AN AGREEMENT ON PURCHASE AND SALE IS LATER ON IN THE AGENDA.

THESE TWO MEMOS 7.1, 7.2.

BOTH ADDRESS THOSE BYLAWS FOR AGREEMENT OF PURCHASE AND SALE JUST TO GIVE COUNCIL A QUICK BACKGROUND ON THE TWO OF THEM.

I HAVE A CONCERN WITH THE CHANGE IN THE AGREEMENT.

I WOULDN'T MIND IF IT SAID AVAILABILITY TO THE PROPERTY LINE, BUT THE WAY THAT THIS IS STATED AND THE WAY THAT THE BYLAW IS STATED ON PAGE 29, IT STATES THAT WE WILL PROVIDE HYDRO TO THE PROPERTY LINE.

THAT IS NOT STANDARD OPERATING PRACTICE.

NORMALLY WE DON'T DICTATE WHERE HYDRO IS GOING TO PUT THE SERVICE IN AND I'M NOT AT A $20,000 SALE OF A PIECE OF PROPERTY NOT INTERESTED IN HAVING TO PROVIDE. IF THAT LINE IS ON THE WRONG SIDE OF THE ROAD.

I DON'T WANT TO HAVE TO PAY TO BRING THAT LINE ACROSS AND DROP THE POLE IN ONTO HIS PROPERTY REGARDLESS OF WHOSE PROPERTY IT IS.

BUT I KNOW FOR A FACT THAT WE HAVE HAD TO DO THIS IN THE PAST WHERE THE PROPERTY ONE HYDRO LINE DOESN'T RUN EXACTLY ADJACENT OR ONTO THEIR PROPERTY AND THE PROPONENT ENDS UP HAVING TO PAY TO PUT THAT SERVICE IN.

SO I'M NOT IN FAVOR OF DOING IT THE WAY THAT IT'S WORDED.

I WOULD. BE WILLING TO DO IT.

BUT THE ASPECT THAT IT'S AVAILABLE TO THE PROPERTY LINE OR CLOSE TO THE PROPERTY LINE, THAT HYDRO IS AVAILABLE, BUT NOT THAT THE WAY THAT IT'S WORDED, WE MUST PROVIDE IT TO THE PROPERTY LINE AND I'M NOT WILLING TO DO THAT.

MR. DOYLE AND I, WHEN WE DID OUR SITE VISIT WITH HYDRO AT FOX DRIVE BECAUSE OF THE DESIGN AND THE TEARDROP.

THEY ACTUALLY WERE TALKING ABOUT INDIVIDUAL DROPS TO EACH OF THE PROPERTIES THAT ARE THERE.

THERE IS THE PROPERTY PURCHASED BY BUS LINES ON THE RIGHT HAND SIDE OF FOX DRIVE AND THE TWO LOTS, THE ONE LOT AT THE END FOR SEAMLESS EAVES TROUGH AND THE TWO LOTS ON THE LEFT HAND SIDE OF FOX DRIVE.

SO HYDRO HAD INDICATED THAT AS THEY GO THROUGH WITH THE DESIGN OF THE TEARDROP, THEY ARE GOING TO HAVE DROPS AT EACH ONE OF THE LOTS.

THANKS. HAVE HYDRO ACTUALLY REACHED OUT AND GOTTEN BACK TO US ABOUT THE INSTALLATION AND RUNNING OF HYDRO FOR THOSE LOTS THROUGH YOUR WORSHIP? NOT AS OF LATE, BUT THEY'VE BEEN USING MR. DOYLE AS THEIR POINT OF CONTACT.

MR. DOYLE WAS AWAY ON HIS HOLIDAYS LAST WEEK, SO I DON'T KNOW IF THERE'S BEEN A NUDGE FROM THEIR SIDE, BUT MR. DOYLE AND I DID DISCUSS IT TWO WEEKS AGO WITH PUSHING THROUGH A LITTLE BIT FURTHER.

SO WE'RE HOPING IT IS IMMINENT AT THE ANNUAL CONFERENCE.

DEFINITELY GAVE A BIG NUDGE TO HYDRO TO REACH OUT AND GET THIS PROJECT DONE.

SO I'M LOOKING FORWARD TO THAT.

QUESTION FOR MR. ANTUNES. REALISTICALLY, WHAT ARE THE PROBABILITY OR THE ODDS THAT THIS WILL BE COMPLETED BEFORE THE CONDITIONAL DATE OF SEPTEMBER 21ST? WHAT HAPPENS AFTER THAT, I GUESS IS MY QUESTION.

YEP. THROUGH YOUR WORSHIP, I'M VERY QUICKLY REALIZING THAT TO HOLD MY BREATH WHEN IT COMES TO ISSUES WITH HYDRO, AS NOTED IN THE AGREEMENT, IT WAS REVIEWED BY OUR SOLICITOR WHEN IT WENT THROUGH AND THE NOTE SAYS NO LATER THAN SEPTEMBER 21ST UNLESS THE PARTIES AGREE OTHERWISE IN WRITING AND MR. SAURO AND I AND THROUGH OUR SOLICITORS HAD THE DISCUSSION THAT IT WOULD JUST GET EXTENDED.

THE NOTE THERE ABOUT THE CONDITION CLOSING IN FAVOR OF THE PURCHASER IS THAT IF HYDRO DOES MAKE IT INDEFINITE, THAT IT DRAGS ON MUCH FURTHER, IS THAT HE WILL TAKE HIS INVESTMENT ELSEWHERE.

SO THAT IS WHERE THAT IS.

I'LL BE VERY HONEST, SEPTEMBER 21ST, I'M NOT HOLDING BREATH.

BUT AGAIN, THAT'S WHY WE ADDED THE EXTRA SENTENCE OF AN AGREEMENT IN WRITING FROM BOTH PARTIES TO EXTEND.

I WOULD WANT THAT TO CHANGE BECAUSE I'M NOT IN FAVOR OF DOING THIS THE WAY THAT IT IS.

I AM IN FULL FAVOR AND I TOTALLY UNDERSTAND THE GENTLEMAN'S CONCERNS THAT IF THERE'S NO HYDRO TO THE PROPERTY, HE'S NOT GOING TO BE ABLE TO BUILD.

BUT THE ISSUE IS, I'M NOT WILLING TO PUT IT INTO THE PURCHASE AND SALE AGREEMENT THAT WE WILL PROVIDE IT TO THE PROPERTY LINE BECAUSE YOU HAVE A CONVERSATION WITH HYDRO AND THEY SAY THAT'S WHAT THEIR PLAN IS OR THE POTENTIAL PLAN IS, DOESN'T MEAN THAT'S WHAT THEY'RE GOING TO DO.

WE BECOME ON THE HOOK THAT IF IT COSTS US $30,000 TO DROP THE LINE TO HIS PROPERTY LINE ACCORDING TO THIS PURCHASE AND SALE AGREEMENT, WE HAVE TO DO IT.

I WOULD WANT THAT WORDING CHANGED AND THAT WAS NOT IN THE ORIGINAL AGREEMENT THAT WE DISCUSSED.

BUT WE APPROVED THIS AS A COUNCIL.

IT WAS APPROVED THAT WE UNDERSTAND THAT IT NEEDS TO HAVE HYDRO TO THE PROPERTY, BUT IT'S AVAILABILITY OF HYDRO TO THE PROPERTY.

I'M NOT WILLING TO AGREE TO A PURCHASE THAT WE PAY TO GET IT TO HIS PROPERTY.

VERY OFTEN THE PROPERTY LINE, IT WILL BE ON THE OPPOSITE SIDE OF THE ROAD.

AND I'M NOT WILLING TO SIGN AN AGREEMENT TO DO THAT.

CERTAINLY IF IT'S THE WILL OF COUNCIL STAFF ARE HAPPY TO MAKE THE AMENDMENT FROM HYDRO CONNECTION TO THE BOUNDARY LINE OF THE PROPERTY, TO AVAILABILITY TO THE PROPERTY.

AND WE CAN JUST SEND IT BACK TO THE PROPONENT FOR AMENDMENT AND SIGNATURE AND WE CAN BRING IT BACK TO COUNCIL IF THAT'S THE WILL OF COUNCIL.

YOUR WORSHIP MY QUESTION TO MR. ANTUNES, JUST FOR ADDITIONAL INFORMATION, THE ORIGINAL INTENT OF THE HYDRO BEING INSTALLED IN THE AREA, WHO WAS PAYING FOR THAT INSTALLATION? THROUGH YOUR WORSHIP TO COUNCILLOR MANN.

IT IS BEING DONE BY THE MUNICIPALITY THROUGH OUR COMBINATION FED NOR NO HFC GRANT IF IT GOES THROUGH FOR THAT AND THE LIFT STATION AT THE END OF THE TEARDROP.

SO WE'RE PAYING FOR IT REGARDLESS AT THIS POINT TO RUN THE HYDRO DOWN DOWN FOX DRIVE AND IT'S BEING EXTENDED FROM PERINE ROAD ALL UP YOUR WORSHIP BUT WITHOUT POWER THESE LOTS HAVE A DIFFERENT POTENTIAL INTENTION, RIGHT? LIKE WE NEED THE INTENTION WAS TO PUT POWER THERE.

I UNDERSTAND THERE'S A COUPLE OF CONCERNS HERE I HAVE AS WELL.

THAT'S WHY I ASK THE QUESTION ABOUT THE SEPTEMBER 21ST DATE.

IT'S 30 DAYS AWAY, BUT I JUST NEEDED TO ENSURE THAT THIS IS A FUNDED PROJECT.

THE THREE YOUR WORSHIP IT'S THE APPLICATION IS IN, BUT WE HAVEN'T GONE THROUGH TO THE FUNDING PROGRAM BECAUSE WE DON'T KNOW WHAT IT'S GOING TO COST.

SO HYDRO IS HIGH.

THE LIFT STATION IS VERY SIMPLE BECAUSE WE COST THAT OUT OURSELVES AND MR. HALLOCH AND MR. DOYLE HAVE THE ABILITY TO COST THAT OUT.

SO AS FAR AS FUNDING, WE'RE STILL IN THE APPLICATION PROCESS AND WE'RE IN STAGE ONE SO THAT WE'RE READY.

BUT WE CAN'T PUT IN OUR FINAL STAGE OF THE APPLICATION BECAUSE WE HAVE NO IDEA WHAT THE COST IS.

BUT THE ASSUMPTION IS THAT THOSE LOTS WERE TO ALL BE PROVIDED WITH HYDRO AND OF COURSE SEWER AND WATER ALREADY EXIST UNDER THE ROAD SURFACE.

ACCORDING TO THIS, ONTARIO HYDRO HAS INSTALLED A HYDRO LINE CONNECTION TO THE BOUNDARY LINE, NOT THE CITY.

HYDRO. THROUGH YOUR WORSHIP? YES, COUNCILLOR TURNER, IT'S WORDED THAT WAY BECAUSE THE INSTALLATION FOR THAT SERVICE HAS TO BE DONE BY ONTARIO HYDRO.
