THAT IS WHAT OUR OFFICIAL PLAN DOES. OUR OFFICIAL PLAN SAYS NO RETAIL IN RESIDENTIAL HOMES. THAT'S WHY YOU NEED THE ZONING AMENDMENT APPLICATION. BUT I'M JUST VERY CONCERNED AND I WOULD LOVE TO SEE YOU BE DOING HUNDREDS OF CUSTOMERS A WEEK. I THINK IT IS A PERFECT FIT NOT ONLY IN OUR COMMUNITY, BUT IN OTHER COMMUNITIES. WE DO FEEL THAT THE APPLICATION IS CONSISTENT WITH THE PPS AS THE PROPERTY IS LOCATED WITHIN THE SETTLEMENT AREA OF THE CITY OF ELLIOT LAKE, [00:15:04] AND IT HAS ACCESS TO MUNICIPAL SERVICING AS WELL AS ADEQUATE ROAD NETWORK. THE PROPOSAL TO PERMIT A HOME BASED BUSINESS SUPPORTS A SMALL LOCAL BUSINESS THAT'S STARTING OUT AND PROMOTING ECONOMIC DEVELOPMENT WITHIN THE CITY. ADDITIONALLY, WE DON'T ANTICIPATE ANY MAJOR NOISE OR NUISANCE DUE TO THE NATURE OF THE PROPOSED BUSINESS. SIMILARLY, WITH RESPECT TO THE GROWTH PLAN FOR NORTHERN ONTARIO, THIS DOCUMENT GENERALLY SUPPORTS ECONOMIC DEVELOPMENT AND INNOVATIVE BUSINESS IDEAS. THE PROPOSED USER IS SUPPORTED OR DOES NOT CONFLICT WITH THE GROWTH PLAN FOR NORTHERN ONTARIO. WITH RESPECT TO THE OFFICIAL PLAN, THE PROPERTY IS LOCATED WITHIN THE CITY OF ELLIOT LAKE URBAN SETTLEMENT AREA, AND IS DESIGNATED RESIDENTIAL. THE OFFICIAL PLAN DOES CONTAIN POLICIES ON HOME BASED BUSINESSES AND NOTES TO PROVIDE ECONOMIC DEVELOPMENT OPPORTUNITIES. IT'S THE POLICY OF COUNCIL TO PERMIT HOME BASED BUSINESSES, AND THAT RESIDENTIAL AREAS IN THE CITY ARE PERMITTED TO HAVE RESIDENTIAL DWELLINGS AND OTHER COMPATIBLE USES, INCLUDING NEIGHBORHOOD COMMERCIAL USES. AT THIS SCALE, WITH THE PROPOSED NATURE OF THE HOME BASED BUSINESS, WE DO FEEL THAT THIS CONFORMS TO THE CITY'S OFFICIAL PLAN. FINALLY, WITH RESPECT TO THE ZONING BYLAW, RIGHT NOW THE PROPERTY IS ZONED RESIDENTIAL ONE AND TWO UNIT DWELLINGS. THAT'S THEY ARE ONE ZONE. THIS ZONE DOES PERMIT HOME BASED BUSINESSES AS OF RIGHT IN THE ZONE. BUT AS IS MENTIONED, IT DOESN'T PERMIT THE RETAIL COMPONENT SPECIFICALLY DOES NOT ALLOW FOR THOSE GOODS WARES MERCHANDISE OTHER THAN WHAT'S PRODUCED ON THE PREMISES TO BE OFFERED FOR SALE. THOSE TWO COMPONENTS ARE WHAT THE EXCEPTION IS FOR. THE ZONING BYLAW IMPORTANTLY DOES INCLUDE OTHER CRITERIA WHICH LIMITS THE SCALE AND NATURE OF A HOME BASED BUSINESS TO MAKE SURE THAT IT'S COMPATIBLE WITH OUR RESIDENTIAL AREAS, AS WELL AS THE PART OF THE PURPOSE OF THE HOME BASED BUSINESS, COULD BE SOMEWHAT STARTING OUT, MAYBE CREATING A BUSINESS, TESTING THE WATERS, AND IF IT GETS BIGGER BEYOND THE SCALE OF WHAT WOULD THAT BE PERMITTED IN THE ZONING BYLAW, THEN IT WOULD BE AN APPROPRIATE TIME TO PERHAPS SEEK A RELOCATION TO A MORE APPROPRIATE COMMERCIAL AREA. WE DO HAVE THE OTHER CRITERIA OF SECTION 5.6 FROM THE ZONING BYLAW, WHICH ARE LAID OUT IN THE MEMORANDUM, WHICH LIMITS THE SCALE AND SCOPE OF OUR HOME BASED BUSINESSES, INCLUDING THIS ONE. THAT HAS THE CRITERIA OF THE NUMBER OF EMPLOYEES. THE CRITERIA INDICATES THAT YOU CAN ONLY HAVE ONE EMPLOYEE OTHER THAN THE OCCUPANTS OF THE DWELLING. THAT AREA OF THE DWELLING OCCUPIED HAS TO BE LESS THAN 25 PERCENT OF THE TOTAL FLOOR AREA OF THE DWELLING. WE DO FEEL THAT THE CRITERIA LAID OUT IN SECTION 5.6 ARE MET BY THE PROPOSAL, AND THAT IS IMPORTANT JUST AS A RESPONSE TO THE CONCERNS RAISED BY COUNSELOR PATRICK, BECAUSE WE DO HAVE THESE ADDITIONAL MEASURES WHICH LIMIT THE SIZE AND SCALE OF THE USE TO NOT BECOMING SOMETHING MORE, WHERE IT'S MORE OF A PRIMARILY COMMERCIAL USE OR JUST A LARGER COMMERCIAL USE THAN WHAT WE WOULD WANT TO SEE PERMITTED IN THE RESIDENTIAL AREA. OVERALL, WE DO FEEL THAT THE APPLICATION FOR THE AMENDMENT IS CONSISTENT WITH THE TPS, THE GROWTH PLAN FOR NORTHERN ONTARIO, AND CONFORMS TO THE CITY'S OFFICIAL PLAN. WE WOULD RECOMMEND THAT COUNCIL ENACT THE BYLAW. TERESA ON THE SUBJECT PLANS TO PERMIT THE REFINERY AS A HOME BASE BUSINESS TO ALLOW FOR THE SALE OF GOODS, WARES, AND MERCHANDISE PRODUCED ELSEWHERE TO BE SOLD ON THE PROPERTY. I WOULD JUST MENTION TO YOU AS A NOTE TO COUNSELOR PATRICK'S COMMENTS. I DO FEEL THAT THE CRITERIA CONTAINED IN SECTION 5.6 DO SUFFICIENTLY LIMIT THE SCOPE AND THE SCALE OF THE PROPOSED BUSINESS TO THOSE CONCERNED ABOUT IT GOING TO SOMETHING MAYBE LARGER OR MORE OF A RETAIL STORE. THAT BEING THE HOME BASED BUSINESS AND SECONDARY. BUT WE CAN HAVE ADDITIONAL MEASURES IF YOU WOULD LIKE TO LIMIT THAT RETAIL STORE COMPONENT TO MAYBE BEING JUST THE PICKUP OR THE DELIVERIES THAT THE APPLICANT WAS TALKING ABOUT. WE MIGHT JUST WANT TO ASK THE APPLICANT TO RESPOND IF SHE IS ANTICIPATING HAVING A STORE AS IN PEOPLE COMING IN, PERUSING, AND THEN LEAVING, OR IF SHE'S INTENDING TO KEEP IT AS THAT DELIVERY AND PICKUP, BECAUSE THAT'S SOMETHING THAT WE COULD INCLUDE IN THE ZONING BILATERAL LIMIT THAT POTENTIAL, IF YOU WOULD LIKE. [00:20:01] HOWEVER, AS I NOTED, THIS HOME BASED BUSINESS AND GENERALLY HOME BASED BUSINESS POLICIES ARE MEANT TO ALLOW NOT ONLY JUST A SMALL SCALE HOME BASE USE THAT MIGHT REMAIN IN PERPETUITY, BUT ALSO THOSE STARTER TYPE BUSINESSES, WHICH MAYBE IT'S THEY'RE TESTING NEW GROUNDS. ONCE IT GETS TO A CERTAIN SCALE OR CERTAIN AMOUNT OF CUSTOMER BASE, IT MIGHT BE MORE APPROPRIATE TO LOCATE ELSEWHERE IN A COMMERCIAL AREA. YOU DON'T NEED TO HAVE COMMERCIAL INSURANCE. YOU DON'T HAVE TO BE ACCESSIBLE AND YOU DON'T NEED TO HAVE A VENDOR'S PERMIT NUMBER. YOU DON'T NEED TO HAVE AN HST NUMBER. THERE'S JUST NO SAFEGUARDS. WHEN WE ARE CONSIDERING A RETAIL COMPONENT OR AN OFFICE OR SOME OTHER HOME BASED BUSINESS, THERE IS PARKING REQUIRED. IF WE'RE LOOKING AT A LARGER RETAIL COMPONENT, THEN ADDITIONAL PARKING WOULD BE REQUIRED, WHICH MAY NOT BE ABLE TO BE PROVIDED ON RESIDENTIAL LOTS AND THEN MAY NOT HAVE A FAVORABLE RECOMMENDATION AS A RESULT OF THAT, FOR EXAMPLE, OR JUST AGAIN, IF WE'RE CONSIDERING A MUCH LARGER RETAIL COMPONENT, THAT THERE IS THE POTENTIAL FOR ADDITIONAL TRAFFIC IN THE NEIGHBORHOOD.
