THERE ARE NO PUBLIC INPUT SESSIONS THIS EVENING. THERE ARE NO PUBLIC PRESENTATIONS. INTRODUCTION AND CONSIDERATION OF CORPORATE REPORTS. [7. INTRODUCTION AND CONSIDERATION OF CORPORATE REPORTS] ITEM 7.1 REPORT FROM THE MUSEUM CURATOR REGARDING DOWNTOWN ART CENTRE NAMING CONTEST RESULTS. MAY HAVE A MOTION THAT COUNCIL APPROVED THAT THE DOWNTOWN ART CENTRE, LOCATED AT 16 ELIZABETH WALK, BE HENCEFORTH RENAMED THE ELLIOT LAKE ARTS AND HERITAGE CENTRE (CENTRE DES ARTS ET DU PATRIMOINE D’ELLIOT LAKE). MOVER COUNCILLOR MORRISSETTE SECONDED COUNCILLOR BULL, MRS. D'AMATO, PLEASE. THANK YOU. THROUGH YOU, YOUR WORSHIP. THE PURPOSE OF THIS REPORT IS TO SHARE THE RESULTS OF OUR DOWNTOWN ART CENTRE NAMING CONTEST AND TO RECOMMEND TO COUNCIL THE WINNING NAME BY MOST POPULAR VOTE. THE NAMING CONTEST WAS ESTABLISHED TO OFFER AN OPPORTUNITY FOR OUR COMMUNITY TO PARTICIPATE IN THE NAMING OF OUR DOWNTOWN ART CENTRE. THIS INITIATIVE IS IN LINE WITH OUR STRATEGIC GOAL TO ENSURE THAT CITIZENS ARE INFORMED AND ABLE TO PROVIDE FEEDBACK ON MUNICIPAL ACTIVITIES. DURING THE CONTEST'S OPEN CALL FOR ENTRY. WE'RE SORRY, WE RECEIVED JUST OVER 100 UNIQUE NAME SUBMISSIONS, WHICH WERE VETTED AGAINST OUR CITY'S ASSET NAMING AND RENAMING POLICY AND SHORTLISTED TO TEN NAMES BY A PANEL OF JUDGES. DURING THE VOTING PROCESS, WE RECEIVED VOTES FROM 277 INDIVIDUALS AND THERE WERE TWO FRONT RUNNERS DURING THIS PROCESS. BUT OUR WINNING SUBMISSION WAS THE ELLIOT LAKE ARTS AND HERITAGE CENTRE. THIS PROPOSAL SATISFIES THE PRINCIPLES LAID OUT IN OUR NAMING POLICY AND THE FUNCTION OF THE FACILITY. SO THE NAME ELLIOT LAKE ARTS AND HERITAGE CENTRE IS A FITTING NAME FOR THE SPACE. AS A CONCLUSION OF THE CONTEST, AND IN LINE WITH OUR POLICY, WE ARE NOW LOOKING FOR COUNCIL'S ULTIMATE DETERMINATION ON THE NEW NAME OF THE DOWNTOWN ARTS CENTRE. THANK YOU FOR YOUR CONSIDERATION AND PLEASE LET ME KNOW IF YOU HAVE ANY QUESTIONS. THANK YOU, MRS. D'AMATO, DO WE HAVE ANY QUESTIONS OR COMMENTS? COUNCILLOR BULL. THANK YOU, YOUR WORSHIP THROUGH YOU TO MRS. D'AMATO. I THINK THE OUTSIDE OF THE BUILDING LOOKS AWESOME AND I LOOKING FORWARD TO IT BEING USED. IS THERE A TIMELINE WHEN PEOPLE CAN START MOVING IN OR ROUGHLY. THROUGH YOU, YOUR WORSHIP. UNFORTUNATELY, I CANNOT PROVIDE A TIMELINE AT THIS TIME. I'M NOT SURE IF ANY OTHER STAFF WANTS TO WEIGH IN ON THAT. SURE. THROUGH YOU, YOUR WORSHIP, WE'RE CONTINUING TO WORK WITH THE LOCAL ARTS GROUPS TO TRY AND SORT OUT MOU ISSUES THAT AS DIRECTED BY COUNCIL PREVIOUSLY. THANKS. ANY OTHER QUESTIONS OR CONCERNS? COUNCILLOR FLINTOFF. THANK YOU YOUR WORSHIP MORE OF JUST A COMMENT. I THINK THIS IS ONE OF OUR FIRST ADVENTURES OF COUNCIL IS TRYING TO GET SOMETHING GOING, AND GREAT JOB, MR. GOULDING. IT'S WE'RE ALMOST THERE AS YOU SAY. [00:10:01] IT'S JUST A MATTER OF FORMALITY WITH SOME PAPERWORK AND EVERYTHING, AND IT'LL BE AN EXCITING DAY WHEN WE CUT THAT RIBBON. LOOKING FORWARD TO IT. AND THANK YOU VERY MUCH FOR ALL THE GROUPS THAT HAVE BEEN PATIENTLY WAITING FOR THIS TO BE OPEN. YEP. THANK YOU. AND CONGRATULATIONS. SUCCESSFUL NAME THE BUILDING CONTEST IS NOW CLOSED. CONGRATS. SO LET'S HAVE A VOTE. ALL IN FAVOR? AND NONE ARE OPPOSED. THAT IS CARRIED. THANKS AGAIN. ITEM EIGHT PRESENTATION OF COMMITTEE REPORTS 8.1 REPORT FROM THE DEPUTY CLERK AND ACCESSIBILITY COORDINATOR REGARDING [8. PRESENTATION OF COMMITTEE REPORTS] SWIMMING POOL BYLAW. AT THE APRIL 2ND BYLAW AND PLANNING COMMITTEE MEETING, THE FOLLOWING RESOLUTION WAS PASSED THAT COUNCIL REPEAL BYLAW 79-70 OUTDOOR SWIMMING POOLS AND THAT COUNCIL ADOPT BYLAW 24-28, BEING A BYLAW PROVIDING FOR THE REGULATION OF PRIVATE OUTDOOR SWIMMING POOLS IN THE CITY OF ELLIOT LAKE. MAY I HAVE A MOTION THAT COUNCIL REPEAL BYLAW 79-70 OUTDOOR SWIMMING POOLS AND THAT COUNCIL ADOPT BYLAW 24- 28 BEING A BYLAW PROVIDING FOR THE REGULATION OF PRIVATE OUTDOOR SWIMMING POOLS IN THE CITY OF ELLIOT LAKE. A MOVER, PLEASE. COUNCILOR LEFEBVRE SECONDED COUNCILOR MANN. MISS LAURENCE, PLEASE. MRS. LAURENCE. SORRY. THANK YOU, YOUR WORSHIP. SO THE CITY'S CURRENT SWIMMING POOL BYLAW IS FROM 1979 AND REFERENCES THE TOWN OF ELLIOT LAKE, THE MUNICIPAL ACT FROM 1970, AND IT IS NOT AS DETAILED AS IT COULD BE IN TERMS OF FENCING ENCLOSURES, ZONING SETBACKS AND HEIGHT REQUIREMENTS, IN-GROUND AND ABOVE GROUND POOLS, AND ENFORCEMENT. SO ATTACHED IS THE NEWLY DRAFTED BYLAW FOR PRIVATELY OWNED OUTDOOR SWIMMING POOLS THAT IS UP TO DATE AND MORE DETAILED FOR REVIEW. I DO KNOW AT THE BYLAW AND PLANNING COMMITTEE MEETING, THERE WAS A BIT OF CONFUSION OF WHEN YOU WOULD HAVE TO APPLY FOR A SWIMMING POOL PERMIT. SO AFTER CONFIRMATION FROM THE BUILDING INSPECTOR, THIS IS FOR ALL SWIMMING POOLS WITH MORE THAN TWO FEET OF WATER, AS THERE ARE DIFFERENT REQUIREMENTS FOR AN ENCLOSURE OR DECK WHEN A POOL IS INVOLVED. BUT ANY QUESTIONS THE PUBLIC HAS SURROUNDING THIS PROCESS CAN CONTACT THE CITY'S BUILDING DEPARTMENT AND THEY WILL BE HAPPY TO HELP. THE MAIN PURPOSE FOR UPDATING THIS BYLAW IS FOR THE HEALTH AND SAFETY OF THE PUBLIC, AND MAKING SURE APPROPRIATE INSPECTIONS BY THE APPROPRIATE PEOPLE ARE BEING DONE FOR SAFETY AND COMPLIANCE. OKAY. THANK YOU, MRS. LAURENCE. ANY QUESTIONS OR COMMENTS? COUNCILLOR BULL. THANK YOU, THROUGH YOU YOUR WORSHIP TO MRS. LAURENCE. WHAT ABOUT THE INFLATABLE POOLS? SOME OF THEM SEEM TO BE GETTING BIGGER. DOES IT HAVE TO BE A PERMANENT POOL WITH SIDES AND EVERYTHING SUPPORTING IT? YES. SO IF IT'S. I THINK IT'S ABOVE ANYTHING THAT'S MORE THAN FIVE FEET WALLS NEEDS A PERMIT. ANY, LIKE INFLATABLE POOL THAT YOU'RE TAKING IN AND OUT KIND OF EVERY DAY WOULD NOT REQUIRE A PERMIT. BUT AGAIN, THAT WOULD BE IF YOU CALLED THE BUILDING DEPARTMENT, THEY WOULD LET YOU KNOW IF YOU WOULD NEED TO APPLY FOR A PERMIT OR NOT. OKAY. YEAH. ANY OTHER QUESTIONS? OKAY. SEEING NONE. LET'S HAVE A VOTE. ALL IN FAVOR? NONE ARE OPPOSED. THAT'S CARRIED. 8.2 MEMO FROM THE DIRECTOR OF CLERK'S AND PLANNING SERVICES REGARDING AMENDMENT TO PROPERTY STANDARDS BYLAW. AT THE APRIL 2ND BYLAW AND PLANNING COMMITTEE MEETING, THE FOLLOWING RESOLUTION WAS PASSED THAT BYLAW 21-23 BEING A BYLAW TO ESTABLISH STANDARDS FOR THE MAINTENANCE AND OCCUPANCY OF PROPERTY IN THE CORPORATION OF THE CITY OF ELLIOT LAKE BE AMENDED TO ADD SCHEDULE D. MAY I HAVE A MOTION THAT BYLAW 21- 23 BEING A BYLAW TO ESTABLISH STANDARDS FOR THE MAINTENANCE AND OCCUPANCY OF PROPERTY IN THE CORPORATION OF THE CITY OF ELLIOT LAKE BE AMENDED TO ADD SCHEDULE D. A MOVER, PLEASE. COUNCILLOR SEIDEL SECONDED COUNCILLOR FLINTOFF, MRS. LAURENCE, PLEASE. THANK YOU, YOUR WORSHIP. AT THE MARCH 11TH COUNCIL MEETING, MEMBERS OF THE PUBLIC WERE APPOINTED TO THE PROPERTY STANDARDS COMMITTEE. AS SUCH, THE RULES OF PROCEDURE NEED TO BE PLACED IN THE PROPER PROPERTY STANDARDS BYLAW FOR THE COMMITTEE TO ADHERE TO. OUR SOLICITOR HAS DRAFTED THE RULES OF PROCEDURE, AND A RESOLUTION IS REQUIRED TO AMEND BYLAW 21-23 TO INCLUDE THE ATTACHED SCHEDULE. THANK YOU, MRS. LAURENCE. ANY QUESTIONS OR COMMENTS HERE? COUNCILLOR FLINTOFF. THANK YOU, YOUR WORSHIP. THROUGH YOU TO MRS. LAURENCE. I'M NOT SURE IF YOU CAN ANSWER THIS, BUT I'LL ASK. SO I WAS GOING THROUGH IT IN A CERTAIN SPOTS AND LIKE UNDER ITEM 6.2, IT'S TALKING ABOUT A BUILDING THAT'S BEEN BOARDED UP FOR A CERTAIN [00:15:08] TIMELINE. BUT I'M THINKING ABOUT THE WHITE MOUNTAIN ACADEMY BUILDING. IF I READ WHAT I READ, IT'S TOTALLY BREAKING ALL THE RULES. IT'S IT'S ALL BOARDED UP. RODENTS, WE ALL KNOW. GET IN THERE. LIKE, HOW LONG CAN THAT GO ON TILL SOMEBODY HAS TO COME. GOOD FOR IT. OR DO SOMETHING ABOUT IT? THANK YOU FOR THE QUESTION THROUGH YOU YOUR WORSHIP. I'M ACTUALLY NOT ABLE TO ANSWER YOUR QUESTION TONIGHT, I APOLOGIZE. BUT I CAN ASK THE CLERK AND GET BACK TO YOU WITH THAT RESPONSE. OKAY. THANK YOU. I JUST HAD A FEW PEOPLE MENTION IT TO ME SINCE I'VE BEEN ON COUNCIL, SO MAYBE I COULD HAVE THAT LATER. THANKS. ANY OTHER QUESTIONS OR COMMENTS? OKAY. YEAH. WE TALKED ABOUT THIS IN BYLAW AT LENGTH. THAT WAS A GOOD QUESTION THAT MISSED. IS THAT ENOUGH TO MAKE YOU SECOND ANYTHING TO NOT VOTE. NO. OKAY. SO NO MORE COMMENTS OR QUESTIONS, THEN LET'S HAVE A VOTE. ALL IN FAVOR? NONE ARE OPPOSED AND THAT IS CARRIED. 8.3 REPORT FROM THE ACTING DIRECTOR OF PUBLIC WORKS REGARDING ARENA REPAIRS. MR. GOULDING, PLEASE. THANK YOU. THROUGH YOU, YOUR WORSHIP. NOT A FUN REPORT TO WRITE OR PRESENT OR TO LIVE THROUGH IN MANY RESPECTS. SO WHEN WE STARTED HAVING STRUCTURAL ISSUES WITH THE ARENA I REALLY PUT AN EMPHASIS ON TAKING A STRATEGIC APPROACH TO ITS RENEWAL AND REPAIR. AND THAT APPROACH YOU PROBABLY REMEMBER, ENTAILED MAKING SURE THAT WE HAD A REALLY COMPREHENSIVE UNDERSTANDING OF WHAT THE ISSUES WERE AT THE ARENA, STRUCTURALLY OR OTHERWISE. AND SO TO THAT END, WE SPENT A LOT OF TIME, EFFORT AND ENERGY SHORING UP THE STRUCTURE, REMOVING INTERIOR FINISHES, AND COMPREHENSIVELY INSPECTING ALL OF THE WOOD STRUCTURE ELEMENTS, GETTING A REALLY GOOD PICTURE OF WHAT THE CONDITION OF THE BUILDING WAS. WE ENGAGED WITH WRD, WHO ENTERED ALL THAT INFORMATION ON A DAILY BASIS AS WE WENT THROUGH THAT PROCESS INTO THEIR COMPUTER MODEL TO TRY AND UNDERSTAND HOW THE BUILDING WAS BEHAVING AND WHAT WOULD IT WOULD TAKE TO AFFECT REPAIRS. AND THEN IN PARALLEL WITH THAT, THE OTHER STRATEGIC INITIATIVE THAT I EMPHASIZED LAST FALL WAS HAVING A SINGLE ENTITY OVERSEE THE ACTUAL RENEWAL AND REPAIR. AND SO TO THAT END I APPROACHED JOHNSON CONTROLS TO ACT AS THAT ENTITY LAST FALL. AND WE SPENT A LOT OF, AGAIN, TIME, EFFORT AND ENERGY TRYING TO FIGURE OUT HOW WE COULD ADMINISTRATIVELY MAKE THAT HAPPEN. I THINK IT'S FAIR TO SAY THAT WE DID IT WITH A LOT OF CONSIDERATION AND ATTENTION TO DETAIL ON BOTH SIDES OF THAT RELATIONSHIP. TO THE POINT WHERE IN FEBRUARY I CAME TO COUNCIL WITH A PROJECT DEVELOPMENT AGREEMENT THAT WAS NEGOTIATED BY LEGAL TEAMS BY BOTH JOHNSON CONTROLS AND THE CITY TO ENTER INTO AN AGREEMENT TO DO DESIGN WORK FOR THE ARENA FOR THE RENEWAL, NOT FOR THE, STRICTLY SPEAKING, THE REPAIRS. THAT ACT TRIGGERED JOHNSON JOHNSON CONTROLS HAD TO FORMALIZE THEIR RELATIONSHIP WITH WRD. THEY HAD TO ENTER INTO A CONTRACT TO ACT AS A SUB VENDOR, AS WE HAD REQUESTED. BECAUSE IT'S REALLY IMPORTANT, IN MY VIEW, TO HAVE THE CONTINUITY OF OF DESIGN EXPERTISE THAT WRD CAN PROVIDE WITH RESPECT TO THIS ARENA BECAUSE OF THEIR HISTORY WITH IT FOR ONE THING BUT MORE THAN THAT, BECAUSE OF THE REALLY SPECIALTY NATURE OF THEIR PRACTICE AND THE FACT THAT IF WE ASKED. WELL, IT'S MY BELIEF. I DON'T KNOW IF ANYBODY HAS EVER DONE THIS, BUT IT'S MY UNDERSTANDING THAT IF YOU ASKED ANOTHER PROFESSIONAL ENGINEER TO REVIEW OR OVERSEE OR CONTRADICT THE FINDINGS OF WRD, YOU'D HAVE TO MEET A REALLY SUPER HIGH LEVEL OF [00:20:10] SCRUTINY, OR YOU'D HAVE TO OFFER A WHOLE LOT OF CONSIDERATION IN ORDER TO SUPPORT A CONTRADICTORY VIEW OF WHAT THEY DO. THEY'RE WORLD AUTHORITIES. THEY'RE MORE MATERIAL SCIENTISTS THAN AN ENGINEERING FIRM. SO WHEN THE TWO COMPANIES STARTED TRYING TO WRITE A CONTRACT TOGETHER. IT WENT WELL, IS MY UNDERSTANDING. THERE'S NO PROBLEM WITH THE RELATIONSHIP BETWEEN THE FIRMS, BUT IT TRIGGERED A LEGAL AND UPPER MANAGEMENT REVIEW WITHIN JOHNSON CONTROLS TO EVALUATE THE SCALE AND SCOPE OF THE PROJECT. AND AND THAT WITH THAT SCRUTINY, APPARENTLY JOHNSON CONTROLS BECAME UNCOMFORTABLE WITH PROCEEDING AS BEING THE DESIGN AND PROJECT LEAD FOR THE FOR THE PROJECT. SO THE IMPLICATIONS OF THIS ARE PRETTY BIG. IT WAS A IT WAS A PRETTY KEY TACTIC FOR MY APPROACH TO TO SHORTENING TIMELINES AND INCREASING THE DESIGN CONSIDERATION ON THE PROJECT. SO I THINK THAT WE CAN MITIGATE THE SITUATION IN THE MANNER THAT I MADE CLEAR IN THE REPORT. BUT THE ONE BIG COMPROMISE THAT WE'RE GOING TO SEE, IN MY VIEW, IS THAT WITH A SINGLE ENTITY OVERSEEING THE PROJECT FROM THE START, THERE WAS SOME PARALLELISM IN DESIGN AND WORK GOING ON, AND CARE AND CONTROL OF THE SITE THAT WERE NOT ABLE TO DO QUITE SO EFFICIENTLY IF WE HAVE TWO SUBSEQUENT VENDORS ACTING. SO TO MAKE THAT CLEAR AT ANY ONE TIME. THERE'S ONLY ONE CONTRACTOR THAT'S ABLE TO BE IN CARE AND CONTROL OF THE SITE. SO WHEREAS BEFORE, IF EVERYTHING HAPPENED UNDER A SINGLE UMBRELLA, SOME VENDORS COULD WORK IN PARALLEL. BUT IF WE IF WE DIVIDE THE SCOPE OF WORK, THE INITIAL SCOPE OF WORK WOULD HAVE TO TO FORMALLY CLOSE, AND THEN SUBSEQUENTLY THE SECOND CONTRACTOR WOULD HAVE TO TAKE CONTROL OF THE SITE AND BEGIN ITS SCOPE OF WORK. SO BUT THE INITIAL APPROACH, WE COULD HAVE TWO HORSES RUNNING AT THE SAME TIME. BUT WITH THE WAY THAT THINGS ARE SHAPING UP NOW, WE'RE GOING TO HAVE TO HAVE A FORMAL TRANSFER OF THE SITE FROM ONE PARTY TO ANOTHER. SO I'M STILL TRYING TO FIGURE OUT WHAT THE ACTUAL TIME CHAIN DIFFERENCE WILL BE IN THE PROJECT LENGTH FOR THAT. BUT MY BELIEF AT THIS MOMENT WHEN I'M SITTING IN FRONT OF YOU NOW IS THAT WE'RE STILL ABLE TO ACHIEVE A FOURTH QUARTER OPENING IN 2024. BUT I'M AS I MAKE CLEAR IN THE REPORT, I'M WAITING FOR A REVISED PDA FROM JOHNSON CONTROLS, WHERE I CAN PIN THEM DOWN FOR A TENTATIVE SCHEDULE ON WHAT KEY MILESTONES WILL BE ABLE TO MAKE BY WHEN. IT'S KIND OF A WIDE RANGING REPORT. I GLUED A BUNCH OF IDEAS TOGETHER. ONE OF THE ONES THAT I WANTED TO ARTICULATE IS THAT I STILL THINK THE APPROACH IS, IS SOUND THAT WE TOOK IN THE FALL. AND ONE OF THE BIG THINGS THAT'S BEEN HAPPENING FOR THE LAST MONTH THAT, YOU KNOW, THROUGH THE HOCKEYVILLE HYPE, IT'S KIND OF ADDED TO THE STRESS OF MY EXISTENCE. BUT WE'VE HAD STRUCTURAL ALARMS GOING OFF WITH THE HEALTH MONITORING SYSTEM AT AT THE ARENA. I JUST CHECKED THE NOTIFICATIONS AND IT'S TODAY IT'S EXACTLY A MONTH AGO THEY STARTED AND MY MOST RECENT ONE THAT I'VE RECEIVED WAS LAST THURSDAY. AND THEY'VE CEASED SINCE THEN. SO I'M, I HAD A BIT EASIER WEEKEND THIS ONE PAST. SO THROUGH THAT PROCESS WE REACHED OUT TO WRD AND THEIR SISTER COMPANY, TIMBER RESTORATION SERVICES, HAD THEM RE-ATTEND SITE AND CITY STAFF WORKED WITH THEM TO DO SOME INVESTIGATIVE WORK, NOT ONLY TO THE INTERIOR STRUCTURE, BUT TO THE FOUNDATION SYSTEMS. WE LOOKED AT THE PIERS FOR THE ARENA. THE WORKING THEORY WAS THAT PERHAPS THE PIERS ARE JUST A LITTLE BIT UNDERSIZED, BUT THE CALCULATIONS HAVE TO BE RUN FOR THAT, AND IT LOOKS LIKE THEY MIGHT BE A LITTLE BIT SHALLOW, BUT AGAIN, HAVE TO RUN THE CALCULATIONS ON THAT AS WELL. BUT THAT THEORY IS SUPPORTED BY THE FACT THAT THESE THESE ALARMS FOR THE HEALTH MONITORING SYSTEM HAVE BEEN [00:25:08] TRIGGERED IN CORRELATION WITH THE THE TEMPERATURE CHANGE WITH THE SPRING THAW. SO IT LOOKS LIKE IT WAS FROST ACTION MOVING THE STRUCTURE FROM BELOW, WHICH CAUSED A LITTLE BIT OF A STRANGE SITUATION WHERE WE'RE HOLDING THE BUILDING UP FROM INSIDE WITH SHORING. AND THE COLUMNS, FOR LACK OF A BETTER DESCRIPTION, ARE KIND OF DANGLING IN THE FROST OFF OF THE TRUSSES. AND IT THREW OFF A BUNCH OF STRANGE READINGS WITH THE HEALTH MONITORING SYSTEM. IT THERE'S A FEW IMPLICATIONS TO THAT. ONE, I'M REALLY GLAD WE INSTALLED THAT SYSTEM. WE'VE LEARNED A LOT ABOUT THE BUILDING WITH THAT IN PLACE. AND I DON'T KNOW IF THIS IS COMFORTING OR NOT, BUT IF WE'RE OBSERVING THIS HAPPEN THIS YEAR WITH A RELATIVELY MILD WINTER, WE CAN WONDER WHAT'S BEEN HAPPENING SINCE 1967 WITH THE BUILDING. IT'S KIND OF A TESTAMENT TO THE WELL, THIS ISN'T MY THIS IS A PULL QUOTE FROM A PRIVATE CONVERSATION WITH DR. TINGLEY, BUT IT'S KIND OF A TESTAMENT TO THE MERITS OF HAVING A WOOD STRUCTURE, BECAUSE IT WOULD BE HARD TO IMAGINE A MORE RIGID ONE SURVIVING THAT LONG WITH THOSE CONDITIONS. ANOTHER ANGLE ON THAT CONSIDERATION IS THAT A LOT OF THE MOVEMENT AND DAMAGE THAT WE HAD PRESUMED THAT WAS JUST DUE TO WATER IT'S STILL DUE TO WATER, BUT IT'S DUE TO OTHER THINGS AS WELL, AND THERE'S IMPLICATIONS THERE. BUT THE BIGGEST IMPLICATION OF, OF, OF THAT, OF THESE EVENTS IS THAT IF WE HAD CHARGED HEADSTRONG IN THE FALL TO MAKING SURE THAT WE PUT THINGS BACK TOGETHER AGAIN, WE WOULD HAVE MISSED A VERY SIGNIFICANT STRUCTURAL ISSUE WITH THE ARENA. AND I TAKE THE FIRM VIEW THAT DESPITE THE APPETITE THAT THE COMMUNITY AND AT LARGE WANT WANTS TO SEE THIS FACILITY REOPEN, WE HAVE TO DO IT IN A SAFE AND CONSIDERED WAY TO MAKE SURE THAT ALL ISSUES ARE ADDRESSED. I'M GOING TO STOP THERE. I'M GOING TO OPEN UP TO QUESTIONS BECAUSE I THINK I COULD GO A LOT LONGER AND IT MIGHT BE USEFUL TO YOU OR NOT. OKAY. THANK YOU, MR. GOULDING. OKAY. JUST A SLIGHT CLERICAL ERROR. I NEED A MOTION THAT COUNCIL APPROVE THE USE OF THE NEGOTIATION METHOD, AS DESCRIBED IN THE CITY'S PROCUREMENT POLICY, TO SOLE SOURCE THE PROVISION OF SERVICES TO DESIGN STRUCTURAL REPAIRS TO THE CENTENNIAL ARENA, TO WOOD RESEARCH AND DEVELOPMENT CANADA, AT AN UPSET LIMIT OF $186,900 PLUS APPLICABLE TAXES, AND THAT THE ASSOCIATED COSTS BE DRAWN FROM THE CITY'S BUILDINGS AND FACILITIES CAPITAL RESERVE. A MOVER, PLEASE COUNCILLOR MANN SECONDED COUNCILOR BULL. NOW I WILL OPEN UP FOR QUESTIONS OR COMMENTS, COUNCILOR MANN. THANK YOU YOUR WORSHIP. THROUGH YOU. THANK YOU, MR. GOULDING, FOR YOUR REPORT. I DO HAVE A COUPLE OF QUESTIONS, BUT I GUESS FIRST AS THIS IS OUR FIRST MEETING BACK, I JUST WANT TO THANK EVERYONE THAT DID VOTE FOR KRAFT HOCKEYVILLE. SO THIS IS THE ARENA ITEM. SO I GUESS IT'S WE CAN SAY IT NOW. SO THANK YOU. WELL DONE EVERYONE. I GUESS THE FIRST QUESTION I HAVE, MR. GOULDING, IS YOU HAD INDICATED EARLIER IN THE REPORT, SO WILL THIS UPSET LIMIT OF $186,000 THEN DETERMINE THE FINAL EXTENT OF DAMAGE IN THE ARENA, OR DO WE KNOW THAT INFORMATION CURRENTLY? THAT'S MY FIRST QUESTION. THANK YOU. THROUGH YOU, WE'VE YET TO RECEIVE A FINAL DELIVERABLE FROM OUR PREVIOUS CONTRACT WITH WRD THAT DETAILS THE THE EXTENT OF THE DAMAGE. SO THE ANSWER TO YOUR QUESTION IS NO. THIS THIS COMMISSIONED WORK WILL NOT PROVIDE THAT, BUT WORK WE PREVIOUSLY COMMISSIONED WILL. SO IT'S A MATTER OF THEY HAVEN'T PUT IT ON PAPER FOR US YET. I EXPECT THAT THEY WILL BE AND IT PROBABLY WE WILL PROBABLY RECEIVE THAT DOCUMENT IN PARALLEL WITH THEIR DESIGN DOCUMENTS. THEY HAVE SUCH A STRONG UNDERSTANDING OF WHAT IS WRONG WITH THE ARENA RIGHT NOW THAT THEY ARE PREPARED TO DELIVER CONSTRUCTION DOCUMENTS IN SHORT ORDER. OKAY. THE FIRST SO THANK YOU. THE SECOND PART AND THE REASON THAT I WAS VERY HAPPY TO MOVE THIS IS BASED ON WRDS PRESENTATION TO COUNCIL IN THE FALL. [00:30:08] I'M VERY COMFORTABLE WITH THEM DOING THE WORK. I GUESS, IS IT SAFE TO THEN SAY THAT THE RELATIONSHIP THAT WE WERE ATTEMPTING TO HAVE WITH JOHNSON CONTROLS TO CREATE EFFICIENCIES, ACTUALLY, IN THE CASE OF THE CENTENNIAL ARENA DID THE OPPOSITE. THANK YOU THROUGH YOU YOUR WORSHIP. I'M NOT SURE THAT'S TRUE. IT JUST DIDN'T WE DIDN'T ACHIEVE ALL OF THE EFFICIENCIES THAT WE WERE HOPING TO. SO I'VE FRAMED THIS AS A REPAIR LASHED TO AN ESCO PROJECT, AND IT STILL IS A REPAIR LASHED TO AN ESCO PROJECT. IT'S JUST STRUCTURED LEGALLY DIFFERENTLY, THAT HAS IMPLICATIONS ON THE SCHEDULE. BUT BY AND LARGE, WE'RE STILL SEEING WE'RE STILL ACHIEVING THE SAME CORE LOGISTICAL GOALS THAT I WAS HOPING TO ACHIEVE. PERHAPS NOT THE ADMINISTRATIVE ONES, BUT THE LOGISTICAL ONES WHERE THE TWO FIRMS HAVE WORKED SO CLOSELY TOGETHER AT THIS POINT THAT THEY ARE ABLE TO HAVE SOME DESIGN COHESIVENESS BETWEEN THEM. SO. THIS MAY CHANGE. I'M NOT AN ENGINEER. I DON'T EVEN PLAY ONE ON TV. BUT WE'VE IDENTIFIED ABOUT FIVE AREAS WHERE THE WORK THAT WRD IS DOING DIRECTLY IMPACTS THE DESIGN KNOWLEDGE THAT JCI WOULD NEED TO DO ITS ESCO WORK IN THE BEST WAY POSSIBLE. SO THE ONE MOST OBVIOUS WAY THAT WE'VE TALKED ABOUT FOR A WHILE, AND I THINK I MAY HAVE MENTIONED AT COUNCIL BEFORE, IS THAT THIS IS A WOOD STRUCTURE. WE'VE LEARNED THE HARD WAY THAT WE HAVE TO KEEP IT DRY, THAT INCLUDES AMBIENT AIR. WRD WILL BE PROVIDING CRITERIA THAT JCI WILL BE DESIGNING TO FOR KEEP FOR DEHUMIDIFICATION, FOR THE WOOD STRUCTURE TO MAKE SURE THAT IT LASTS AS LONG AS POSSIBLE. THE THAT INFORMATION IS GOLDEN AND THAT CONSIDERATION HAS NEVER HAPPENED BEFORE. AND SO IT WILL INFORM TO A GREAT DEGREE THE MECHANICAL UPGRADES AND THE AIR HANDLING UPGRADES THAT WILL FORM PART OF THE ENERGY PROJECT, RIGHT. WE'RE SORTING OUT THE INTERFACE BETWEEN THE TWO FIRMS WHEN IT COMES TO THE ROOF. I HAVE A STRONG APPETITE, AND JOHNSON CONTROLS SEEMS WILLING TO ACCOMMODATE THAT JOHNSON CONTROLS LOOKS AFTER THE ROOF. THERE'S A SPECIFIC REASON FOR THAT. WE WENT AND TORE ALL OF THE INTERIOR FINISHES AND INSULATION OUT OF THE ROOF SYSTEM FROM THE INSIDE. I HAVE NO APPETITE TO PUT THEM BACK. I WOULD REALLY LIKE TO BE ABLE TO SEE ALL OF THE WOOD STRUCTURE INSIDE THE ARENA FOREVERMORE, SO THAT WE CAN INSPECT IT. SO THAT MEANS INSULATING FROM THE TOP OVER A ROOF DECK. THAT WAS MENTIONED BY DR. TINGLEY DURING HIS PRESENTATION HERE TO COUNCIL. AND THAT ASSEMBLY OF THE ROOF DECK INSULATION LAYER AND THEN ROOFING MATERIAL OVER TOP, I THINK NEEDS TO BE LOOKED AFTER BY ONE ENTITY. AND THAT ENTITY AT THIS TIME WE'RE SORTING THIS OUT IS JOHNSON CONTROLS. AND SO THAT'S ANOTHER INTERFACE. JOHNSON. FROM A HIGHER LEVEL JOHNSON CONTROLS HAS EXPRESSED THAT THEY HAVE AN APPETITE TO WORK ON A, ON A FACILITY THAT'S CAPABLE OF OCCUPANCY. THAT'S THEIR CRITERIA FOR THEIR COMFORT LEVEL. THAT DOESN'T MEAN OPERATIONS THAT JUST MEANS IT STANDS ON ITS OWN AND IT'S SAFE TO WALK INSIDE WITHOUT EXTRAORDINARY MEASURES HOLDING IT UP. RIGHT. AND SO THAT WRD WILL BE PROVIDING A DESIGN SO THAT THAT CONDITION CAN BE MET. AND PRESUMABLY WE HAVEN'T COME TO COUNCIL WITH A QUOTATION FOR THE REPAIR, ACTUAL WORK REPAIRS. BUT BASED ON THE RELATIONSHIPS IN OUR HISTORY AND THE WAY THE THINGS HAVE RUN THUS FAR, T HEIR SISTER COMPANY TIMBER RESTORATION SERVICES, WOULD BE PROVIDING THAT WORK. THERE'S A SMALL IMPLICATION IN THAT, IN THAT I JUST MENTIONED THE ROOF DECK. IT WOULD BE A STRUCTURAL COMPONENT. I DON'T THINK THAT JOHNSON CONTROLS HAS AN APPETITE TO INSTALL A STRUCTURAL COMPONENT. SO THAT MEANS THAT WE WOULD NEED TO MAKE SURE THAT THE FACILITY WOULD STAND UP WITHOUT A ROOF DECK, WHICH MEANS ADDITIONAL STRUCTURE TO BE PUT IN PLACE IN THE, IN THE ROOF SYSTEM, WHICH ULTIMATELY I THINK IS A GOOD THING. IT MEANS IT'S A STRONGER BUILDING. IT MEANS IT'S GOING TO BE A LITTLE BIT OVER ENGINEERED. BUT THAT INTERFACE BETWEEN THE COMPANIES IS WHAT I'M TALKING ABOUT. SO WHEN JOHNSON CONTROLS WOULD PUT ON A ROOF DECK, WE WOULD HAVE A FASTENING SCHEDULE THAT WOULD BE COMMENTED ON BY AND RECOMMENDED BY WRD IN ORDER TO AFFECT THAT [00:35:06] COMPONENTS INSTALLATION. STARTING TO GET DOWN IN THE WEEDS. BUT YOU CAN SEE HOW OVER THE LAST MONTH, WE'VE BEEN SPENDING A LOT OF TIME COORDINATING BETWEEN THE TWO FIRMS TO TRY AND FIGURE OUT HOW DO WE MAKE THIS HAPPEN QUICKLY, SAFELY, WITH THE CONSIDERATION THAT WE'RE HOPING TO OFFER. AND WE'RE NOT THERE YET BECAUSE I'VE YET TO BRING ANOTHER PROPOSAL FORWARD TO COUNCIL FOR ITS CONSIDERATION. BUT AT A HIGH LEVEL, WE'RE THERE. WE'RE SORTING OUT THE DETAILS ON EITHER SIDE. ONE FINAL COMMENT, YOUR WORSHIP. OR MAYBE A REQUEST. THROUGH YOU TO MR. GOULDING. IF IF THIS IS SUCCESSFUL TONIGHT WITH WRD, ANY OF THE WORK COMING BACK, IT'LL BE MY PERSONAL REQUEST. I WON'T DO IT BY RESOLUTION. I'LL JUST LEAVE IT LIKE THIS. BUT I WOULD REALLY LIKE TO SEE AN OPTIMISTIC AGGRESSIVE TIMELINE TO MEET Q3 AND NOT Q4. THAT'S SOMETHING THAT I WOULD REALLY LIKE TO SEE IF THAT'S EVEN REASONABLE TO TALK ABOUT. AND I GUESS WE WILL HAVE TO WAIT TO SEE WHAT COMES BACK FROM THIS REPORT. BUT IF THERE'S IF THEY'RE DOING THIS IN PARALLEL WITH THE OTHER WORK THAT WE'VE ALREADY REQUESTED HOPEFULLY OPTIMISTICALLY, I WILL CONTINUE TO THINK THAT WE CAN MEET SOME OF OUR OWN THOUGHTS OF SEPTEMBER AND NOT THE BALANCE OF THE YEAR. THANK YOU MR. GOULDING. THANK YOU. THROUGH YOU, MR. CHAIR. WELL, WE'VE ALREADY AT STAFF AND VENDOR LEVEL HAD THOSE DISCUSSIONS I'VE PRESSED WRD FOR AND AND TIMBER RESTORATION SERVICES FOR A SCHEDULE. AND THEIR SCHEDULE BRINGS US TO THE END OF AUGUST, BEGINNING OF SEPTEMBER. SO THAT IF YOU CARRY THROUGH WHAT I'VE JUST DESCRIBED IN TERMS OF HOW THE COMPANY'S INTERFACE AND WHAT PIECES EACH ARE INSTALLING, WE'RE LOOKING AT WE'RE LOOKING FOR JOHNSON CONTROLS TO INSTALL A ROOF FOR US AT A MINIMUM IN THE FALL. SO IT'S A MATTER OF HOW QUICKLY THEY CAN DO THAT. I DON'T THINK WE'LL BE ABLE TO MEET Q3, BUT IT'S A MATTER OF HOW FAR INTO Q4 WE GET. ANY OTHER QUESTIONS? COUNCILLOR FLINTOFF. THANK YOU YOUR WORSHIP THROUGH YOU TO MR. GOULDING. I JUST WANT TO DO A TIMELINE. AND IF I'M WRONG, YOU CAN TELL ME I'M WRONG. I'VE GOT BIG SHOULDERS HERE. SO SEPTEMBER 11TH WRD DOES AN INSPECTION, IT FAILS. OCTOBER 3RD, WE HAVE A SPECIAL COUNCIL MEETING WE AGREE TO $218,906 AND ANOTHER $60,000 FOR THE HEALTH SENSORS, WHICH OBVIOUSLY WAS MONEY WELL SPENT. AND THAT WAS FOR THE SHORING DESIGN BY WRD. NOVEMBER 16TH WE AGREE TO ANOTHER $86,027 FOR WRD TO COME BACK AND RE-INSPECT THE SHORING. THAT'S WHAT. SO NOW WE'RE UP TO $372,933. WAITING FOR THE SHORING. DECEMBER 20TH, WE AGREED FOR TO ANOTHER $350,000 TO TIMBER RESTORATION TO REPAIR CERTAIN AREAS THAT YOU HAD EXPLAINED. IT DIDN'T MAKE SENSE TO SHORE THEM. WE WANT TO PERMANENTLY FIX THOSE AREAS BECAUSE THAT MAKES SENSE. AND I WE ALL TOTALLY AGREED WITH YOU. SO MY I HAVE A COUPLE QUESTIONS AS I GO THROUGH THIS. SO MY FIRST QUESTION IS THAT PART FOR THE DECEMBER 20TH THAT MONEY WE SPENT, HAS THAT FIX BEEN DONE BECAUSE WE'VE NEVER HAD A REPORT BACK ON WHETHER OR NOT THAT PART'S BEEN DONE RIGHT. THANK YOU FOR THE QUESTION. AND THROUGH YOU, MR. YOUR WORSHIP. SO, YES, THE TIMBER RESTORATION SERVICES ATTENDED, SITE WORKED THROUGH THE WINTER, AFFECTED REPAIRS. WE GOT TO A CERTAIN POINT IN THOSE REPAIRS, AND THIS IS PRIOR TO FEBRUARY 15TH. THIS IS PRIOR TO JOHNSON CONTROLS DOING THEIR INTERNAL REVIEW AND AND ASKING TO REVISE THE PDA. WE GOT TO A POINT WHERE TIMBER RESTORATION SERVICES AND WRD REALIZED THAT WE WERE VERY CLOSE TO AN AGREEMENT ON THE 15TH OF FEBRUARY WITH JOHNSON CONTROLS, AND THAT SOME OF THE SCOPE OF WORK THAT WAS IDENTIFIED BY WRD, FOR LACK OF A BETTER DESCRIPTION, WAS DOUBLE WORK. THERE WAS SOME WORK ON SOME COLUMNS THAT THEY NEEDED TO DO THAT WERE PART OF THAT $350,000 THAT WHEN THEY PUT IT IN PLACE, [00:40:01] THEY WOULD IN VERY SHORT ORDER AT THAT TIME, PRESUMABLY HAVE TO TAKE THAT WORK OUT AND AND MOST LIKELY. REDO IT, AND THAT DIDN'T SEEM LIKE A GOOD DECISION AT THAT TIME. SO AT THAT TIME, AND IN VERY ROUGH NUMBERS, IT LOOKED LIKE THAT WE WERE GOING TO BE ABLE TO SAVE ABOUT $100,000 OF THAT $350,000. AND SO BECAUSE WE WERE SO CLOSE TO AN AGREEMENT WITH JOHNSON CONTROLS, AND THERE WAS GOING TO BE A FORM WHAT WE HAD PRESUMED TO BE A FORMAL TRANSFER OF THE JOBSITE FROM ONE ENTITY TO ANOTHER. AND WE WERE EXPERIENCING A VERY LIGHT WINTER, AND WE HAD MITIGATION MEASURES IN PLACE IN TERMS OF PROCEDURES FOR SNOW REMOVAL AND ENSURING THAT WAS IN PLACE. WE MADE THE I MADE THE DECISION TO LET'S HOLD OFF WITH ADVANCING TRS WORK. LET'S TRY AND SAVE THAT MONEY. IT'S A CONSIDERABLE SUM. AND LET'S HAVE JCI CARRY ON WITH THIS ENTIRE PROJECT. AND THAT WE ALL KNOW NOW BECAUSE I'VE MADE THIS REPORT THAT DIDN'T COME TO PASS. IN RETROSPECT, IT'S BOTH A GOOD AND A BAD THING. IT'S IT'S A GOOD THING BECAUSE WE'RE NOT DOING DOUBLE WORK AND WE SAVE SOME MONEY. AND ACTUALLY, I WAS FLIPPANT THERE AND SAID IT'S A BAD THING, BUT I IT WAS A STRESSFUL DECISION TO MAKE. IN ADMINISTERING THE PROJECT, BUT IT AFFORDED ME SOME CONTINGENCY FUNDS TO HAVE TRS AND WRD RE-ATTEND AND REENGAGE WITH THE WITH THE SITE. SO WHEN WE STARTED NOTICING THE ALARMS GOING OFF, THERE WAS MONEY THERE UNDER THE ORIGINAL CONTRACT THAT I BROUGHT THE VENDOR BACK, I SAID, WE STILL HAVE APPROVAL FOR AN UPSET LIMIT OF $350,000. COME ON AND LET'S MAKE SURE WE KNOW WHAT'S GOING ON WITH THESE STRUCTURAL ISSUES SO WE DON'T HAVE A BIGGER PROBLEM. SO ON THAT BASIS, I WAS ABLE TO REENGAGE WITH THEM WITHOUT COMING TO COUNCIL VERY QUICKLY. GET SOMETHING DONE. RIGHT. OKAY. SO I HOPE. I HOPE THAT ANSWERS YOUR QUESTION. SOME OF IT GOT DONE OR NONE OF IT GOT DONE? THE VAST MAJORITY OF IT GOT DONE. OH, OKAY. SOME IS OUTSTANDING. THE COLUMN WORK THAT WE FORWENT NOW HAS TO BE DONE. I'M ALMOST DONE YOUR WORSHIP I JUST WANT TO FINISH THE TIMELINE. OKAY, SO THEN WE GET ON TO FEBRUARY 15TH WE PASS A BYLAW TO ENTER INTO A PROJECT DEVELOPMENT WITH JOHNSON CONTROLS, WHICH YOU'VE EXPLAINED VERY WELL TO US THAT AND THAT WAS FOR $275,000. MIKE WHAT I REALLY DON'T UNDERSTAND ON THAT WELL, WE DON'T FIND OUT UNTIL SEVEN WEEKS LATER, WHICH I KNOW EVERYTHING TAKES TIME. WHEN THEY AGREED TO DO THE $275,000 IN FEBRUARY 15TH. IT SAYS ON THIS ANALYST, IT SAYS JOHNSON CONTROLS HAS MADE IT CLEAR TO STAFF THEY ARE ENABLED TO WORK ON A BUILDING THAT IS NOT SUITABLE FOR OCCUPANCY DUE TO STRUCTURAL DEFICIENCIES. DO YOU MEAN TO TELL ME BACK IN FEBRUARY 15TH, YOU DIDN'T KNOW THE BUILDING HAD STRUCTURAL DEFICIENCIES? IT DOESN'T. IT DOESN'T MAKE SENSE. THANK YOU. THROUGH YOU, MR. CHAIR, YOU SOUND A LOT LIKE MYSELF EARLIER THIS MONTH. I I'M SORRY, MR. GOULDING, BUT THE PUBLIC ARE WONDERING THAT I HAVE TO ASK THESE QUESTIONS. I THINK IT'S A FAIR QUESTION. I MADE IT CLEAR TO JOHNSON CONTROLS THAT I'M GOING TO HAVE TO ANSWER THESE SORT OF QUESTIONS. THE ONLY SENSE THAT I CAN MAKE OF IT IS THAT THAT SCRUTINY THAT WAS BROUGHT UPON BY HAVING TO ENTER INTO A CONTRACT KICKED THINGS UP ABOVE A LEVEL AT WHICH THEY WERE PREVIOUSLY DISCUSSED. THAT'S NOT TO SAY THAT THE STAFF THAT I WAS ENGAGED WITH AT THE COMPANY WASN'T DOING THINGS WITH CONSIDERATION OR INTO THE UNDER THE PROPER PROCESSES THAT THEY ENGAGE IN AS, AS A CORPORATION. IT'S JUST THAT THE I ASKED THEM TO DO SOMETHING THAT THEY'D NEVER BEEN ASKED TO DO, AND THEY REALLY WANTED TO HELP. I THINK THAT'S WHAT HAPPENED. AND THEY GAVE US A YES BEFORE THEY YOU HAVE TO REALIZE HOW BIG THIS COMPANY IS BEFORE THEY COLLECTIVELY UNDERSTOOD WHAT THEY WERE REALLY GETTING INTO. IT'S THE ONLY WAY THAT I CAN READ THE SITUATION. SO THEY JUST HAVE ONE MORE QUESTION. SO THEY NEVER GOT BACK TO YOU. SO NOW IT'S APRIL 8TH AND WE'RE REALLY NOT IN THERE REPAIRING THE BUILDING. AND I KNOW YOU'VE DONE EVERYTHING YOU CAN. I JUST I HAVE TO GET MY HEAD TOTALLY WRAPPED AROUND THIS TONIGHT, AND WE'RE PATIENTLY WAITING FOR A FINAL BILL OR SOMETHING FROM [00:45:04] WRD. TO SAY IT'S GOING TO BE X AMOUNT OF DOLLARS. LET'S GET THE GUYS IN THERE AND LET'S GET TO WORK, BECAUSE I, I KNOW THAT'S. AND ONE MORE LAST THING THIS THIS JOHNSON CONTROLS. OBVIOUSLY WE'RE GOING TO GET A CREDIT FROM THE $275,000. THANK YOU. THROUGH YOU YOUR WORSHIP THERE'S A FEW QUESTIONS THERE. YEAH. SO SO WHAT HAPPENED BETWEEN FEBRUARY 15TH, AND THE POINT AT WHICH JOHNSON CONTROLS LET ME KNOW THAT THEY WEREN'T INTERESTED. SO FORGIVE ME, I HAVEN'T. I HAVEN'T. I THINK IT WAS ON MARCH 11TH THAT I LEARNED THAT THEY WEREN'T INTERESTED IN PROCEEDING AND OUR INITIAL COMMUNICATION WAS SUCH THAT THEY WERE NOT WELL. I'VE SPENT THE LAST MONTH OR SO FIGURING OUT A WAY THAT WE CAN CONTINUE TO WORK TOGETHER. THEIR INITIAL RESPONSE TO ME ON MARCH 11TH WAS A LOT LESS INVOLVED THAN WHAT I'VE PRESENTED TO YOU IN THIS REPORT. SO THEY STILL HAVE AN APPETITE TO HELP US WITH THIS. AND I MADE IT CLEAR IN THIS REPORT WITH MY 5 OR 6 POINTS RIGHT IN THE MIDDLE OF IT, I STILL THINK THIS IS THE BEST WAY FORWARD. BUT THE THE APPROXIMATELY THREE WEEKS FROM FEBRUARY 15TH TO WHEN THEY LET ME KNOW THAT WASN'T DEAD TIME. THEY THEY WERE STILL HAVING THEIR ENGINEERS ENGAGE IN DESIGN WORK. THEY WERE STILL COORDINATING THINGS ON THEIR END. THEY WERE WORKING WITH WRD. TO GET FIRM PRICING ON WHAT WRDS DESIGN COSTS WOULD BE AND WHAT TIMBER RESTORATIONS CONSTRUCTION COSTS WOULD BE. THAT'S PART OF THE REASON WHY THOSE TWO FIRMS CAN PROVIDE US WITH INFORMATION SO QUICKLY. THEY'VE ALREADY DONE THIS BACK IN MARCH. RIGHT. AND THEY SPENT THE BETTER PART OF THOSE THREE WEEKS WRESTLING WITH THEIR INTERNAL STAFF AT VARIOUS LEVELS, TRYING TO FIGURE OUT HOW CAN WE ACTUALLY DO THIS? THIS IS MY UNDERSTANDING THROUGH TALKING WITH THEM AND UNFORTUNATELY AFTER GOING THROUGH THAT PROCESS WITH THEIR OWN ADMINISTRATION. THE ANSWER CAME OUT THAT AS DEFINED, THEY COULDN'T. SO WHEN THEY TOLD ME THAT, I WENT BACK AND PUSHED AND SAID, OKAY, THAT'S GREAT, YOU TOLD ME WHAT YOU CAN'T DO. TELL ME WHAT YOU CAN DO. WHAT CAN WE DO HERE? HOW CAN WE WORK TOGETHER AND MAKE THIS WORK? AND THIS IS THE FIRST STEP TO WHAT TO WHAT WE'VE BEEN ABLE TO PUT TOGETHER. I'M BRINGING YOU TONIGHT TO TO TALK. OKAY, THAT'S THAT'S IT FOR NOW. I'LL OPEN THE FLOOR OVER HERE OR SOMETHING. I MIGHT COME BACK, THOUGH. I THINK THAT'S MY JOB, CHARLIE [LAUGHTER]. COUNCILLOR SEIDEL. THANK YOU YOUR WORSHIP THROUGH YOU TO MR. GOULDING. AGAIN, A COUPLE QUESTIONS. I DON'T QUITE UNDERSTAND HOW JOHNSON CONTROLS COMES UP WITH A PRICE FOR A PDA OF $275,000 WITHOUT TALKING TO WRD TO GET A PRICE FROM THEM. SORRY. THANK YOU. THROUGH YOU YOUR THROUGH YOU, YOUR WORSHIP. I BELIEVE I MISSPOKE, I, I SAID THAT THEY WERE GETTING A PRICE FROM WRD AT IN THOSE THREE WEEKS. THEY COULDN'T HAVE THEY THEY GOT THEIR DESIGN COSTS UP FRONT BEFORE THEY PRESENTED US WITH A PDA. OKAY. SO THEN WOULD WE BE ABLE TO HOLD JOHNSON CONTROLS TO THE TOTAL COST OF THE $275,000, LESS THE $176,000? SO THEIR DESIGN FEE IS ONLY GOING TO BE AROUND THE $80,000. THANK YOU. THROUGH YOU. SO I'M DEFINITELY PUTTING THAT PRESSURE ON. DO I THINK I'M GOING TO BE SUCCESSFUL IN THAT? NO I DON'T I THINK THAT THE THE PROJECT HAS COMPLICATED ITSELF A LITTLE BIT, BUT I WELL IN GOOD FAITH I LET JOHNSON CONTROLS READ MY REPORT BEFORE IT WAS PUBLISHED TO THE COMMUNITY AND TO COUNCIL TO SAY, DO YOU DISAGREE WITH ANY OF THIS MATERIAL? AM I BEING UNFAIR IN ANY OF MY ASSESSMENT AND IN MY REPORT I CLEARLY SAY WE'RE EXPECTING THEIR DESIGN FEES TO COME IN AT SUBSTANTIALLY LESS THAN, AND THEY CAN DO MATH WELL. SO I'M HOPING THAT WE HAVE SOME SUCCESS ON THAT FRONT. OKAY, I'LL LEAVE IT FOR NOW. COUNCILLOR LEFEBVRE. THANK YOU, YOUR WORSHIP THROUGH YOU. [00:50:02] I WOULD BE IN AGREEMENT WITH YOUR LAST COMMENT. I THINK IF WE WOULD HAVE HAD PRICING ASSIGNED TO EACH OF THE SCOPE OF SERVICES, THEN WE COULD HAVE HELD THEM TO THAT. BUT I HIGHLY SUSPECT THAT WE WILL NOT RECOUP THE COST OF THE WRD BASED ON THEIR OVERALL WORK LEFT IN THE SCHEDULE. I GUESS MY QUESTION IS, IS THERE DOES IS WRD EQUIPPED TO COMPLETE THE SCOPE OF SERVICES THAT WERE UNDER 1B IN THE PDA, TO DO THE ROOFING, TO DO THE RESTORATION WORK AND EVERYTHING ELSE. THANK YOU. THROUGH YOU, YOUR WORSHIP. YOU'VE CAUGHT ME AT A BIT OF A LOSS. I'M NOT FAMILIAR OFFHAND WITH WHAT 1B IN THE PDA IS AT THIS VERY MOMENT, BUT. WELL, IT SPOKE TO THE ROOFING MORE OF THE ROOFING STUFF. THE SPECS FOR THE EXTERIOR WALL LIKE THE THINGS THAT THEY EXCLUDED IN THEIR QUOTE. OKAY. SO ARE THEY ABLE TO DO THAT? YES, THEY ARE ABLE TO DO THAT WITHIN THEIR SCOPE OF PRACTICE, WRD IS ABLE TO PROVIDE THOSE DESIGN SERVICES. IS THAT WHAT I WOULD RECOMMEND DOING? WELL NOT NECESSARILY BECAUSE THERE'S AN ENERGY IMPLICATION TO THE INSULATION LAYER THAT I THINK THAT WOULD ALLOW US TO ACCESS FUNDING THAT'S AVAILABLE FOR ESCO PROJECTS. THAT AND IT'S A REALLY SLIPPERY SLOPE ON WHO DO WE WANT RESPONSIBLE FOR WHAT AND HOW H OW DOES THE WHOLE BUILDING WORK TOGETHER? AND I THINK THE ENVELOPE WORK BECAUSE IT HAS THE ENERGY FOCUS SHOULD REMAIN WITH THE ESCO COMPANY. THAT'S WHY I'VE RECOMMENDED IT THAT WAY. THERE'S STILL AN OPPORTUNITY TO CHANGE THINGS IF I GET AN ANSWER FROM JOHNSON CONTROLS THAT IN TERMS OF MONEY OR TIMELINES OR EXPEDIENCY OTHERWISE, OR LOGISTICS, I MIGHT CHANGE THAT OPINION AND I WOULD COME TO COUNCIL WITH THAT REVISED OPINION. BUT BASED ON WHAT I KNOW NOW, I'M THINKING THIS IS THE BEST WAY TO PROCEED. OKAY. BECAUSE THERE'S THE ONE LINE IN THERE QUOTE THAT CATCHES MY EYE, WHICH WILL LEAD TO THIS WITH TWO SUPPLIERS, RIGHT? IS THAT THEIR SPEC IS DEPENDENT ON THE ROOF WORK FOR THEIR DESIGN WORK. SO THAT'S GENERALLY A RED FLAG. THE OTHER SUGGESTION I WOULD HAVE FOR WRDS QUOTE IS IF THEY'RE ABLE TO ADD TIMELINES TO THEIR COST ESTIMATES, IT WOULD HELP US TO FIGURE OUT THEIR TIMELINES AS WELL. THAT'S IT FOR ME. OKAY. THANK YOU COUNCILLOR LEFEBVRE, COUNCILLOR BULL. THANK YOU, YOUR WORSHIP TO YOU, MR.GOULDING. ON THE FULL RESTORE RESTORATION DESIGN NUMBER ONE IT SAYS TIMBER RESTORATION DESIGN, INCLUDING THE TIMBER ELEMENTS, PURLINS, BLEACHERS AND STAMPED DRAWINGS. IS THAT FOR THE BEAMS THAT ARE GOING TO GO ON THE CONCRETE FOOTINGS THAT IF THEY HAVE TO BE CHANGED, OR IS THAT STILL FROM THE BEAMS BEFORE THEY WERE WORKING ON? THANK YOU. THROUGH YOU YOUR YOUR WORSHIP, YOU'RE YOU'RE REFERRING TO THE WRD QUOTE. SORRY. YEAH. LET ME REVIEW IT BEFORE I COMMENT. OKAY. I'M SORRY, WHICH NUMBER WERE YOU REFERRING TO? THE FIRST ITEM TIMBER RESTORATION DESIGN. YEAH. OKAY. SO ALL THE WORK THAT WE'VE DONE SO FAR WITH WRD HAS BEEN MITIGATION WORK. LET'S MAKE SURE THINGS DON'T FALL DOWN. THEN THERE WAS $350,000 THAT COUNCILLOR FLINTOFF MADE REFERENCE TO ABOUT TARGETED STRUCTURAL REPAIRS. NOT COMPREHENSIVE, BUT IT MAKES SENSE TO FIX THESE SPECIFIC THINGS RATHER THAN PUT SHORING TOWERS UP. THIS DESIGN WORK IS FOR EVERYTHING ELSE THAT NEEDS TO BE EITHER STRENGTHENED OR REPAIRED IN THE BUILDING. OKAY. THANK YOU. FOLLOW UP. I'M JUST CURIOUS AS TO WHY NOBODY WOULD HAVE WITH ALL THESE COMPANIES. NOBODY WOULD HAVE THOUGHT OF CHECKING THE FOOTINGS. I MEAN, THE ROOF AND THE WALLS ALL SIT ON THAT. I WOULD HAVE THOUGHT MAYBE SOMEBODY MIGHT HAVE HAD THE THOUGHT TO CHECK TO MAKE SURE OR IF, IF WAS IT EVEN DONE FIVE YEARS AGO OR WHEN THIS ALL STARTED? THANK YOU. THROUGH YOU, MR. CHAIR. NO, I'M MR. CHAIR YOUR WORSHIP. SORRY, I'VE DONE THAT A FEW TIMES TONIGHT. NO, I'M SEEMINGLY THE MOST AGGRESSIVE INVESTIGATOR THERE'S BEEN WITH RESPECT TO THIS BUILDING. IN GENERAL, THERE WAS NO REASON TO SUSPECT THE BUILDINGS STOOD HERE FOR A LONG TIME. I WOULDN'T HAVE ANTICIPATED THAT THIS WAS AN ISSUE, AND IF WE DIDN'T HAVE THE MEANS TO MEASURE THAT, WE WOULDN'T HAVE SEEN IT. TO GIVE YOU AN IDEA HOW SENSITIVE THE HEALTH MONITORING SYSTEM IS, WHEN THE ALARM STARTED GOING OFF, THE FIRST QUESTION THAT THE TEST THE TECHS ASKED US AS [00:55:09] STAFF WERE, OH, HAVE ANY DELIVERY TRUCKS CHANGED ROUTE IN THE AREA RECENTLY? SO DEPENDING UPON THEIR CALIBRATION, THEY CAN MEASURE THOSE KINDS OF VIBRATIONS. AND IN FACT, I'VE SEEN THE RAW DATA AND THEY DO ROUTINELY. AND SO THEY SET A THRESHOLD ABOUT WHAT'S OF CONCERN OR WHAT'S NOT BASED ON THEIR EXPERIENCE. SO THESE ARE PRETTY SENSITIVE DEVICES. THAT BEING SAID, THE SIGNALS THAT WE WERE GETTING WERE SO UNUSUAL AND SO CONSISTENT FOR SO LONG ON I MEAN, I REMEMBER IT WELL, MARCH 8TH, WE GOT NO LESS THAN EIGHT ALARMS ON THAT DAY I WAS HAVING I HAPPENED TO BE OFF AND OUT OF PROVINCE, AND IT WAS PRETTY STRESSFUL TIME WATCHING MY PHONE THAT DAY. AND IT DIDN'T GET LESS STRESSFUL AS TIME WENT ON, BUT IT DID GET A LITTLE BIT MORE NORMALIZED BECAUSE IT TAKES A LONG TIME FOR FROST TO COME OUT OF THE GROUND I'VE LEARNED IN ELLIOT LAKE. SO YEAH. OKAY, SO TO YOUR KNOWLEDGE, THIS WASN'T CHECKED OUT FIVE YEARS AGO OR I DON'T KNOW. SORRY, I. SO TO MY KNOWLEDGE, NO IT WASN'T. AND I'D BE VERY SURPRISED IF IT WAS, FRANKLY. WELL, THROUGH YOU, YOUR WORSHIP, I KNOW THEY RESTORED SOME OF THE SUPPORT BEAMS ON THE OUTSIDE, SO I WAS JUST CURIOUS IF THEY HAD CHECKED THE FOOTINGS AT THE TIME. OKAY. THANK YOU. COUNCILLOR MORRISSETTE. THROUGH YOU, YOUR WORSHIP. WHEN I READ THIS REPORT, I WAS REALLY MAD THAT THERE WERE JUST SORT OF, LIKE, MOVING ALONG BUT NOT MOVING FAST ENOUGH. AND SO MY NEXT QUESTION IS, IS IT POSSIBLE TO GET THE STRUCTURE SAFE ENOUGH FOR THE OPENING OF THE ARENA AND AT THE END OF AUGUST, AND MAYBE THE ROOF BE DONE WHEN IT'S, YOU KNOW, EARLY FALL TO GET IT FINISHED? OR DO WE HAVE TO WAIT UNTIL THE ROOF IS DONE WITH THE STRUCTURE TO OPEN THE ARENA? THANK YOU. THROUGH YOU, YOUR WORSHIP. SO THOSE ARE KIND OF THE SAME QUESTIONS, SO I'LL TRY TO ANSWER. I'LL TRY TO ANSWER AS SPECIFICALLY AS I CAN. SO RIGHT NOW, TIMBER RESTORATION SERVICES IS SAYING THAT IN BEST CASE SCENARIO, THE EARLIEST THAT THEY REASONABLY COULD BE DONE THE WORK, IF EVERYTHING GOES WELL, IS THE BEGINNING OF SEPTEMBER. AT THAT POINT, WE WOULD ENGAGE WITH JOHNSON CONTROLS TO TAKE CARE AND CONTROL OF THE SITE AND START INITIATING WORK AND MOBILIZING THEIR CONTRACTORS TO CARRY ON. AND I HAVEN'T BEEN ABLE WE DON'T KNOW WHAT THE TIMELINE FOR THE ROOF INSTALLATION WOULD BE STARTING IN SEPTEMBER. SO DOES THAT SORRY DOES THAT MAKE IT MORE CLEAR FOR YOU? NOT AT ALL. SO MY NEXT QUESTION IS, DOES JOHNSON AND CONTROL HAVE TO WAIT TILL THE STRUCTURE IS DONE BEFORE THEY FIGURE OUT ABOUT THE ROOF? OR CAN THEY START MAKING A PLAN ON THE ROOF? SO WHEN THE STRUCTURE IS DONE, THEY COULD START ON THE ROOF AND GET IT DONE INSTEAD OF WAITING ANOTHER TWO MONTHS. THANK YOU. SO THE ANSWER TO THAT IS YES. THEY CAN START BEFORE THE WORK IS ACTUALLY IN PLACE. SO SO WE'RE TALKING ABOUT TWO THINGS. WE'RE TALKING ABOUT DESIGN AND PEOPLE ACTUALLY SWINGING HAMMERS, RIGHT, DOING WORK. SO THE DESIGN CAN HAPPEN WHILE TIMBER RESTORATION SERVICES IS REPAIRING. I'M PRESUMING THAT THEY WILL. BUT I THINK IT'S A SAFE PRESUMPTION WITH ALL OF US HERE REPAIRING THE STRUCTURE OVER THE SUMMER. SO BY THE TIME THAT TIMBER RESTORATION SERVICES HAS MADE SURE THAT ALL OF THE WOOD ELEMENTS WILL STAND UP IN PLACE AND THAT THE FACILITY CAN BE SAFELY, WE CAN REMOVE ALL THE SHORING. WE CAN GO IN AND OUT OF THERE WITHOUT CONCERN. THE DESIGNS, THE DESIGNS FOR THE REMAINDER OF THE ELEMENTS WILL BE DONE FROM BY JOHNSON CONTROLS. OKAY, YOU'RE FINISHED COUNCILLOR MORRISSETTE. FOR NOW. COUNCILLOR FLINTOFF. THANK YOU, YOUR WORSHIP THROUGH YOU BACK TO MR. GOULDING. SO I REMEMBER WHEN WE WERE BRINGING JOHNSON CONTROLS ON A FEW MEETINGS AGO. [01:00:05] WE SAID THERE'S SOME PRIORITY THINGS THAT HAVE TO BE DONE, AND WE USED THE WATER TREATMENT PLANT AS AN EXAMPLE. THE WHATEVER THAT THING ON THE ROOF WAS. BUT SO NOW MY QUESTION TO YOU, MR. GOULDING, IS JOHNSON CONTROLS IS NOT IN THERE GETTING IT STRUCTURALLY SOUND. THEY'VE MADE THAT VERY CLEAR. THEY REALLY WANT NOTHING TO DO WITH IT. SO WE'RE BRINGING IN WRD OR WOOD RESTORATION PEOPLE, THEY KNOW THEIR STUFF. THEY'RE GOING TO GET IT UP AND GOING, CAN WE NOT PUT SOME OF THIS STUFF FROM THE ESCO ON HOLD LIKE, AND DEAL WITH IT? MAYBE AFTER THE WINTER SEASON, LIKE, SURE, WE'D LIKE TO HAVE LED LIGHTING IN THERE, BUT I MEAN, PEOPLE WOULD BE JUST AS HAPPY TO BE SKATING IF IT WAS AN LED LIGHTING RATHER THAN, YOU KNOW, WHY DO WE HAVE TO HAVE IT LIKE TAJ MAHAL BEFORE ANYBODY CAN GET IN THERE? THANK YOU. THROUGH YOUR WORSHIP. THAT'S IN FACT MY PLAN ALL ALONG. SO THE STATE THAT MOST PEOPLE PROBABLY WOULDN'T NOTICE THE DIFFERENCE BETWEEN THE ARENA NOW AND WHEN IT OPENED. RIGHT. SO THE ONLY, IN FACT, THE ONLY THING I CARE ABOUT FOR OPENING IS SAFE STRUCTURE AND NEW ROOF. I DON'T THINK THERE'S MUCH POINT IN PUTTING REPAIRS AND EFFORT INTO THE STRUCTURE, AND LET IT CONTINUE TO BE LEAKED ON FOR YET ANOTHER SEASON. THAT JUST MAKES NO SENSE TO ME, AND EVERYTHING ELSE IS OPTIONAL. UNTIL THE FOLLOWING SEASON, WE CAN GET SKATING IN A PLACE WITH A ROOF AND A SAFE STRUCTURE. SO, WHEN JOHNSON CONTROLS OFFERS US A PDA FOR DESIGN AND THEN SUBSEQUENTLY A CONTRACT FOR THE ESCO WORK, I'M EXPECTING AND I'VE MANDATED TO THEM, AND THEY'RE WILLING TO ACCOMMODATE, AS FAR AS I KNOW BIG OLD HOLE IN THE SCHEDULE SO THAT WE CAN GO AND PLAY HOCKEY NEXT SEASON. RIGHT? SO, WE CAN START WITH THE ROOF, TAKE A PAUSE, DEMOBILIZE FROM SITE, COME BACK, PUT UP NEW SIDING AND EXTERIOR INSULATED PANELS AND THE REMAINDER. OKAY. THANK YOU. COUNCILLOR BULL. THANK YOU, YOUR WORSHIP, MR. GOULDING, THROUGH YOU. I AGREE WITH THAT. WE DON'T HAVE TO CHANGE THE LIGHTS RIGHT AWAY. WE WOULD HAVE TO INSTALL A DEHUMIDIFICATION SYSTEM OR SOMETHING LIKE THAT. I DON'T EVEN KNOW WHAT KIND OF SHAPE THE PLANT IS IN, BUT THAT KIND OF STUFF COULD BE DONE BEFORE IT OPENS. OR WOULD HAVE TO BE DONE BEFORE IT OPENS. THANK YOU THROUGH YOU, MR. CHAIR. WELL, WE'D HAVE, AS FAR AS WE KNOW, THE PLANT RUNS, SO WE'D HAVE TO RECOMMISSION IT. WE'VE DECOMMISSIONED IT AT THIS POINT. AND DEHUMIDIFICATION. THERE IS A DEHUMIDIFICATION SYSTEM IN IT. IT'S TAXED MOST IN THE SUMMER. THE AIR IS GENERALLY DRIER IN THE WINTER. I'M HOPING THAT THE ENGINEERS CAN COMMENT ON THAT, SO THAT WE CAN NARROW DOWN THE SCOPE OF WORK AS MUCH AS WE CAN TO GET OPEN AS SOON AS WE CAN THIS FALL AND DEFER AS MUCH OF THOSE ITEMS AS WE CAN. BUT THOSE QUESTIONS ARE EXACTLY WHY I DON'T HAVE A PDA HERE FOR YOU FROM JOHNSON CONTROLS IN PARALLEL, WE'VE GOT A LOT OF STUFF TO FIGURE OUT. OKAY. THANK YOU. COUNCILLOR MORRISSETTE. THROUGH YOU, YOUR WORSHIP. ANOTHER QUESTION WOULD HAVE THEY GIVEN YOU ANY INDICATION BEFORE THEY COULD COME BACK WITH NEW FIGURES FOR US? DO THEY REALIZE THE IMPORTANCE? THAT IT'S NEEDED SOON. THANK YOU. THROUGH YOUR WORSHIP, I THINK IT'S FAIR TO SAY THAT EVERYBODY INVOLVED AND UNDERSTANDS THE URGENCY THAT WE WANT TO PROCEED WITH THE PROJECT WITH. YEAH. SO, WE STILL HAVE. I SPOKE TO TIMBER RESTORATION SERVICES TODAY VIA EMAIL. WE STILL HAVE SOME RESIDUAL IN THE CONTRACT AMOUNT FOR THAT. COUNCILLOR FLINTOFF MADE REFERENCE TO THE 350,000. I'M GOING TO BE ASKING THEM TO REMOBILIZE FOR THE BEGINNING OF NEXT WEEK. I'M INVESTIGATING THAT SO THAT WE CAN GET FORCES ON SITE AND HAVE SOME PARALLELISM IN THE DESIGN WORK AND DOING THE WORK THAT WE KNOW NEEDS TO BE DONE AS SOON AS POSSIBLE. I'M EXPECTING TO SEE PRICING FROM THEM IN THE NEXT COUPLE OF WEEKS, AT WHICH POINT I'LL BRING IT FORWARD TO COUNCIL FOR APPROVAL SO THAT WE CAN GET THIS GOING AS SOON AS POSSIBLE. I'M TRYING TO PULL EVERY CHECK I CAN TO GET THINGS GOING AS FAST AS WE CAN. [01:05:02] OKAY, MR. GOULDING, I HAVE A FEW QUESTIONS. SO, SEPTEMBER 11TH. I'D KNEW ABOUT THIS ISSUE RIGHT THEN AND THERE. WE COMMITTED TO THEM THAT WE WANTED TO BASICALLY FIX IT BY WHATEVER THE NEXT MEETING WAS. WE AGREED TO THEIR TERMS. WE GAVE THEM THE MONEY. MY QUESTION IS, WHY HAVEN'T THEY BEEN PLANNING THIS STRAIGHT THROUGH? I KNOW THAT JOHNSON CONTROLS IS GOING TO IMPLICATE OR BE THE LEAD. BUT THE WORD SHOULD HAVE BEEN CONTINUING THEIR BUSINESS, THEIR STUDIES AND EVERYTHING. I'M ALMOST POSITIVE THAT THEY SHOULD BE READY TO GO RIGHT NOW. AND I DON'T THINK WE'RE GOING TO WAIVER FROM OUR COMMITMENT TO GET THEM HERE. JUST WANT TO MAKE SURE THAT THEY KNOW THE URGENCY AND THE EXPECTATION. AND IF IT IS POSSIBLE TO GET THIS DONE, YOU KNOW, THAT'S 12 MONTHS, SEPTEMBER TO SEPTEMBER AND NOW WE'RE ON APRIL 8TH. I'M A LITTLE DISAPPOINTED THAT YOU MENTIONED THAT THIS TROUBLE WAS MARCH 11TH, THAT YOU FOUND OUT BETWEEN JOHNSON CONTROLS AND WRD AND WE'RE ONLY HEARING ABOUT IT NOW. AND I'M ALSO A LITTLE DISAPPOINTED IN JOHNSON CONTROLS. I SHARE YOUR DISAPPOINTMENT AND FRUSTRATION. THE DUDE SAT RIGHT IN THAT TV SCREEN, AND I ASKED HIM OUTRIGHT, DO YOU DO THIS OFTEN? DO YOU SHARE RESPONSIBILITIES WITH OTHER COMPANIES? AND HE ASSURED US THEY DO IT ALL THE TIME. TO HAVE THIS COME BACK BECAUSE OF LEGAL IS A BIT OF A SLAP IN THE FACE. YEAH, WE JUST WON HOCKEYVILLE. VERY IMPORTANT THING. WE NEED TO RIDE THE WAVE, TOO, AND I REALLY. I DON'T KNOW IF WE CAN GET DR. TINGLEY BACK HERE TO TALK TO US AT ONE POINT, EVEN A SPECIAL MEETING, I'LL CALL IT. BUT WE HAVE TO GET MOVING. I'D LIKE TO FIND OUT WHERE THEY ARE IN THEIR PLANS TO MOVE FORWARD. SORRY. WOULD YOU LIKE ME TO RESPOND? I DIDN'T HEAR A QUESTION THERE. WELL, I'M JUST WONDERING IF THEY'RE READY. I GUESS. NO, MAYBE I WAS JUST MAKING A COMMENT. IT'S. WE'RE FRUSTRATED, AND I'M SURE YOU ARE, TOO. THIS IS AN IMPORTANT THING. I'M URGING YOU TO FIND A WAY. AND IF WE CAN HELP TO FIND A WAY TO GET THIS OPEN QUICKER, WE'LL DO WHAT WE CAN. SO, I THINK I WILL. I THINK I WILL RESPOND. THERE'RE A FEW THINGS THERE. THE REASON I DIDN'T COME BACK BETWEEN MARCH 11TH AND NOW IS THAT I SEE VERY LITTLE VALUE IN RAISING ALARM WITHOUT A SOLUTION. I'VE COME BACK TO YOU WITH A SOLUTION THAT I THINK IS THE BEST WAY. IF I CAME AND SAID, HEY, THERE'S A PROBLEM WITHOUT SOMETHING FOR COUNCIL TO CONSIDER, I DON'T KNOW WHAT USE THAT IS FOR THE COMMUNITY OR FOR THE PROJECT OR FOR ANYONE. REALLY. I MEAN, I NEED TO GIVE YOU, COUNCIL, A RESOLUTION TO PASS TO AFFECT MY NEXT ACTION. SO, I GOT THINGS ARRANGED SO THAT I COULD OFFER A RESOLUTION FOR COUNCIL TO CONSIDER SO THAT I COULD TAKE MY NEXT ACTION. UNFORTUNATELY, IT JUST TOOK ME A MONTH TO DO IT. AND THE IMPLICATION THAT WRD HASN'T BEEN WORKING ON THIS IS, IT'S INCORRECT. THEY'VE BEEN CARRYING ON UNDER THE CONTRACTS THAT WE'VE ISSUED AS WE'VE GONE IN GOOD FAITH, GONE AHEAD IN GOOD FAITH. WHAT'S CHANGED IS WHO'S GOING TO PAY THEM FOR IT. AND MY UNDERSTANDING IS THAT MY UNDERSTANDING IS THAT THEY'VE GOT A BIG OLD HEAD START ON STUFF. THEY'RE PRACTICALLY DONE. SO, NOT PUT TOO FINE A POINT ON IT, BUT UNTIL COUNCIL APPROVES THEIR QUOTATION TONIGHT, THEY WOULD HAVE BEEN WORKING ON SPEC FOR ALL OF THAT WORK. SO, I DON'T THINK IT'S FAIR TO IMPLY THAT THEY'RE NOT DOING EVERYTHING THEY CAN FOR THIS COMMUNITY. IN FACT, IT'S QUITE THE OPPOSITE. THEY'RE VERY ENGAGED AS VENDORS AND I'M REALLY HAPPY WITH THEIR SERVICES AND PERFORMANCE. THERE'S NO DEFENSE FOR YOUR COMMENTS ABOUT JOHNSON CONTROLS. I SHARE YOUR FRUSTRATION. WELL. ANY OTHER QUESTIONS OR COMMENTS? [01:10:02] COUNCILLOR LAFAVE. THANK YOU, YOUR WORSHIP. THROUGH YOU. I THINK WHAT MIGHT APPEASE THIS COUNCIL IS, AS I SUGGESTED EARLIER, IF WE CAN GET MILESTONE DATES ATTACHED TO THESE WHAT THE WORK THAT THEY'VE PUT IN THEIR QUOTE, BECAUSE I AGREE WITH YOU, I THINK THEY ARE PROBABLY 9,075% COMPLETED DESIGN. AND ONCE WE SIGN THIS, WE MIGHT GET THINGS VERY QUICK. BUT WITHOUT KNOWING WHAT THEIR TARGET TIMELINES ARE, WE DON'T KNOW. RIGHT. AND THE OTHER THING I WOULD SUGGEST IS WE NEED TO CLEARLY CALL OUT WHAT JOHNSON CONTROLS IS GOING TO BE DEPENDENT ON AND VICE VERSA SO THAT WE DON'T GET CAUGHT IN A HE SAID SHE SAID BATTLE. YEAH. SO, THANK YOU. THROUGH YOU YOUR WORSHIP, BOTH WRD AND TRS GAVE ME PRELIMINARY SCHEDULES THAT I DIDN'T INCLUDE IN MY REPORTING BECAUSE THEY'RE SOMEWHAT DEPENDENT UPON THE OTHER PARTY, SO I DIDN'T WANT TO CONFUSE THE DISCUSSION BY, AND FRANKLY, DRAG WRD INTO A SITUATION WHERE THEY'RE ACCOUNTABLE FOR OTHER PEOPLE'S PERFORMANCE THAT THEY CAN'T CONTROL. SO, I WILL BE ABLE TO BRING THAT INFORMATION FORWARD WITH THE SUBSEQUENT CONTRACT. AND I THINK IT'S PROBABLY MOST APPROPRIATELY DISCUSSED AT THAT TIME. BY THE TIME I DO THAT, I EXPECT IT WILL HAVE TO BE REVISED SOMEWHAT. NOT TO ANY SIGNIFICANT DEGREE, BUT ENOUGH SO I THERE'S ENOUGH SCRUTINY ON THIS PROJECT THAT I WOULD NOT WANT THEM TO STATE SOMETHING THAT WOULDN'T. SOMETHING WOULD BE ONE DAY EARLY OR LATE BECAUSE PEOPLE WILL NOTICE. OKAY. ANY OTHER QUESTIONS OR COMMENTS? COUNCILLOR FLINTOFF. THANK YOUR WORSHIP MORE OF A COMMENT. WE'RE ALL FRUSTRATED, MR. GOULDING, AND I KNOW YOU ARE TOO. AND IT'S, YOU KNOW, IT HAS ACTUALLY ALMOST SEVEN MONTHS OF THE DAY WHEN WE HAD TO CLOSE THE ARENA, AS MAYOR WARNER HAD MENTIONED, WE'RE PROBABLY CLOSE TO $1 MILLION IN AFTER THIS 181. AND, YOU KNOW, WE DON'T WE DON'T REALLY HAVE AN EXACT TIMELINE. AND WE'RE AND WE DON'T WANT TO PUT THE PRESSURE ON YOU, BUT IT'S JUST SO, IT'S SUCH AN IMPORTANT PART OF ELLIOT LAKE AS WE SAW WITH HOCKEY CRAFT, PHIL, I MEAN, NOT EVERYBODY CARED, BUT I'D SAY 97% AT LEAST DID. AND WE JUST WE JUST HAVE TO AS I'M JUST REITERATING WHAT MARIJUANA AND SAID WE JUST WHATEVER IT TAKES, WE HAVE TO GET SOME CONSTRUCTION GOING ON THERE, NOT THE SHORING PART. WE NEED TO SAY, OH, THEY'RE CHANGING THE BEAMS LIKE IT JUST, WE GOTTA GET THIS MOVING. THANK YOU. THANK YOU THROUGH YOU, YOUR WORSHIP, I THINK EVERYONE INVOLVED COULD BENEFIT FROM SOME PERSPECTIVE ON THE SCALE AND SCOPE OF THIS PROJECT. SO MANY OF US ARE HOMEOWNERS, AND THEY'LL ENGAGE WITH A CONTRACTOR TO GO AND DO SOME WORK ON THEIR HOUSE. AND BY AND LARGE, WE ALL HAVE HOUSES THAT ARE SIMPLE ENOUGH THAT THEY'RE COVERED UNDER WHAT'S CALLED PART NINE OF THE BUILDING CODE, WHICH IS PRESCRIPTIVE. IT TELLS THAT PART OF THE BUILDING CODE TELLS YOU EXACTLY WHAT SIZE OF BOARDS TO PUT IN PLACE FOR A FLOOR, OR A ROOF OR A WALL, AND TELLS YOU EXACTLY HOW TO DO IT. AND THE REASON IT'S DONE THAT WAY IS BECAUSE IT SPEEDS UP CONSTRUCTION PROJECTS CONSIDERABLY, AND IT LOWERS DESIGN COSTS AND TIME CONSIDERABLY. THAT'S NOT THIS KIND OF BUILDING. RIGHT. SO THIS KIND OF FACILITY REQUIRES IT'S COVERED UNDER PARTS OF THE BUILDING CODE THAT ARE DESCRIPTIVE IN NATURE. IT TELLS YOU WHAT KIND OF PERFORMANCE STANDARD A BUILDING NEEDS TO MEET. AND IT'S UP TO THE DESIGN TEAM TO DEMONSTRATE BASED ON THEIR EXPERTISE. HOW DO WE ACHIEVE THOSE DESIGN PERFORMANCE STANDARDS? NOW LET'S COMPLICATE THINGS A LITTLE MORE. OUR ARENA IS NOT IN THAT SITUATION. IF, IF, IF WE WERE IN THAT SITUATION, WE COULD ENGAGE WITH TULLOCH ENGINEERING UNDER OUR VENDOR AGREEMENTS WITH THEM AND WE COULD SAY, PLEASE GO DESIGN, YOU KNOW, DO A DESIGN FOR THE ARENA SO THAT WE CAN REOPEN AS SOON AS POSSIBLE. OR ANY OTHER KIND OF NORMAL STRUCTURAL ENGINEERING FIRM. AND THAT'S NOT TO DIMINISH THE VENDORS WE WORK WITH, BUT THEY HAVE THEIR LEVEL OF EXPERTISE. AND WHEN WE EXCEED IT, AS IN THIS CASE, TULLOCH VERY CLEARLY SAID TO US, YOU NEED TO ENGAGE WITH SOMEONE THAT HAS MORE EXPERTISE THAN WE DO FOR THIS PROBLEM. SO, NOW WE'RE ENGAGED AT THE NEXT LEVEL UP WHERE WE'RE NOT ASKING ENGINEERS TO PUT REGULAR DESIGN. ELEMENTS IN PLACE THAT ARE LIKE CONVENTIONAL, SOMETHING THEY COULD LOOK UP ON A TABLE. WE ACTUALLY SPENT A GOOD AMOUNT OF TIME THIS FALL SHORING THE PLACE UP SO THAT WE COULD ACTUALLY MEASURE THE [01:15:05] STRUCTURAL INTEGRITY OF THE WOOD COMPONENTS THAT ARE IN PLACE AND FIGURE OUT HOW STRONG THEY ACTUALLY ARE, NOT WHAT SOME PRE CALCULATED TABLE WOULD TELL AN ENGINEER AND USE THAT INFORMATION TO GO THIS IS LIKE HARD SCIENCE. WHAT WE'VE ENGAGED IN. AND THE REASON WE DID IT IS BECAUSE IT'S THE QUICKEST LINE BETWEEN A AND B, RIGHT. SO. AND IT'S ALSO THE MOST REASONABLE WAY. LIKE, INEVITABLY, WE'RE INCHING UP ON THE CONVERSATION OF WHY DIDN'T WE JUST BUILD A NEW ARENA? WELL, WE'RE STILL ENTERING INTO A PROJECT THAT'S SOMEWHERE AROUND THE THIRD THE PRICE OF WHAT A NEW ARENA WOULD COST. AND WE'RE NOT EXCEEDING THE TIMELINE OF WHAT A CONVENTIONAL BUILD PROJECT WOULD BE EITHER. SO YES, EVERYBODY WANTS TO SEE DONE QUICKER. AND WE'RE REALLY CONSCIOUS ABOUT WHAT THE EXPENSE OF THE PROJECT IS. AND, AND WE'D LIKE TO SEE MORE ACTIVITY. BUT THAT'S REALLY NOT THIS KIND OF PROJECT FOR PERSPECTIVE. WE ALL ARE SEEING HILLSIDE DRIVE BEING RENEWED RIGHT NOW. IT'S, IN COMPARISON A PRETTY SIMPLE PROJECT. THEY REMOVE SOME DIRT, THEY PUT SOME BACK, THEY REMOVE SOME PIPES, THEY PUT SOME BACK, THEY REMOVE SOME ASPHALT, THEY PUT SOME BACK. IT'S ALL KNOWN THINGS WITH VERY STANDARD DESIGN ELEMENTS. AND IT TOOK TWO YEARS TO GET THE DESIGNS DONE FOR THAT PROJECT. SO YES, WE ALL WANT TO GO QUICKER. FRANKLY, IF WE MANAGE TO PULL THIS OFF IT WILL BE INCREDIBLE. AND I'M PLANNING ON DELIVERING IT AS BEST AS I CAN. BUT THIS, IT'S A LOT OF PRESSURE IN THIS FOR EVERYONE. BUT THERE'S A LINE WHERE YOU'RE AT WHERE THE COMMUNITY CAN ASK FOR SOMETHING THAT'S REASONABLE AND ACHIEVABLE AND WHERE IT'S JUST NOT. OKAY. THANK YOU, MR. GOULDING. I KNOW WE ALL KNOW THIS IS YOUR BABY. THIS IS YOUR PROJECT. WE'VE BEEN LISTENING, FOLLOWING YOUR LEAD, AND WE WILL CONTINUE TO DO THAT. LET'S HOPE WE CAN FIND SOME EFFICIENCIES, BECAUSE THERE IS AN APPETITE TO HAVE THAT PLACE OPEN FOR SEPTEMBER. WE HAVE ANY MORE QUESTIONS? OKAY. ALL IN FAVOR? AND THAT'S CARRIED. THAT THERE'S NO OUTSIDE BOARD AND COMMITTEE REPORTING. THERE'S NO UNFINISHED BUSINESS. THERE ARE NO PETITIONS, CORRESPONDENCE REQUESTS FOR SUPPORT REGARDING CLOSURE OF SIX PUBLIC HEALTH [12. CORRESPONDENCE] ONTARIO LABS. MAY I HAVE A MOTION? WHEREAS THE AUDITOR GENERAL'S REPORT AND RECOMMENDATIONS REGARDING PUBLIC HEALTH ONTARIO WERE RELEASED ON DECEMBER 6TH, 2023. AND WHEREAS, SHOULD THE REPORT'S RECOMMENDATIONS BE ACCEPTED BY THE MINISTRY OF HEALTH, IT WOULD LEAD TO THE CLOSURE OF SIX PUBLIC HEALTH ONTARIO LABS, INCLUDING THE PUBLIC HEALTH LAB IN SAULT STE. MARIE. AND WHEREAS, THESE CLOSURES WILL LEAD TO A SIGNIFICANT LOSS OF PUBLIC HEALTH EXPERTISE IN THE ALGOMA DISTRICT, ELLIOT LAKE AND NORTHEASTERN ONTARIO, WITH THE POSITIONS FROM THE LAB. AT A TIME WHEN PUBLIC HEALTH EXPERTISE HAS PROVEN TO BE A CRITICAL ASSET IN ASSISTING WITH THE MANY PUBLIC HEALTH CHALLENGES IN NORTHERN ONTARIO. NOW, THEREFORE, BE IT RESOLVED THAT COUNCIL OF THE CORPORATION OF THE CITY OF ELLIOT LAKE COMMUNICATE TO MINISTER OF HEALTH SYLVIA JONES THAT IT'S STRONGLY OBJECTS TO THE CLOSURE OF THE PUBLIC HEALTH LAB IN SAULT STE. MARIE DUE TO THE PROFOUND IMPACT IT WILL HAVE ON THE PUBLIC HEALTH OF NORTHERN ONTARIANS AND ELLIOT LAKE RESIDENTS, AND FURTHERMORE, THAT A COPY OF THIS RESOLUTION BE SENT TO THE MINISTER OF HEALTH, MPP MICHAEL MANTHA. MUNICIPALITIES IN THE ALGOMA DISTRICT, PHONEME AND PREMIER DOUG FORD. WE HAVE A MOVER. COUNCILOR LEFEBVRE SECONDED. COUNCILLOR FLINTOFF. ALL IN FAVOR? NONE ARE OPPOSED. THAT IS CARRIED 12.2. LETTER FROM THE OFFICE OF THE OMBUDSMAN REGARDING OMBUDSMAN INVESTIGATION IN THE JANUARY 30TH, 2023, MEETING OF COUNCIL. WE HAVE A MOTION THAT THE LETTER FROM THE OFFICE OF THE OMBUDSMAN DATED APRIL 3RD, 2024, CONCERNING THE INVESTIGATION INTO THE JANUARY 30TH, 2023, MEETING OF COUNCIL, RECEIVED A MOVER COUNCILLOR MANN. SECONDED. COUNCILLOR BULL. [01:20:06] DO YOU HAVE ANY COMMENTS OR QUESTIONS? COUNCILLOR MANN? THANK YOU, YOUR WORSHIP. THIS MATTER HAS BEEN DEALT WITH A COUPLE OF TIMES. ORIGINALLY WHEN WE RECEIVED THE FIRST RESPONSE FROM THE OMBUDSMAN OFFICE, THERE WAS A CONCERN THAT WE BREACHED THE MUNICIPAL ACT. THIS LETTER AND I DO THANK THE CLERK'S DEPARTMENT FOR FOLLOWING UP MOST RECENTLY WITH THE OMBUDSMAN'S OFFICE. THIS LETTER CLEARLY CLARIFIES THAT WE DID NOT ACTUALLY BREACH DURING OUR JANUARY 30TH MEETING. THERE ARE A COUPLE OF POINTS IN THE MATTER THAT I DO. TAKE EXCEPTION WITH IT SEEMS TO BE CONTRADICTORY IN SEVERAL SPOTS. AND AGAIN, I KNOW THAT THE CLERK'S DEPARTMENT HAS REACHED OUT ON SEVERAL OCCASIONS TO TRY TO REQUEST A DIFFERENT LETTER THAN WAS RECEIVED. HOWEVER, THAT'S NOT THE CASE. BUT, YOU KNOW, SUGGESTING THAT IT'S NOT A TRIVIAL MATTER, THAT WE WERE HINDERED WITH THE FAILURE TO DISCLOSE EVIDENCE AND THEN SAYING WE HAVE NO REASON TO BELIEVE THAT THIS OMISSION WAS INTENTIONAL. SO WHAT IS IT? AND THEN REMINDING US, OF COURSE, THAT IT'S AN OFFENSE UNDER THE OMBUDSMAN ACT TO WILLFULLY MISLEAD THE OMBUDSMAN. BUT AGAIN, WE'RE ADVISED THIS SUBMISSION WAS NOT VIEWED AS INTENTIONAL. AND THEN, OF COURSE, LASTLY, YOU KNOW, HOPEFULLY IN THE FUTURE YOU FULLY COOPERATE WITH ANY FUTURE INVESTIGATION. I BELIEVE EVERY MEMBER OF COUNCIL THAT WAS REQUESTED TO COMPLY DID COMPLY. SO, I THINK WE'RE ALREADY IN COMPLIANCE WITH THE ACT. THANK YOU. THANK YOU. COUNCILLOR MANN ANY OTHER QUESTIONS OR COMMENTS? OKAY. ALL IN FAVOR? CARRIED. THERE ARE NO NOTICES OF MOTION NUMBER 14. [14. COUNCIL REPORTS AND ANNOUNCEMENTS] COUNCIL REPORTS AND ANNOUNCEMENTS. SO, I HAVE A PROCLAMATION.
