIREMENT OF THE PLANNING ACT IN ACCORDANCE WITH THE PLANNING ACT.

NOTICE MUST BE GIVEN AT LEAST 20 DAYS BEFORE THE PUBLIC MEETING IS HELD.

NOTICE OF THE PUBLIC MEETING WAS GIVEN AT THE JUNE 6, 2022, BYLAW AND PLANNING COMMITTEE MEETING AND PUBLISHED IN JUNE 16, 2022 EDITION OF ELLIOT LAKE STANDARD.

IF YOU WISH TO BE NOTIFIED OF THE DECISION OF THE CITY OF ELLIOT LAKE ON THE PROPOSED ZONING BYLAW AMENDMENT, YOU MUST MAKE A WRITTEN REQUEST TO THE CITY.

IF A PERSON OR A PUBLIC BODY WOULD OTHERWISE HAVE AN ABILITY TO APPEAL THE DECISION OF THE CITY OF ELLIOT LAKE TO THE LOCAL PLANNING APPEAL TRIBUNAL BUT THE PERSON OR BODY PUBLIC BODY DOES NOT MAKE ORAL SUBMISSIONS AT A PUBLIC MEETING OR MAKE WRITTEN SUBMISSIONS TO THE CITY OF ELLIOT LAKE BEFORE THE BYLAWS PASSED THE PERSON OR PUBLIC BODY IS NOT ENTITLED TO APPEAL THE DECISION.

IF A PERSON OR PUBLIC BODY DOES NOT MAKE ORAL SUBMISSIONS AT THE PUBLIC MEETING OR MAKE WRITTEN SUBMISSIONS TO CITY OF ELLIOT LAKE BEFORE THE BYLAWS PASS, THE PERSON OR PUBLIC BODY MAY NOT BE ADDED AS A PARTY TO THE HEARING OF AN APPEAL BEFORE THE LOCAL PLANNING APPEAL TRIBUNAL UNLESS THE OPINION OF THE TRIBUNAL THERE ARE REASONABLE GROUNDS TO DO SO.

A ZONING BYLAW AMENDMENT 26 ONTARIO AVENUE.

OKAY. MS.. BRAY, IF YOU WOULD, PLEASE.

THANK YOU YOUR WORSHIP SO I CAN GO OVER THE REPORT FROM THE PLANNER.

SO THE APPLICANT HAS INITIATED A ZONING BYLAW AMENDMENT TO PERMIT THE USE OF THE EXISTING STRUCTURE ON THE SUBJECT PROPERTY AS A PLACE OF WORSHIP.

THE SUBJECT PROPERTY HAS AN AREA OF APPROXIMATELY 606 SQUARE METERS AND A FRONTAGE OF APPROXIMATELY 21 METERS ON ONTARIO AVENUE.

THE SUBJECT PROPERTY IS ZONED CENTRAL COMMERCIAL SPECIAL EXCEPTION 2 C1-2 IN THE CITY OF ELLIOT LAKE ZONING BYLAW NUMBER 1836 SPECIAL EXCEPTION 2 PERMITS THE USE OF THE SUBJECT PROPERTY FOR A CRAFTS WORKSHOP.

IN ADDITION TO THE USES OTHERWISE PERMITTED IN THE CENTRAL COMMERCIAL ZONE, THE C-1 ZONE PERMITS THE USE OF LAND FOR VARIOUS USES, INCLUDING BUT NOT LIMITED TO COMMERCIAL USES, GOVERNMENT OFFICES, PERSONAL SERVICE SHOPS AND APARTMENT BUILDINGS.

HOWEVER, INSTITUTIONAL USES SUCH AS A PLACE OF WORSHIP ARE NOT PERMITTED AS A RIGHT ON THE SUBJECT PROPERTY AND THEREFORE A ZONING BYLAW AMENDMENT IS REQUIRED TO ALLOW FOR THIS USE IN THE C1 ZONE.

THE PROPOSED ZONING BYLAW AMENDMENT IS CONSISTENT WITH THE INTENT AND POLICIES OF THE PROVINCIAL POLICY STATEMENT THE GROWTH PLAN FOR NORTHERN ONTARIO AND THE CITY OF ELLIOT LAKE'S OFFICIAL PLAN. AND AS SUCH, THE AMENDMENT IS RECOMMENDED FOR APPROVAL.

I BELIEVE IT'S 7.3 IS THE REPORT AND 16.1 WOULD BE THE BYLAW.
