[00:00:03]
GOOD EVENING. I'D LIKE TO CALL TO ORDER THE SPECIAL COUNCIL MEETING DATED DECEMBER 1ST AT 6:00 PM.
[1. CALL TO ORDER]
IT WAS SCHEDULED.ROLL CALL. ALL MEMBERS ARE PRESENT.
DO WE HAVE ANY DECLARATIONS OF CONFLICT OF INTEREST? GOING ONCE, GOING TWICE, THREE TIMES.
WE DO HAVE A PUBLIC INPUT REQUEST THAT CAME IN FROM CHRISTINE ROBERTS.
[4. PUBLIC INPUT SESSION]
PLEASE COME UP TO THE PODIUM.STATE YOUR NAME FOR THE RECORD.
I'M CHRISTINE ROBERTS, CURRENT PRESIDENT OF THE ELLIOT LAKE ARTS CLUB.
I JUST WANTED TO GIVE A BRIEF HISTORY OF THE ARTS CLUB.
IN THE SEVENTIES, WE BECAME INCORPORATED.
IN 2019, WE HAD A MEMBERSHIP OF 75 TO 80 MEMBERS, NOW WITH 6 BUSY STUDIOS.
THE FEDNOR GRANT, WAS SUPPOSED TO GO TOWARDS AN ART CENTER THROUGH YOU, MR. MAYOR. I HAVE A FEW QUESTIONS THAT I WOULD LIKE TO PROBABLY ASK SPECIAL PROJECTS OR WHOEVER HAS PLANS.
WE WILL NOT ANSWER THEM AS YOU ASK THEM.
WE MAY. WE MAY BE ABLE TO GIVE YOU THOSE ANSWERS WHILE WE DELIBERATE THE WAY THAT OUR CURRENT PROCEDURAL BYLAW STIPULATES NOW IS WE CANNOT ANSWER QUESTIONS.
OH. SO WE MAY BE ABLE TO ANSWER SOME OF THOSE AS WE GO THROUGH THE MEETING AFTERWARDS.
BUT WE CAN'T DO IT BACK AND FORTH WITH QUESTIONS UNTIL WE CHANGE OUR PROCEDURAL BYLAW RIGHT NOW.
OKAY, SO I JUST READ MY QUESTIONS.
OKAY. DO THE PLANS INCLUDE INTERIOR WALLS, CEILINGS AND DOORS? ADEQUATE LIGHTING FOR TWO SPACES OF 30 TO 35,000 CUBIC FEET OF AIR SPACE.
HEAVY DUTY HOOKUPS FOR THE KILN, WHICH WAS PROVIDED AT THE CIVIC CENTRE.
NO PROBLEM. SO THIS NEW PLAN FOR $1.5 MILLION, HOPEFULLY IT'S GOOD FOR MORE THAN APPROXIMATELY 3,000 SQUARE FEET OF NICE FLAT FLOOR.
IMPRESSION OF THIS WHOLE THING FEELS LIKE PULLING THE WOOL OVER FEDNOR'S EYES AND ELLIOT LAKERS.
AND IT'S NOT A GOOD LOOK FOR THIS BRAND NEW COUNCIL.
THANK YOU. THANK YOU, MS. ROBERTS. I DO BELIEVE THAT WE WILL COVER SOME OF THOSE QUESTIONS IN OUR DELIBERATION THROUGH THIS TONIGHT.
WITH THAT, WE HAVE NO PUBLIC PRESENTATIONS.
[6.1 Report of the Acting Director of Public Works]
WE HAVE ONE REPORT THAT'S WHAT THE SPECIAL MEETING IS ABOUT.AND THE RECOMMENDATION FOR THE REPORT IS THAT THE REPORT OF THE ACTING DIRECTOR OF PUBLIC WORKS BE RECEIVED AND THAT STAFF BE DIRECTED TO PROCEED WITH PREPARING A REVISED TENDER DOCUMENT AND PROCEED TO TENDER AS SOON AS POSSIBLE FOR THE DOWNTOWN ARTS CENTRE AND THAT STAFF LIAISE WITH FEDNOR TO AMEND THE EXISTING FUNDING AGREEMENT IN PLACE FOR THE REVISED SCOPE OF WORK.
AND CAN I GET A MOVER AND A SECONDER? COUNCILLOR MORISSETTE.
SO THE MAJORITY OF THE PEOPLE HAVE READ THE REPORT.
WE ARE LOOKING AT RENOVATING BOTH SIDES, LEVELING THE FLOORS ON BOTH SIDES.
THERE WILL BE SOME SPECIAL AREAS FOR THE PRINTING PRESS, THE KILN.
THERE WILL BE HYDRO AVAILABLE FOR THAT.
BUT WE'RE ACTUALLY LOOKING AT 6,000 SQUARE FEET OF USABLE SPACE FOR THE USER GROUPS.
WE'RE NOT LOOKING AT PUTTING THE MUSEUM INTO THIS SPACE.
THE SPACE WILL BE RENOVATED FOR USER GROUP SPACE ONLY.
PRETTY MUCH. THAT IS OUR NEW ASK OF FEDNOR.
[00:05:06]
IN THE NEAREST POSSIBLE FUTURE THAT THIS COUNCIL CAN WORK RAPIDLY AT.SO WE'RE HOPING THAT WITHIN 2023 WE HAVE PLANS, TENDERS OUT AND BE READY TO START REBUILDING WHAT WE'VE LOST. SO I PERSONALLY BELIEVE THAT WE'RE DOING THIS IN THE BEST INTEREST OF THE PEOPLE THAT HAVE LOST THEIR SPACES AND IT GIVES THEM SOMEWHERE TO GO AS OPPOSED TO JUST WALKING AWAY FROM THE GRANT AND NOT BEING ABLE TO GET ANYTHING COMPLETED BY THE END OF MARCH WHERE WE WOULD LOSE THAT GRANT COMPLETELY.
WITH THAT BEING SAID, DO WE HAVE ANY QUESTIONS OF COUNCIL? COUNCILLOR MANN.
HAS COUNCIL OR THE CITY STAFF SPOKEN TO FEDNOR ABOUT THIS REVISION? THIS ISN'T SOMETHING THAT WE'RE DOING WITHOUT INVOLVING FEDNOR.
CORRECT. SO I HAD A A PHONE CONVERSATION WITH MR. GOULDING AND MRS. ROSETTE OF FEDNOR.
FEDNOR KNOWS THAT THIS AMENDMENT IS COMING FORWARD.
SO WE DO HAVE TO WORK EXTREMELY FAST AND DO OUR DUE DILIGENCE AND GET THIS.
HENCE THE SPECIAL MEETING OF COUNCIL AND NOT WAITING UNTIL THE DECEMBER 12TH MEETING.
WE THINK THAT THAT EXTRA WEEK MR. GOULDING HAS BEEN WORKING HIS BUTT OFF TO GET THIS TO WHERE WE NEED IT TO BE AT THIS POINT.
AND WE JUST DON'T WANT TO LOSE THIS.
WE DO REALIZE THAT WE DO HAVE THE CHRISTMAS SEASON COMING FORWARD.
ANY OTHER? COUNCILLOR FLINTOFF. THANK YOU.
YOUR WORSHIP. THROUGH YOU, YOUR WORSHIP AS PROJECT MANAGER BILL GOULDING.
FOUR MONTHS IS NOT VERY LONG BUILT IN YOUR.
I'M NOT HOLDING YOU TO NOTHING BUT YOU.
IS IT REALLY FEASIBLE? DOES IT HAVE TO BE TOTALLY DONE BY THE END OF MARCH OR WE LOSE A 750,000? AND THEN IF WE COMMITTED TO THIS, THEN THE REST $750 COMES BACK TO THE TAXPAYERS.
I JUST WANT YOUR I'M JUST WANT YOUR OPINION, THAT'S ALL.
YEAH. THROUGH YOU, YOUR WORSHIP.
BUT THE CURRENT AMENDMENT THAT WE HAVE IN PLACE RIGHT NOW, IF MEMORY SERVES ME CORRECTLY, WE'RE OBLIGATED TO SPEND $938,000 IN ORDER TO RECEIVE $750,000.
NOW, SHOULD THAT APPETITE CONTINUE ON FEDNORS PART WHEN THEY RETURN WITH AN AMENDED OFFER OF GRANT TO US, THEN TECHNICALLY WE COULD GET TWO THIRDS OF THE PROJECT DONE AND STILL MEET THEIR REQUIREMENTS.
THEY HAVE SOME LEVEL OF CONFIDENCE OR COMFORT BECAUSE WE HAVE FUNDS IN HAND TO COMPLETE.
NORMALLY THEY WOULDN'T BE THIS FLEXIBLE AT ALL.
I DON'T KNOW WHAT I EXPECT TO SEE WHEN I'M FINISHED DEALING WITH FEDNOR.
THEY'RE AS CONCERNED ABOUT TIMELINES AS WE ARE.
THANKS, BILL. I MEAN, THAT'S YOU KNOW, I WAS JUST CURIOUS.
DO WE HAVE ANY CONTRACTORS SORT OF LINED UP YET? I KNOW WE DISCUSSED IT SOMEWHAT, BUT.
NO, WE HAVEN'T SOLIDIFIED RELATIONSHIPS WITH CONTRACTORS AS YET, BUT WE HAVE ENGAGED OUR EXISTING DESIGN TEAM AND THEY, FOR THE PREVIOUS PROJECT, HAD A SHORT LIST IN PLACE.
WE'RE GOING TO EXPAND THAT SOMEWHAT AND I DON'T HAVE A CONCERN WITH BEING ABLE TO FIND BIDDERS FOR THE PROJECT. THANK YOU.
COUNCILLOR SEIDEL. THANK YOU YOUR WORSHIP THROUGH YOU.
IF THIS IS APPROVED TONIGHT, WHAT TIME FRAME ARE WE LOOKING AT AS GETTING THE TENDERS OUT TO BID? AND THEN AFTER THAT, HOW LONG ARE WE PUTTING ON THE TENDERS TO COME TO, YOU KNOW,
[00:10:07]
TO GET THE PROCESS IN TO, YOU KNOW, AWARD A BIDDER OR GO BACK OR LOOK AT IT SO? THROUGH YOU, YOUR WORSHIP.SO I'VE BEEN SPEAKING TO OUR DESIGN TEAM ALL WEEK ON VARIOUS ISSUES, AND THIS CERTAINLY HAS COME UP.
THEY'VE THEY SAID, WELL, A WEEK MIGHT BE A LITTLE TIGHT TO GET SOMETHING DONE.
THEY KNOW THAT TWO WEEKS IS TOO LONG.
SO THE BEST, MOST ACCURATE ANSWER I CAN GIVE TO THAT QUESTION IS SOMEWHERE BETWEEN ONE AND TWO WEEKS TO GET A TENDER PACKAGE OUT AND THEN A TENDER PERIOD OF TWO WEEKS IS WHAT WE'RE ANTICIPATING. THANK YOU.
SO YOU'RE LOOKING AT FIRST WEEK OF THE NEW YEAR? APPROXIMATELY. THAT'S WHAT WE'RE SHOOTING, HOLIDAYS COMING IN AND STUFF LIKE THAT.
COUNCILLOR BULL. THANK YOU YOUR WORSHIP THROUGH YOU.
TO BILL OR MR. GOULDING. SORRY. THE QUESTIONS THAT WERE ASKED ARE ALL THOSE PART OF THE NEW PLAN, THE KILN, THE HOOKUP, THE 30 TO 35,000, I THINK YOU SAID AIRSPACE.
AND THE LIGHTING. AND OF COURSE, THERE'LL BE WALLS, I'M SURE, BUT.
SO THE DESIGN DOCUMENTS ARE NOT YET DONE.
SO IT'S HARD FOR ME TO ANSWER THAT WITH CERTAINTY, BUT I CAN ANSWER SOME THINGS SPECIFICALLY.
PLACE TO PUT PRINTING PRESSES? YES. I BELIEVE ONE OF THE QUESTIONS WAS PARTITION WALLS, DOORS ARE.
I INCLUDED THEM IN MY ESTIMATING AND WAS ABLE TO MEET BUDGET.
OUR DESIGN TEAM HASN'T, SO WE'RE TRYING TO FIGURE OUT HOW THAT MIGHT WORK.
LIGHTING IS IN A SIMILAR SITUATION.
SO AS HIS WORSHIP MENTIONED, I'VE BEEN WORKING QUITE DILIGENTLY TO TRY AND FIGURE OUT THESE DETAILS AND IT'S GOING TO CONTINUE THROUGH THE NEXT WEEK AND A HALF.
THANK YOU. ANY OTHER QUESTIONS OF COUNCIL? COUNCILLOR WANNAN.
IS THERE ANY CURRENT NUMBER ON THE MEMBERSHIP OF THE ARTS CLUB? ROBERTS SPEAKING, SO THEY'RE DOWN TO 35 TO 40 MEMBERS IN THE ARTS CLUB FROM THE 85 THAT THEY HAD PRIOR TO THE COLLAPSE.
YES, GO AHEAD. THROUGH YOU, YOUR WORSHIP.
ABSOLUTELY. SO THE 6,000 SQUARE FEET THAT POTENTIALLY ARE GOING TO BE AVAILABLE.
YOU MENTIONED YOU ONLY WANTED 3,000.
BUT WE WILL ENTERTAIN AND USE YOUR EXPERTISE.
WELL, I DON'T REALLY KNOW WHERE YOU GOT THE 6,000 FROM.
EITHER I DIDN'T DO MY MATH RIGHT OR BECAUSE I WAS THINKING 3,000.
THERE'S ACTUALLY 6,000 FEET ROUGHLY OF SPACE THAT'S GOING TO BE RENOVATED IN THE GRANT.
SO INSTEAD OF JUST HAVING THE 3,000 ON THE ONE SIDE, BOTH SIDES WILL BECOME.
YEAH, BUT I THOUGHT I ADDED I THOUGHT I MULTIPLIED WITH THAT I HAD 53 FOR WIDTH THAT'S BOTH THEATERS TIMES 65 WHICH IS THE LENGTH 65 OR 69.
[00:15:04]
AND THAT'S THAT'S THE LENGTH AND THE FULL WIDTH, THE TWO THEATERS.AND I DON'T HAVE THAT EXACT NUMBERS IN HERE, BUT THOSE NUMBERS I JUST TOOK OFF THE THE ORIGINAL MAPS OF THE SPACE.
I'M GOING TO NEED MR. GOULDINGS BECAUSE THE ISSUE BECOMES WE'VE LOOKED INTO THIS VERY THOROUGHLY BECAUSE WE ARE JUST OVER THE THRESHOLD OF REQUIRING ENGINEERS TO DO THE WORK, WHICH IS 600 SQUARE METERS, WHICH IS 6,800 SQUARE FEET, ROUGHLY, IT'S OVER 6,000 FEET.
AND THAT'S THE CAVEAT THAT PUTS YOU INTO REQUIRING AN ENGINEER.
IF IT WAS 800 FEET SMALLER, I DO BELIEVE WAS THE NUMBER THAT WE NEEDED.
WE WOULDN'T EVEN NEED ENGINEERS.
WE'D BE ABLE TO MOVE FORWARD IN A MUCH QUICKER CAPACITY TO DO THIS.
SO IT IS OVER 6,000 SQUARE FEET THAT I CAN GUARANTEE YOU.
ONE MORE QUESTION THROUGH YOU TO MR. GOULDING. SO HOW MANY STUDIOS DO YOU THINK WOULD BE ABLE TO BE PUT IN THERE, OR DO YOU KNOW HOW MANY SQUARE FEET OF STUDIO NEEDS? THROUGH YOU, YOUR WORSHIP.
SO THERE'S VARYING DISCIPLINES THAT THE ARTS GROUP ACCOMMODATES AND AS WELL THERE'S A MODEL TRAIN CLUB THAT WAS A PREVIOUS TENANT OF THE PEARSON CIVIC CENTRE.
BUT IN BROAD STROKES, WE'RE LOOKING AT ACCOMMODATING EACH OF THOSE GROUPS WITH ROUGHLY THE EQUIVALENT AMOUNT OF SPACE, AS WAS SEEN IN THE FINAL THIRD OPTION THAT WAS DISCUSSED ON THE AUGUST 8TH COUNCIL MEETINGS OR IT WAS IN THE IN THE SUMMER OF THIS PAST YEAR.
SO IT'S REALLY DOWN TO VERY FINE ADJUSTMENTS IN THE DESIGN, WHETHER ONE GROUP WOULD GAIN OR LOSE A LITTLE BIT.
IT WAS IT'S A GAME OF INCHES, LITERALLY.
AND I CAN'T SAY WITH CONFIDENCE HOW ANY ONE GROUP WOULD FARE RIGHT NOW WITH ANY CERTAINTY .
YEAH, THEY HAVE SIX STUDIOS BEFORE AND HOPEFULLY THAT'S WHAT WE CAN GET IN THERE AGAIN.
BUT SOMETHING HAS TO BE DONE HERE, SO THANK YOU, BILL.
NO FIRST NAMES. COUNCILLOR MORISSETTE.
THROUGH YOU, YOUR WORSHIP FOR BILL.
I UNDERSTAND THAT THE KILNS TAKE MORE HYDRO THAN YOU KNOW US USING HYDRO HERE FOR THE LIGHTS.
LET'S SAY FOR THE CHRISTMAS LIGHTS.
COULD THAT BE ON A SEPARATE METER? THROUGH YOU, YOUR WORSHIP.
CERTAINLY I HAVE A SAYING IN CONSTRUCTION PROJECTS THAT ANYTHING'S POSSIBLE.
WE'RE LOOKING TO MINIMIZE PRICE.
I WOULDN'T PURPORT TO MAKE THAT ACCOMMODATION RIGHT NOW.
THE QUESTION IS, IS IT POSSIBLE? YES, IT'S CERTAINLY POSSIBLE.
DO I ANTICIPATE THAT WE'LL BE DOING THAT IN THIS PROJECT? NO, I DON'T ANTICIPATE THAT WE'LL BE DOING THAT IN THIS PROJECT.
FOLLOW UP. THROUGH YOU, YOUR WORSHIP.
I DON'T KNOW. MAYBE I'M JUMPING THE GUN ON THIS.
SO LET'S SEE IF ALL THE RENOVATIONS ARE DONE BY MARCH, APRIL.
DO WE GET AND DO WE ENTER INTO AN AGREEMENT WITH THE ARTS CLUB FOR RENT AND STUFF LIKE THAT? WE WILL BE ENTERING INTO RENTAL AGREEMENTS WITH ALL OF THE USERS, AND WE ALWAYS HAVE, WE ALWAYS WILL.
THERE'S GOING TO BE INSURANCE CAVEATS TO BE PUT INTO PLACE.
THERE WILL BE MONTHLY LEASE AGREEMENTS FOR EACH USER GROUP.
[00:20:05]
SO THIS ISN'T JUST HERE'S A SPACE DO WITH WHAT YOU WILL.AND IT WAS AT THE PEARSON CENTRE AS WELL.
ALL OF THAT DOCUMENTATION HAS ALWAYS BEEN PUT INTO PLACE WITH THE MUNICIPALITY.
ANY OTHER QUESTIONS? SO I'LL JUST I'LL JUST FINISH OFF WITH BEFORE WE CALL FOR THE VOTE.
SO THE MAIN ISSUE IS IF WE DON'T DO THIS TONIGHT, WE'RE NOT GOING TO GET THE $750.
SO I THINK THE IMPORTANT THING IS THAT WE GET THIS APPLICATION MOVING FORWARD AND HOPEFULLY WE PAN OUT THAT THIS ACTUALLY WORKS PERFECT AND WE GET THE $750,000. WE DO UNDERSTAND THAT WE NEED TO TAKE CARE OF THE USER GROUPS AND GIVE THEM SOMEWHERE.
SO THIS ACTUALLY GIVES THE USER GROUP SOMEWHERE TO GO IN THE CURRENT FORESEEABLE FUTURE.
SO WITH THAT, I'LL CALL THE VOTE.
ALL IN FAVOR. THAT MOTION IS CARRIED.
WE HAVE NO NOTICE OF MOTION, NO CLOSED SESSION, NO BYLAWS OTHER THAN OUR CONFIRMATORY BYLAW.
[10.1 By-Law 22-113]
AND THAT IS THE BYLAW [INAUDIBLE] THE BEING A BYLAW TO CONFIRM THE PROCEEDINGS OF COUNCIL AT THE SPECIAL MEETING HELD ON THURSDAY, DECEMBER 1ST, 2022.CAN I GET A MOVER? COUNCILLOR MANN.
ANY QUESTIONS, CONCERNS? ALL IN FAVOR.
AND CAN I GET A MOTION TO ADJOURN? COUNCILLOR MORISSETTE, COUNCILLOR FLINTOFF.
ALL IN FAVOR. WE ARE ADJOURNED.
THANK YOU VERY MUCH.
