RECONSTRUCTION TENDER RESULTS.

MAY I HAVE A MOVER OR MAY I HAVE A MOTION THAT COUNCIL RECOGNIZE DENIS GRATTON CONSTRUCTION LIMITED AS THE SUCCESSFUL BIDDER FOR RDS 23-07 AND THAT TULLOCH ENGINEERING BE ENGAGED UNDER THE CITY'S EXISTING SERVICE AGREEMENT WITH THE FIRM FOR SITE SUPERVISION, MATERIALS TESTING AND PROJECT ADMINISTRATION SERVICES FOR THE PROJECT, AND THAT FUNDS IN THE AMOUNT OF $9,416,918, BE COMMITTED FROM THE INFRASTRUCTURE, SERVICES, LINEAR TRAFFIC OPERATIONS AND ROADSIDE RESERVE TO SUPPORT THE PROJECT AND THAT THE APPROPRIATE BYLAW BE PASSED.

WOULD YOU CARE TO MAYBE EXPLAIN HOW THE TENDERING PROCESS GOES FIRST, AND THEN GET INTO THE DETAILS OF HOW THEY WERE SELECTED? THANK YOU, YOUR WORSHIP. YEAH, I THINK THAT'S ENTIRELY APPROPRIATE.

WE HAVE ONE IS CAPACITY ON MY PART, BUT THE SECOND IS THAT WE'RE AT A STAGE IN THE PROCESS WHERE THINGS ARE KIND OF STRAIGHTFORWARD, BUT I HAVE EMPATHY FOR THE FACT THAT THIS IS.

QUITE A LARGE PROJECT IN TERMS OF SCALE AND IN TERMS OF.

DOLLARS. THIS REPRESENTS ROUGHLY A THIRD OF OUR JANUARY 1ST BALANCE OF OUR RESERVE FUNDS COMBINED, SO IT'S WORTH UNDERSTANDING HOW WE GO FROM THE IDEA OF, HEY, WE NEED TO FIX A ROAD, WHICH WE'VE ALREADY DONE THIS YEAR AT A SMALLER SCALE, TO HOW DO WE TAKE ON WHAT'S BECOME A $10 MILLION PROJECT? SO PROBABLY THE BEST WAY TO CONTEXTUALIZE THIS IS TO TALK ABOUT THE TENDER DOCUMENTS THEMSELVES, BECAUSE I'M NOT REALLY ONE FOR PROPS, BUT I BROUGHT ONE TODAY.

I PRINTED OFF THE TENDER PACKAGE, DOUBLE SIDED, JUST SO YOU CAN GET AN IDEA OF HOW MUCH DOCUMENTATION WE HAVE GOING BETWEEN BIDDERS AND OURSELVES, AND SO AND I ACTUALLY COUNTED UP THERE'S 456 PAGES OF SPECIFICATIONS THAT ARE OFFERED, AND THEN THERE'S A TOTAL OF 72 DRAWINGS THAT ARE ALSO PRODUCED FOR THE PROJECT.

SO THIS IS A KIND OF A BIG, COMPLICATED DEAL.

IT TAKES IT TOOK OVER 18 MONTHS TO COMPILE THE INFORMATION, TO DO THE INVESTIGATIONS REQUIRED TO, TO EVEN FIND OUT WHAT THE APPROPRIATE SPECIFICATIONS WERE, TO PUT ALL THAT MATERIAL TOGETHER IN THIS DOCUMENT, TO REFINE IT AND THEN PUT IT OUT TO BIDDERS, AND SO THAT'S NOT I'VE PERSONALLY.

NOT HAD A LOT TO DO WITH THAT.

I'VE ONLY WORKED FOR THE CITY FOR ROUGHLY 18 MONTHS, BUT I DID ADOPT OVERSIGHT OF THE PROJECT

FOR APPROXIMATELY THE PAST YEAR.

TULLOCH ENGINEERING HAS BEEN ENGAGED WITH COMPILING MOST OF THIS MATERIAL FOR SURE, AND MR. HALLOCH AND MR. DOYLE HAVE PLAYED KEY ROLES IN INITIATING THIS PROJECT.

EXCUSE ME. SO WHY DID I QUOTE A BUNCH OF NUMBERS AND SIZE OF THE TENDERED DOCUMENT? THERE'S A BUNCH OF IMPLICATIONS TO THAT MUCH CONSIDERATION.

SO THE REASON THAT WE PUT THAT MUCH EFFORT INTO DEFINING THE PROJECT ISN'T JUST BECAUSE IT'S COMPLICATED.

IT'S BECAUSE THESE DOCUMENTS FORM PART OF THE CONTRACT THAT WE AWARD TO THE SUCCESSFUL BIDDER.

SO THE ACTUAL AGREEMENT THAT WE HAVE AND IT'S INCLUDED IN THAT TENDER PACKAGE, IT'S ONLY FOUR PAGES.

IT BASICALLY SAYS, LOOK AT ALL THIS OTHER STUFF AND DO WHAT IT SAYS FOR AN AMOUNT THAT YOU PRESCRIBE IN YOUR BID.

IT'S REALLY NOT MUCH MORE COMPLICATED THAN THAT.

SO WHENEVER THERE IS A DISAGREEMENT WITH A VENDOR OR AN ISSUE THAT COMES UP DOESN'T EVEN HAVE TO BE RAISED TO THE LEVEL OF A DISAGREEMENT.

IF THERE'S AN ISSUE THAT COMES UP ON SITE, THE IDEA IS THAT WE'VE THOUGHT OF IT ALREADY AND WE KNOW HOW TO HANDLE IT, AND IT'S NOT JUST THE SPECIFICATIONS FOR THE PROJECT ITSELF THAT'S INCLUDED.

THERE'S A SECTION CALLED SPECIAL PROVISIONS, WHICH IS, I BELIEVE, ABOUT 96 PAGES ON ITS OWN, AND IT IT DEFINES WHAT TIMES OF WHAT DAYS, WHAT A WORKING DAY MEANS.

LIKE A WORKING DAY MEANS ANY WEEKDAY EXCEPT SATURDAYS AND SUNDAYS AND STATUTORY HOLIDAYS.

IT GETS TO THAT RESOLUTION WHEN THE PEOPLE ARE GOING TO BE ON SITE.

WHAT TIMES OF DAY THEY'RE GOING TO BE THERE.

IF THERE'S SCHEDULE CHANGES, HOW DOES THAT GO ABOUT WHO DO THEY TALK TO? WHO DOES THE VENDOR GO TO GET CLARIFICATION ON TECHNICAL ITEMS? ON ADMINISTRATIVE ITEMS? HOW DOES THE VENDOR GET PAID IS A BIG PART, AND YOU CAN IMAGINE THERE'S NOT VERY MANY, MANY VENDORS OUT THERE THAT WOULD BE WILLING OR ABLE TO INVEST $10 MILLION IN A CLIENT AND THEN WAIT TO GET PAID AT THE END.

SO THERE'S PROGRESS DRAWS THAT HAPPEN ON MILESTONES.

THEY'RE ALL DEFINED IN THE DOCUMENT, AND WHEN THEY GET TO THOSE MILESTONES, IT'S DEFINED.

HOW DO WE MEASURE HOW MUCH YOU'VE GOTTEN DONE? WE DON'T WANT TO PAY FOR THINGS THAT HAVEN'T BEEN DONE YET.

SO THERE'S A SECTION ON HOW DO WE MEASURE EACH OF THE COMPLETION OF EACH COMPONENT OF THE CONTRACT.

SO, AND I'M A BIT OF A GEEK, SO I COULD GO ON ABOUT THAT KIND OF STUFF FOREVER, BUT MY POINT IS THAT IT GOES INTO EXCRUCIATING DETAIL ABOUT HOW THE PROJECT WILL BE ADMINISTERED, AND I MADE REFERENCE TO THIS IDEA IN THE ARENA TOWN HALL IN SEPTEMBER, WHERE IF YOU FOCUS ON THE METHOD AND THE SPECIFICATIONS IN PROCUREMENT, TWO THINGS HAPPEN. ONE, THE CITY CAN GO FROM BEING ROAD BUILDING EXPERTS TO A GOOD CLIENT.

THAT'S IMPERATIVE BECAUSE WE DON'T HAVE IN-HOUSE THE TECHNICAL EXPERTISE TO GENERATE ALL OF THIS MATERIAL AND TO ADMINISTER IT.

I'VE MADE REFERENCE TO THAT IN MY REPORT, BUT THE SECOND PART THAT I DIDN'T TOUCH ON IN THE TOWN HALL IS THAT AT PROJECTS AT THIS SCALE, THERE'S NO SUCH THING AS A GOOD CONTRACTOR AND A BAD CONTRACTOR PER SE.

WHEN YOU'RE TALKING ABOUT PROJECTS ON ON THE ORDER OF $10 MILLION, EVERY PERSON ENGAGED HAS AN OBLIGATION TO ADVOCATE FOR THE INTERESTS OF THEIR ORGANIZATION.

WE DO AS THE CLIENT.

THE VENDOR DOES AS THE VENDOR.

SO IT'S LESS OF A AND AS MUCH AS WE NEED TO TRUST OUR VENDOR, THE VENDOR REALLY NEEDS TO TRUST US BECAUSE THERE'S A LOT OF CASH FLOWING OUT ON THEIR PART THAT THEY NEED TO FEEL COMFORTABLE, THAT IT WILL COME BACK AS LONG AS THEY MEET THE TERMS DEFINED IN THE TENDER PACKAGE.

SO THERE'S A WHOLE LOT OF CONSIDERATION PUT IN, NOT JUST TO MAKE SURE THAT WE GET THE RIGHT PRODUCT, BUT JUST TO MAKE SURE THAT OUR INTERESTS AS THE CORPORATION OF THE CITY OF ELLIOT LAKE ARE PROTECTED, AND BY THE SAME TIME, AT THE SAME TIME THAT THE INTERESTS OF THE VENDOR ARE PROTECTED, AND

TO DRIVE HOME THAT SECOND POINT.

WE HAVE AN OBLIGATION DEFINED IN THE TENDER PACKAGE SO THAT WE HAVE PERFORMANCE BONDING OFFERED BY THE VENDORS, AND THEY HAVE TO PROVIDE EVIDENCE THAT THEY'RE ABLE TO SECURE IT WHEN THEY PUT IN THERE WHAT IT AMOUNTED TO A 42 PAGE SUBMISSION THAT SHOWS THEY COMPLIED WITH ALL OF THESE SPECIFICATIONS, AND THE REASON WE DO THAT IS THAT IF WE'RE TOO ORNERY AS A CLIENT AND WE SQUEEZE OUR VENDORS AND PUT THEM INTO FINANCIAL DISTRESS, THAT WOULD REALLY NOT BE NICE FOR THEM, OF COURSE, BUT IT WOULD BE NOT A VERY SMART THING FOR US TO DO EITHER BECAUSE WE WANT THIS JOB TO CARRY THROUGH TO COMPLETION.

RIGHT? SO AT THIS SCALE, EXCUSE ME, IT'S NOT AN ADVERSARIAL RELATIONSHIP WITH YOUR VENDORS.

WE DEFINE OUR RELATIONSHIP WELL ON ON THE OUTSET, IF MARRIAGES WERE SET UP LIKE THIS, I THINK THE DIVORCE RATE WOULD GO WAY DOWN.

WE ALL, WE ALL KNOW WHAT OUR ROLES ARE IN EXCRUCIATING DETAIL, WHAT'S SET TO BE ACCOMPLISHED AND IF THE PROJECT GOES WELL AND IF WE'VE DONE A GOOD JOB OF DEFINING THAT.

WE'VE TALKED A LOT ABOUT EXCESS SOILS OVER THE LAST YEAR.

SO PART OF OUR TENDER PACKAGE IS 121 PAGE REPORT ON HOW TO DEAL WITH THAT LEGISLATION THAT CAME IN ON JANUARY 1ST, CONSIDERATION OF TRACKING WHAT SOILS GO WHERE AND THE LOGISTICS AROUND WHERE THEY'RE MOVED ON SITE OR OFF SITE, AND WHAT HAPPENS IF THEY HAVE TO BE MOVED OFF SITE? SO I NOTICED IN ONE OF MR. HALLECK'S REPORTS FOR THIS PROJECT IN 2021, HE MADE REFERENCE TO THE FACT THAT AS HE WAS ORGANIZING THIS, HE HAD FORESEEN THAT EXCESS SOILS WAS GOING TO BE A CONSIDERATION, AND IT TURNS OUT HE WAS RIGHT.

OUR EXPERIENCE HAS BEEN THAT IT HASN'T IMPACTED MARKET PRICING NEARLY AS MUCH AS ANYONE HAD FEARED, BUT IT'S STILL SOMETHING THAT WE HAVE TO DEAL WITH ADMINISTRATIVELY.

THE OTHER NOTABLE THING IS THAT IN THE CONTRACT DRAWING SET, THERE'S A 45 PAGE SECTION THAT WE DIDN'T HAVE TO PRODUCE.

THE ONTARIO GOVERNMENT.

HAS WHAT'S CALLED ONTARIO PROVINCIAL PROVINCIAL STANDARD DRAWINGS, AND LAYPEOPLE CAN UNDERSTAND THIS BY LOOKING AROUND THE PROVINCE, AND YOU NOTICE THAT EVERY CURB LOOKS LIKE PRETTY MUCH EVERY OTHER CURB, WITH PERHAPS HISTORICAL MILESTONES ALONG THE WAY, BUT EVERY MODERN ONE LOOKS LIKE EVERY OTHER MODERN ONE.

THERE'S A REASON FOR THAT.

THE PROVINCE REGENERATES THE CONSTRUCTION DETAILS FOR A LOT OF THESE STANDARD ASSEMBLIES SO THAT WE DON'T HAVE TO WRITE.

SO I DON'T WANT TO IMPLY THAT IT'S CHEATING.

IT'S ACTUALLY VERY WISE TO LEVERAGE PRE-DONE WORK, AND I DON'T EVERY CIVIL ENGINEER WOULD CRINGE FOR ME SAYING THIS, BUT IT TURNS A LOT OF THEIR JOB NOT MOST INTO ASSEMBLING.

WELL AN ANALOGY WOULD BE LIKE PUTTING LEGO BRICKS TOGETHER.

YOU HAVE PREDEFINED PARTS THAT YOU CAN ASSEMBLE TO ACHIEVE THE GOAL THAT YOU WANT, AND AND THE OTHER OBVIOUS BENEFIT IS THAT AS A DRIVER, YOU CAN KNOW WHAT TO EXPECT AS YOU NAVIGATE THE ENTIRETY OF THE PROVINCE, RIGHT? THE OTHER ISSUE OR WELL, I'M SENSITIVE TO SOME OF THE THINGS THAT I READ ON SOCIAL MEDIA, AND THERE WAS SOME SENTIMENT THAT I ENCOUNTERED LATELY ABOUT SUPPORTING OUR LOCAL VENDORS AND I CAN UNDERSTAND AS A CONSTITUENT HOW IT WOULD BE CONFUSING TO WATCH THE CITY BEHAVE IN DIFFERENT CONTEXTS WHERE WE JUST HAD A SUCCESSFUL SHOP LOCAL NIGHT, WHERE WE REALLY PROMOTED THE CONSTITUENTS TO GO OUT AND SUPPORT OUR LOCAL BUSINESSES AND EVEN MYSELF, I'VE BROUGHT FORWARD ITEMS TO COUNCIL WHERE I PROVIDED THE RATIONALE THAT IT MAKES SENSE TO DEAL WITH A LOCAL BUSINESS FOR ONE PROJECT OR ANOTHER BECAUSE OF THE WAYS THAT WE HAVE TO INTERFACE WITH THEM DURING THE PROJECT, BUT AT THIS

SCALE, THERE IS OBLIGATIONS THAT WE HAVE AS A MUNICIPALITY TO NOT ENGAGE IN THAT KIND OF CONSIDERATION.

SO ELLIOT LAKE ONLY EXISTS BECAUSE THE PROVINCE SAYS THAT WE CAN.

THAT'S KIND OF AN AWKWARD WAY TO SAY IT, BUT WE'RE DEFINED IN BY THE PROVINCE BY WE'RE AWARDED OUR AUTHORITY AS A REGION, BY THE PROVINCE, AND SIMILARLY, THE PROVINCES ARE GRANTED THEIR AUTHORITY BY THE FEDERAL GOVERNMENT, AND THE IMPLICATIONS OF THAT TIERED RELATIONSHIP ACTUALLY IMPACT US SOMETIMES, AND THE WAY THAT IT DOES IN THIS INSTANCE IS THAT THE CANADIAN FREE TRADE AGREEMENT ACTUALLY DEFINES TIERS AT WHICH WE ARE ABLE TO ENGAGE IN COMPETITIVE PROCESSES AND OFFER PREFERENCE TO REGIONAL VENDORS, AND WHEN WE CAN'T.

SO THIS PROJECT FAR EXCEEDS THE LEGISLATION WHERE WE WHERE WE COULD ACTUALLY CONSIDER.

MAKING THAT KIND OF ISSUE SOMETHING THAT WE MAKE A DECISION ON AWARDING A TENDER ON.

IT'S BOTH THAT TRADE AGREEMENT AND THE ONE THAT CANADA HAS WITH EUROPE.

I BELIEVE IT'S CALLED CETA.

SO THAT'S THE PROCESS.

IF IT PLEASES YOUR WORSHIP, I'LL CARRY ON TO THE, THE ACTUAL BID PROCESS THAT WE UNDERTOOK WITH THIS SPECIFIC PROJECT.

WE WERE LUCKY TO RECEIVE THREE BIDS FOR THE PROJECT.

THEY ALL CAME IN RELATIVELY CLOSE PROXIMITY TO ONE ANOTHER, AND THE IMPLICATIONS OF THAT.

IT WOULD PERHAPS BE INCORRECT TO SAY THAT MEANS WE'VE GOT A GOOD TYPE SCOPE OF WORK TOGETHER, BUT THAT IS WHAT IT IMPLIES, BUT PROBABLY MORE ACCURATELY, IT MEASURES HOW WELL AND HOW SIMILARLY THAT SCOPE OF WORK WAS UNDERSTOOD BY THE VENDORS THAT BID ON THE PROJECT. SO IN ADDITION TO JUST DUMPING A WHOLE BIG PILE OF PAPERWORK ON THE OPEN MARKET, WE HAD A MANDATORY SITE MEETING WITH THE BIDDER POOL.

THEY CAME IN, EXPRESSED.

WE WERE ABLE TO ADDRESS AND OFFER CLARITY ON SOME ITEMS THAT WERE IN THE TENDER PACKAGE INITIALLY.

BASED ON THAT FEEDBACK, WE OFFERED TWO ADDENDUMS TO CLARIFY THE QUESTIONS THAT CAME UP.

SO BY THE TIME WE HAD BIDS COME IN, IT'S MY BELIEF THAT WE HAD A POOL OF BIDDERS THAT UNDERSTOOD THE PROJECT WELL.

I MAKE REFERENCE IN THE REPORT THAT I'M ANTICIPATING THIS SUMMER, WE ARE LIKELY NOT TO HAVE INTERNAL MANAGEMENT CAPACITY TO ADMINISTER THE REALIZATION OF THIS PROJECT, AND SO I REACHED OUT TO TULLOCH FOR AN ESTIMATE OF WHAT THEIR BILLABLE HOURS WOULD AMOUNT TO OVERSEE THE PROJECT WITH FULL TIME SITE SUPERVISION, SO THAT THEY COULD ADDRESS ISSUES AS THEY CAME UP ON SITE, AND REGARDLESS, WE WOULD NEED TO CONDUCT MATERIAL TESTING, AND IT'S ONLY REASONABLE TO THINK THAT WE WOULD ENGAGE TULLOCH SERVICES, GIVEN OUR STANDING AGREEMENT WITH THEM FOR THAT ACTIVITY. SO IT WOULD BE BEHOOVE US TO HAVE THEM ON SITE, AVAILABLE THERE TO DO THE MATERIALS TESTING TO COMPLY WITH THE EXCESS SOILS LEGISLATION THAT I JUST POINTED OUT, AND ADDITIONALLY, WE KNOW THAT AT BEACH ROAD, THERE'S A PRESSURE REDUCING VALVE UNDERGROUND THAT NEEDS TO BE ADDRESSED.

WE REALIZED THIS AND THE SCALE OF THE COST OF THE EQUIPMENT THAT NEEDS TO INTO THE GROUND AFTER THE TENDER PROCESS HAD BEEN INITIATED, AND SO WE INCLUDED THE LABOR TO INSTALL, BUT WE DIDN'T PUT THE MATERIAL.

PRICE FOR THAT EQUIPMENT IN.

WE STILL NEED TO DEFINE IT COMPLETELY, AND THEN WE HAVE TO MULL OVER WHETHER WE HAVE THE CONTRACTOR PURCHASE THAT ON OUR BEHALF AND ISSUE A CHANGE ORDER, OR IF WE KEEP THE TENDER THE SAME AND WE PURCHASE THE EQUIPMENT AND HAVE THEM INSTALL IT AS HAS BEEN BID, OR PERHAPS WE COULD INSTALL IT AND THEY COULD OFFER US A CREDIT.
