I'D LIKE TO CALL TO ORDER THE SPECIAL COUNCIL MEETING DECEMBER 12TH AT 6 P.M., WHICH IS A ZONING BYLAW AMENDMENT MEETING.

ALL MEMBERS ARE PRESENT, AND I'M GOING TO READ [INAUDIBLE].

I'D LIKE TO DECLARE THIS MEETING OPEN, AND THIS IS A PUBLIC MEETING HELD BY COUNCIL UNDER SECTION 34 OF THE PLANNING ACT.

THIS MEETING IS DECLARED OPEN.

THIS PUBLIC MEETING IS TO CONSIDER A ZONING BYLAW AMENDMENT TO THE CITY OF ELLIOT LAKE ZONING BYLAW 1836.

[3. REPORTS]

THE PURPOSE OF THIS PUBLIC MEETING IS TO CONSIDER A PROPOSED ZONING BYLAW AMENDMENT UNDER SECTION 34 OF THE PLANNING ACT TO CORRECT ANOMALIES IN THE CITY'S ZONING BYLAW NUMBER 1836.

THE AMENDMENT WILL AMEND THE WORDING AND DEFINITIONS, GENERAL PROVISIONS AND CERTAIN ZONES TO MORE CLEARLY REFLECT THE INTENT OF THE CITY.

NOTICE OF CIRCULATION AND APPEAL STATEMENTS IN ACCORDANCE WITH THE REGULATIONS OF THE PLANNING ACT.

THE PUBLIC MEETING IS A REQUIREMENT OF THE PLANNING ACT IN ACCORDANCE WITH THE PLANNING ACT.

NOTICE MUST BE GIVEN AT LEAST 20 DAYS BEFORE THE PUBLIC MEETING IS HELD.

NOTICE OF THE PUBLIC MEETING WAS GIVEN ON NOVEMBER 7TH, 2022 BYLAW AND PLANNING COMMITTEE MEETING AND PUBLISHED IN THE NOVEMBER 17TH, 2022 EDITION OF THE ELLIOT LAKE STANDARD.

IF YOU WISH TO BE NOTIFIED OF THE DECISION OF THE CITY OF ELLIOT LAKE ON THE PROPOSED ZONING BYLAW AMENDMENT, YOU MUST MAKE A WRITTEN REQUEST TO THE CITY IF A PERSON OR PUBLIC BODY WOULD OTHERWISE HAVE AN ABILITY TO APPEAL THE DECISION OF THE CITY OF ELLIOT LAKE TO THE PLANNING ACT TRIBUNAL BUT THE PERSON OR PUBLIC BODY DOES NOT MAKE ORAL SUBMISSIONS AT A PUBLIC MEETING OR MAKE WRITTEN SUBMISSIONS TO THE CITY OF ELLIOT LAKE BEFORE THE BYLAW IS PASSED.

THE PERSON OR PUBLIC BODY IS NOT ENTITLED TO APPEAL THE DECISION.

IF A PERSON OR PUBLIC BODY DOES NOT MAKE ORAL SUBMISSIONS AT A PUBLIC MEETING OR MAKE WRITTEN SUBMISSIONS TO THE CITY OF ELLIOT LAKE BEFORE THE BYLAW IS PASSED, THE PERSON OR PUBLIC BODY MAY NOT BE ADDED AS A PARTY TO THE HEARING OF AN APPEAL BEFORE THE LOCAL PLANNING APPEAL TRIBUNAL.

UNLESS, IN THE OPINION OF THE TRIBUNAL, THERE ARE REASONABLE GROUNDS TO DO SO.

WE HAVE READ THIS ALREADY A COUPLE OF TIMES.

WE'VE HAD THIS PRESENTATION BY MS. VEREAULT. I APPRECIATE YOU COMING AND BRINGING THIS MULTITUDE OF PAGES BACK TO US AGAIN.

WITH THAT, GO AHEAD, PLEASE.

THANK YOU, YOUR WORSHIP AND MEMBERS OF COUNCIL.

CAN YOU HEAR ME OKAY? YES. OKAY, PERFECT.

YEAH, SO AS WAS MENTIONED, THIS IS A HOUSEKEEPING AMENDMENT TO FIX ERRORS AND OMISSIONS IN THE CITY'S CURRENT ZONING BYLAW.

JL RICHARDS HAS WORKED WITH THE CITY SINCE 2018 WITH THIS BYLAW AND TO ADOPT A NEW ZONING BYLAW CONCURRENT WITH THE NEW OFFICIAL PLAN FOR THE CITY.

AT THAT TIME, THE BYLAW CONSISTED OF PORTIONS OF THE CITY'S FORMER BYLAW, WHICH WAS DONE IN 1987, AS WELL AS AMENDMENTS THAT WERE RECOMMENDED DURING AN INTERNAL REVIEW OF THE BYLAW BY THE CITY BACK IN 2004, BUT THAT WERE NEVER IMPLEMENTED.

SO WE KIND OF BROUGHT SOME OF THOSE THINGS TOGETHER, AS WELL AS AMENDMENTS REQUIRED TO CONFORM TO THE CITY'S OFFICIAL PLAN, AND THAT'S THE BYLAW IN 2018 THAT YOU HAVE IN EFFECT RIGHT NOW. SO SINCE THAT TIME, WE'VE BEEN WORKING WITH THE CITY, REVIEWING PLANNING APPLICATIONS, AS WELL AS REVIEWING INQUIRIES FROM RESIDENTS OR BUSINESS DEVELOPMENT PROPONENTS AND KIND OF MONITORING THE BYLAW WHERE WE NEED TO MAKE CHANGES FOR CLARITY, WHAT WORKS, MAYBE WHAT DOESN'T WORK, AND SO THROUGH THAT PROCESS, WHAT YOU SEE IS WHAT'S ON THE TABLE IN FRONT OF YOU, WHICH IS THE HOUSEKEEPING AMENDMENT.

SO IT MAKES CHANGES WITH RESPECT TO CLARITY AS WELL AS POTENTIAL ERRORS THAT WERE IN THE EXISTING BYLAW AND OMISSIONS, THINGS THAT MAYBE WE SHOULD HAVE INCLUDED INITIALLY BUT HADN'T INCLUDED, AND SO WE'RE BRINGING THOSE CHANGES FORWARD TO COUNCIL TONIGHT TO HAVE A BYLAW THAT'S SMOOTHER FOR FOR YOUR USE MOVING FORWARD.

SO I'LL BRIEFLY TOUCH UPON A FEW OF THE CHANGES, NOTING THAT YOU DO HAVE THE TRACK CHANGES BYLAW AS WELL AS THE CLEAN VERSION OF THE BYLAW IN FRONT OF YOU AND OUR MEMORANDUM WHICH OUTLINES ALL OF THE CHANGES THAT WERE MADE IN THE BYLAW.

SO THERE WERE SOME AREAS AT THE BEGINNING OF THE BYLAW FOR STANDARD CLAUSES THAT SHOULD BE IN THAT AUTHORIZATION ADMINISTRATION SECTION JUST FOR IMPLEMENTATION PURPOSES.

IN THE DEFINITIONS, IT'S MOSTLY THINGS OF CLARITY, UPDATING TERMINOLOGY, AS WELL AS REMOVING REGULATIONS IN THE DEFINITIONS.

WE DON'T NECESSARILY WANT TO GET RIGHT INTO THE MEAT OF REGULATING WHEN WE'RE JUST TRYING TO DEFINE VARIOUS TERMS IN THE BYLAW.

WE WANT TO KEEP THAT TO OTHER SECTIONS OF THE BYLAW.

IN OUR GENERAL PROVISIONS SECTION, WHICH WOULD APPLY THEN TO ANY ZONE THROUGHOUT THE MUNICIPALITY.

WE DID MAKE SOME CHANGES IN THE ACCESSORY USE REGULATIONS.

WE DO HAVE SOME WE HAVE MENTIONED NOW AND DEFINE THE TERM SHORT TERM RENTAL TERM RENTALS VERY CLEARLY.

SO THIS WAS A USE THAT WAS ALREADY OCCURRING WITH THE CITY, AND BUT NOW WE HAVE A DIFFERENT TERMINOLOGY FOR IT BECAUSE IT'S KIND OF MORE COMMON ACROSS ONTARIO TO CALL AIRBNB TYPE USES AS SHORT TERM RENTALS.

THERE'S NO ADDITIONAL REGULATION PROPOSED AT THIS TIME, BUT IT DOES ALLOW FOR THE MUNICIPALITY SHOULD YOU CHOOSE TO IN THE FUTURE TO ALLOW FOR ADDITIONAL REGULATION THERE.

IN THE PARKING SECTION, AGAIN, I THINK IN THAT CASE IT'S MOSTLY CLARITY AND EASE OF USE.

SO WE'VE ADJUSTED THE NUMBERING SCHEME FOR VARIOUS PARKING SPACES TO HAVE THEM ALL BE ONE SPACE PER CERTAIN AMOUNT OF FLOOR AREA AS OPPOSED TO WE HAD ALL SORTS OF DIFFERENT CALCULATIONS THERE FOR THE NUMBER OF PARKING SPACES REQUIRED.

WE'VE ALSO CONSOLIDATED THE AMOUNT OF LOADING SPACE REGULATIONS, SO WE USED TO HAVE FOUR DIFFERENT SETS OF LOADING SPACE REGULATIONS DEPENDING ON WHAT ZONE YOU'RE IN AND WE'VE COMBINED THOSE BASED ON SIMILARITIES OF THOSE DIFFERENT REGULATIONS TO JUST ONE SET FOR LOADING SPACES.

IN THE R-1 ZONE AND R-1-M ZONE.

WE HAVE ADDED IN SHORT TERM RENTALS AS A PERMITTED USE IN THOSE ZONES TO ALLOW FOR SOME ACCOMMODATIONS WITHIN THE CITY, RECOGNIZING THE SHORTAGE OF HOTEL TYPE ACCOMMODATIONS IN ELLIOT LAKE.

IN THE R-2 AND R-2-M ZONES, WE'VE CONSOLIDATED ROW HOUSES AND TOWNHOUSES BECAUSE THEY ARE A SIMILAR TYPE OF PHYSICAL FORM. WE JUST HAVE ONE SET OF REGULATIONS FOR THOSE USES FOR EASE OF IMPLEMENTATION.

WE DO HAVE REGULATIONS IN THE MOBILE HOME PARK, WHICH WE DIDN'T HAVE BEFORE, BOTH FOR THE PARK ITSELF AS WELL AS INDIVIDUAL SITES , AND FINALLY, IN THE RURAL AND SHORELINE ZONES, WE'VE REMOVED OWNERSHIP REQUIREMENTS FOR CAMPS LIKE SUMMER CAMPS AND TRAILER PARKS, BECAUSE THE USE IS ESSENTIALLY THE SAME REGARDLESS OF WHO IS OPERATING THAT USE, WHETHER IT'S A PUBLIC ENTITY OR A PRIVATE ENTITY, WE'RE STILL REGULATING THE USE IN THE SAME MANNER, AND THEN AS WELL, SHORT TERM RENTALS, AS I MENTIONED, THOSE WERE ALREADY INTERPRETED TO BE PERMITTED IN THOSE ZONES, AND SO WE'VE JUST CLARIFIED THAT, AS WELL AS INCORPORATING SEVERAL COMMITTEE RECOMMENDATIONS FROM THE BYLAW PLANNING COMMITTEE IN MARCH OF 2019 FOR RESIDENTIAL SHORELINE ZONE IN PARTICULAR FOR VEGETATION PRESERVATION, THAT KIND OF THING, THAT WERE NEVER FULLY INCORPORATED INTO THE BYLAW.

AS WAS MENTIONED, WE DID BRING THIS FORWARD TO THE NOVEMBER 7TH BYLAW AND PLANNING COMMITTEE AND RECEIVED COMMENTS AND QUESTIONS FROM THE COMMITTEE, THEN. I BELIEVE THERE WAS JUST ONE REVISION MADE FOLLOWING THAT SESSION, AND WE'RE HERE TONIGHT FOR THE PUBLIC MEETING TO CERTAINLY GET ANY FURTHER QUESTIONS OR COMMENTS FROM COUNCIL, BUT AS WELL AS FROM MEMBERS OF THE PUBLIC, AND THEN DEPENDING ON THE COMMENTS AND QUESTIONS, COUNCIL MAY CONSIDER ADOPTING THE BYLAW TONIGHT.

THERE HAVE BEEN REVISIONS SINCE THEN AND I DON'T KNOW WHAT PAGE THAT'S ACTUALLY ON BUT IF YOU GO DOWN IN YOUR REPORT, THERE ARE SEVERAL.

SO ON PAGE 11 OF YOUR REPORT, THERE WAS A REVISION IN 2019, 2021, 2022, ANOTHER ONE, FOUR OF THEM IN '22.

SO THERE HAVE BEEN REVISIONS AND AMENDMENTS TO THE BYLAW IN THE PAST, BUT THE ORIGINAL ZONING BYLAW WAS IMPLEMENTED IN 2018.
