IT'S A DIFFICULT THING THAT YOU ALL HAVE TO DEAL WITH, AND I APPRECIATE THAT.

PREVIOUSLY IN THE LAST ADMINISTRATION, THEY WERE FACED WITH A SIMILAR THING, AND I DON'T EXPECT YOU TO DO IT, BUT THEY HAD WAIVED SOLICITOR CLIENT PRIVILEGE TO BE ABLE TO DEAL WITH THIS IN A PUBLIC FORUM TWICE DURING THE LAST ADMINISTRATION.

IT SAYS A CASE CONCERNED A SERIES OF EVENTS FROM 2019.

AS A RESULT OF THIS DECISION, THE CITY WILL RECOVER MORE THAN 100,000.

FOR MR. PATRIE.

FOR HIS COST IN BOTH LEGAL PROCEEDINGS THAT WAS ISSUED BY THE CITY ON THE 18TH.

IN THE ITEM THAT IS BEFORE YOU THAT DETAILS THE COSTS.

IT LABELS THE CONFLICT-OF-INTEREST COST.

TO DATE OF 599,000 AND ZERO NINE $4.

THERE'S A BIG DISCREPANCY.

AND IN WHAT'S BEING SAID ON THE 18TH AND WHAT'S BEING DISPLAYED BEFORE YOU ON THE PAPER TONIGHT.

WHAT'S PROBLEMATIC FOR THAT? IS IT IN THE JUSTICE'S DECISION THAT WAS RENDERED ON THE 9TH OF JANUARY AND THE APPELLATE JUSTICE DECISION ON THE 15TH? IT STATES THAT COST WILL BE PAID DIRECTLY TO THE FORUM BY MR. PATRIE. I THINK YOU CAN SEE WHERE THIS IS GOING.

THE PUBLIC'S BEEN INFORMED THAT THE COSTS ARE A DIRECT CONSEQUENCE AND RESPONSIBILITY OF A PARTY OTHER THAN THE CITY, AND THE CITY HAS ISSUED A PUBLIC STATEMENT SAYING THAT THEY'RE GOING TO ISSUE A RECOVERY FOR $100,000, OR ABOUT THAT AMOUNT.

THE TOTAL COST THAT YOU'RE BEING INFORMED OF TONIGHT IS MUCH MORE THAN THAT.

SO, IT WOULD BE HELPFUL TO ELIMINATE THE CONFUSION AS TO ARE YOU TALKING ABOUT ONE OR BOTH TWO SEPARATE ISSUES? AND SECONDARY TO THAT IS, HOW DID WE ARRIVE AT THAT FIGURE OF $100,000 OF RECOVERY, IF THAT'S IN FACT WHAT YOU MEANT TO SAY ON THE 18TH? LASTLY, THE IC REPORTS FOR THE COST FOR 2023 FOR MR. SUOZZI ARE LISTED AT $37,100.

TO MY KNOWLEDGE OR TO ANYTHING THAT WE'VE SEEN ON VIDEO OR IN THE COMMUNITY.

AS LET'S SEE HERE, THE INTEGRITY COMMISSIONER'S MAIN FUNCTION IS ADVISORY TO COUNCIL.

AND THIS IS PART OF THE MUNICIPAL ACT AS WELL AS OUR PROCEDURES AT THE END OF IT.

IT SAYS THE RESPONSIBILITY OF THE INTEGRITY COMMISSIONER IS TO PUBLISH AN ANNUAL REPORT ON FINDINGS OF TYPICAL ADVICE AND COMPLAINT CASES, PROVIDE OUTREACH PROGRAMS TO COUNCIL AND MEMBERS OF STAFF.

PROMOTE PUBLIC AWARENESS OF THE OFFICE.

AND I BELIEVE THAT WAS ENACTED SO THAT ANNUALLY, EVERY YEAR THE COMMUNITY WOULD RECEIVE A DETAILED REPORT, NOT OF THE INCIDENTALS OF ANYTHING THAT'S ONGOING, BUT OF THE TOTAL COST AND WHAT THEY WERE CREATED BY, WHETHER IT WAS A CONFLICT, A CODE OF CONDUCT, OR WHATEVER.

ITEM 6.2 REPORT FROM THE ACTING DIRECTOR OF PUBLIC WORKS REGARDING CENTENNIAL ARENA TARGETED WOOD STRUCTURE REPAIR.

[6.2 Report from the Acting Director of Public Works]

MAY I HAVE A MOTION THAT COUNCIL APPROVED THE USE OF THE NEGOTIATION METHOD, AS DESCRIBED IN THE CITY'S PROCUREMENT POLICY, TO SOLE SOURCE THE CONTINUED PROVISION OF SERVICES TO MITIGATE THE POTENTIAL FOR COLLAPSE OF THE CENTENNIAL ARENA TO TIMBER RESTORATION SERVICES AT AN UPSET LIMIT OF $350,000 PLUS APPLICABLE TAXES, AND THAT THE ASSOCIATED COSTS BE DRAWN FROM THE CITY'S BUILDINGS AND FACILITIES.

I'M TRYING TO KEEP THINGS KIND OF CONSISTENT SO THAT WE CAN TRACK WHAT'S OCCURRING.

SO, WE HAVE COMPLETED THE COMPLETE CANVAS OF THE STRUCTURE.

WE'D FINISHED THAT UP A FEW A FEW WEEKS AGO.

THEY'RE CURRENTLY GOING THROUGH THEIR DATA THAT THEY'VE COLLECTED TO PREPARE A FULSOME REPORT THAT WILL PRESENT TO COUNCIL THAT GIVES A FULL STATUS OF WHAT THE CONDITION OF ALL THE WOOD ELEMENTS ARE IN THE BUILDING WHILE THEY WERE ON SITE.

BOTH TIMES WE WERE ABLE TO COORDINATE BACK AND FORTH BETWEEN CITY FORCES AND THE ENGINEERING TEAM TO TRY AND BEST APPROACH THE PROJECT OVERALL.

SO, THERE'S SOME, BETWEEN MY REPORTING TO YOU AND WHAT'S HAPPENING ON SITE, THERE'S SOME LAG BECAUSE QUITE HONESTLY, WE WOULD DO MIDDAY REPORTS BACK TO THEIR HOME BASE AND COMPILE DATA AND FIGURE OUT WHERE THEY SHOULD WHERE WE SHOULD BE LOOKING, EVALUATING HOW THINGS ARE GOING ON SITE.

WE'D BE MAKING CHANGES.

EXCUSE ME. AND SO THERE WAS, OVERALL, THERE WAS TWO BIG CHANGES THAT WE TOOK IN APPROACH WHEN AND THEY LED TO PROVIDING A WINTER SHORING DESIGN THAT DEVIATED FROM THEIR INITIAL TEMPORARY SHORING DESIGN.

SO, THE INITIAL TEMPORARY DESIGN SPECIFIED 20 TOWERS PUT IN SPECIFIC LOCATIONS.

AND AS WE WERE REALIZING THAT ON SITE, SOME OF THE LOCATIONS THAT THEY PRESCRIBED ARE REALLY CHALLENGING TO GET ASSURING TOWER UP IN.

THEY WOULD INTERFERE WITH THE MECHANICALS FOR THE UM, THE POOL OR, SORRY, THE ICE RINK ITSELF.

THERE'RE TRENCHES WHERE THERE'S A LOT OF CHILLER LINES THAT GO THROUGH THE PAD, AND WE WOULD HAVE TO DEAL WITH THAT IN A WAY.

AND THERE'S ROOM.

THERE'RE ROOMS ON EITHER END OF WHAT'S KNOWN AS TRUST ONE ON THE DRAWINGS.

THAT WE WOULD HAVE TO INTO.

SO BASICALLY, IF WE PUT THE TOWERS WHERE THEY PRESCRIBED THE INITIAL DESIGN, WE WOULD BE DOING A LOT OF DEMOLITION THAT WE'D EVENTUALLY PROBABLY HAVE AN APPETITE TO UNDO. SO, IN THEIR WINTER SOARING DESIGN THAT WE'RE NOW IN THE PROCESS OF REALIZING THEY SUGGESTED ADDING SOME TOWERS IN SOME LOCATIONS AND FORGOING THOSE MORE CHALLENGING AREAS BECAUSE IT SEEMS LIKE IT'S MORE PRACTICAL TO MAKE REPAIRS TO THOSE TRUSSES RIGHT NOW THAN GO TO THE EXPENSE OF TRYING TO HOLD UP THOSE MEMBERS AND.

AND INCURRING THE.

THE RECONSTRUCTION COST TO THE INTERIOR FINISHES THAT I JUST DESCRIBED.

SO, LAST NIGHT WE RECEIVED A QUOTE FROM TIMBER RESTORATION SERVICES, WHICH IS WORDS SISTER COMPANY.

THAT'S THE COMPANY THAT ACTUALLY DOES THE PHYSICAL LABOR FOR RESTORATION OF THE WOOD ELEMENTS.

AND I'VE INCLUDED IT IN THE REPORT TO YOU TODAY.

THEY PROVIDE A BREAKDOWN THAT DETAILS THE VARIOUS EXPENSES THAT THEY ANTICIPATE.

IT SHOULD BE NOTED THAT IT'S A BUDGET ESTIMATE.

IT'S NOT A QUOTE. SO, THAT'S WHY THERE'S A DISCREPANCY BETWEEN WHAT'S IN THE ESTIMATE AND WHAT WE'RE RECOMMENDING SETTING ASIDE FOR THE PROJECT. OKAY.

YEAH. SO THAT'S SORT OF WHAT YOU'RE TELLING US.

THEY'VE MADE SOME DECISIONS IN THOSE AREAS.

YEAH. SO THAT BEING SAID, FOR THE PUBLIC OUT THERE, WE'RE PRETTY MUCH FAIRLY CONFIDENT THIS ARENA IS GOING TO BE FIXED. WHEN CAN WE TELL THE PUBLIC WELL NOT HOLD YOU KNOW WHAT I MEAN? LIKE I CAN'T SEE US DOING A COMPLETE LET'S FIX THESE BEAMS AND THEN SAY, WELL, SORRY, IT'S NOT GOING TO WORK.

WE'VE LEARNED THAT THIS IS A REPAIRABLE AND ECONOMICALLY REPAIRABLE FACILITY.

RIGHT? BUT I OFFER THE RECOMMENDATION NONETHELESS, BECAUSE ALL EVIDENCE TO THIS POINT INDICATES THAT WE'VE GOT A REPAIRABLE WOOD STRUCTURE THAT WE CAN MOVE FORWARD WITH, WITH REPAIRING.

AND THAT'S I BELIEVE THAT'S THE SHORTEST, MOST ECONOMICAL, THE SHORTEST TIMELINE AND MOST ECONOMICAL WAY TO GET A FACILITY UP AND RUNNING.

OKAY. I, YOU KNOW, I DIDN'T WANT TO MAKE YOU SAY 100%, BUT YEAH, IN MY LITTLE OPINION, I THINK THAT'S GOOD NEWS.

AND IT LOOKS LIKE IT'S ONE MORE STEP TO GETTING THE ARENA REOPENED.

MR. GOULDING, WE HEARD WORD AT OUR LAST COMMITTEE MEETING EXPRESS HOW WOOD STRUCTURES CAN BE SAVED AFTER SIGNIFICANT DAMAGE. AND WE WERE TOLD VERY CLEARLY AT THAT POINT, AND I HAVE NO DISPUTE THAT THEY ARE EXPERTS IN THIS, AND WE HAVE RELIABLE INFORMATION COMING THAT IT'S 80% GOOD AS OPPOSED TO 80% BAD, I BELIEVE IS THE NUMBER THAT HE QUOTED FOR EXAMPLES SAKE.

SO, I THINK AS WE MOVE FURTHER TO SHORING UP THE BUILDING FOR THE WINTER, WHICH IS WHAT TONIGHT REALLY IS ALL ABOUT.

AND LIKE YOU SAID, YOU'RE RIGHT.

WINTER IS EVENTUALLY GOING TO APPEAR.

IT CANNOT WITHSTAND ANY SNOW LOAD AT THIS POINT.

AS COUNCILLOR FLINTOFF SAID, I'VE WRAPPED MY HEAD AROUND THE FACT THAT WE ARE GOING TO BE REPAIRING THIS STRUCTURE, AND EVERYTHING WE DO TO MITIGATE FURTHER DAMAGE IS ONE STEP CLOSER TO REOPENING THAT FACILITY.

AGAIN, IT IS MONEY THAT WE NEED TO SPEND.

IT'S A VERY IMPORTANT FACILITY.

WE DON'T HAVE OTHER PLANS, SHOVEL READY PROJECTS OR ANY OF THOSE WONDERFUL THINGS THAT WE'VE TALKED ABOUT IN THE PAST AVAILABLE.

THEREFORE, WE NEED TO KEEP, MAINTAIN AND SUPPORT WHAT WE HAVE AS WE'RE DOING WITH OUR OTHER INFRASTRUCTURE AND OTHER FACILITIES.

I GUESS SIDING FROM THE OUTSIDE.

SO, CITY FORCES WILL BE WORKING ALONGSIDE THEM.

PROBABLY NOT FOR THE ENTIRETY OF THAT TIME, BUT FOR A PORTION OF THAT TIME.

IT GIVES YOU AN IDEA OF WHAT WE'RE THINKING OF IN TERMS OF TIMING.

IN TERMS OF THE SIDING, THE SIDING ON THE ARENA'S BEEN REINSTATED, WITH THE EXCEPTION OF THE AREA ABOVE THE FLAT ROOF OVER THE LOBBY. WE DECIDED ON SITE THAT IT WOULD BE MORE EXPEDIENT TO PUT AIR BARRIER UP AS A TEMPORARY CLADDING. I ANTICIPATE IN THE RESTORATION OF THE FACILITY AS A WHOLE, THAT WILL BE LOOKING AT A NEW SIDING SOLUTION, BECAUSE EVEN BEFORE THESE ISSUES, THE SIDING WAS PRETTY ROUGH ON THAT BUILDING.

IT WAS IT WAS TIME TO DEAL WITH THAT.

AND SO, IT WOULD BE A REAL SHAME TO GET UM.

TO GET THIS PLACE FIXED STRUCTURALLY AND NOT HAVE IT WATERTIGHT AGAIN.

SO, I WOULD ANTICIPATE THAT WE'LL BE REPLACING THAT SIDING.

AS FOR ITS SUITABILITY TO MAKE IT THROUGH THE WINTER, WE BELIEVE WE'VE GOTTEN IT TO THE POINT WHERE IT CAN SURVIVE WINTER THE WAY IT IS RIGHT NOW.

SO, RIGHT NOW WE HAVE BEEN ADVISED BY WRD TO LIMIT LIVE LOAD ON THE ROOF, WHICH IS A FANCY WAY OF SAYING DON'T GO UP ON THE ROOF. SO, WE'VE BEEN ABLE TO TAKE SOME.

WE HAD TO DO SOME DESTRUCTIVE INVESTIGATION ON THE ROOF SHEETS, BUT WE WERE ABLE TO DO THAT OFF OF MAN LIFTS FROM THE EAVE, THANKFULLY. SO, WE'VE BEEN REALLY LIMITING OUR WORKERS EXPOSURE TO BEING ON THE ROOF ON ADVICE FROM THE CONSULTANTS.

SO, THE SHORT STORY IS WE'RE GOING TO HAVE TO FIGURE OUT A WAY TO DO THAT ONCE WE GET THE GREEN LIGHT TO GO UP THERE.

IS THAT THE RULES CHANGED? AND SO, WHEN WORD EVENTUALLY GIVES US A LETTER RECOMMENDING OCCUPANCY, I'M EXPECTING IT TO HAVE CONDITIONS. AND ONE OF THOSE CONDITIONS IS, AGAIN, NO SNOW LOAD GREATER THAN 30CM SO YES, TO ANSWER YOUR QUESTION, WE HAVE BEGUN SHORING UP THE BUILDING IS MORE STABLE NOW THAN IT HAS BEEN IN RECENT TIMES FOR SURE.

SO, IN THE EVENT THAT ONE SPECIFIC SCHEDULE NEEDS TO BE REVISED THROUGHOUT THE YEAR, THE ENTIRE USER FEE BYLAW DOESN'T NEED TO COME BACK, JUST THAT SPECIFIC SCHEDULE. THIS IS AGAIN, A PART OF MODERNIZING SOME OF THE BYLAWS THAT WE'VE HAD.

I THINK OVERALL, THERE WERE SOME NOMINAL CHANGES COST OF LIVING INCREASE OF APPROXIMATELY 3% OVER SEVERAL PROGRAM AREAS AS A RESULT OF THE INCREASE IN MINIMUM WAGE COSTS.

AND IF I REMEMBER MS. SONNENBURG COMMENTING AT THE COMMITTEE MEETING THAT EVEN THIS 3% INCREASE WILL NOT COMPLETELY COVER THAT INCREASE IN MINIMUM WAGE.
