STAFF WERE GIVEN DIRECTION TO PREPARE AN AGREEMENT TO PURCHASE AND SALE WITH REGARDS TO 17 TIMBER ROAD.

AND MISTER MULLEN.

WE HAVE PUT THAT THROUGH.

IT IS IN PLACE.

AS NOTED ON THE APPS, THE PROPONENT WILL BUILD A 20 500 SQUARE FOOT UNIT WITHIN A 24 MONTH BUILD COVENANT.

THE SALE PRICE FOR THE PROPERTY IS $21,125.

AS TYPICAL ROUTINE FOR THE ECONOMIC DEVELOPMENT DEPARTMENT WHEN IT COMES TO THIS TYPE OF PRESENTATION TO COUNCIL.

COUNCIL, OF COURSE, IS AWARE OF THE INTENT OF THE PROPONENT, BUT FOR PUBLIC CONSUMPTION, WE WILL LEAVE THE PROPONENTS PRESENTATION OF HIS FINAL PRODUCT ON THE SITE TO FOLLOW HIS OWN MARKETING PLAN AND TO AVOID ANY ISSUES WITH COMPETITIVE ADVANTAGE TO THE PROPONENT BY GETTING INFORMATION OUT AHEAD OF HIS WISHES.

09-44 ELIGIBLE CHARITIES TAX REBATE.

AT THE JUNE 17TH FINANCE AND ADMINISTRATION COMMITTEE MEETING, THE FOLLOWING RESOLUTION WAS PASSED THAT BYLAW 09-44 BEING A BYLAW TO ESTABLISH A TAX REBATE PROGRAM FOR THE PURPOSE OF PROVIDING RELIEF OF TAXES ON ELIGIBLE PROPERTY OCCUPIED BY ELIGIBLE CHARITIES AND SIMILAR ORGANIZATIONS, BE AMENDED AND THAT THE APPROPRIATE BYLAW BE PASSED.

SO MAY I HAVE A MOTION THAT BYLAW 09-44 BEING A BYLAW TO ESTABLISH A TAX REBATE PROGRAM FOR THE PURPOSE OF PROVIDING RELIEF OF TAXES ON ELIGIBLE PROPERTY OCCUPIED BY ELIGIBLE CHARITIES AND SIMILAR ORGANIZATIONS, BE AMENDED AND THAT THE APPROPRIATE BYLAW BE PASSED.

THIS ITEM THAT WAS BROUGHT TO FNA ON LAST MONDAY IS A HOUSEKEEPING ITEM THAT WE'VE BEEN WORKING ON FOR SOME TIME AND HAVE FINALLY CLEANED UP.

IT'S ONE OF THOSE POLICIES THAT HAS BEEN IN EXISTENCE FOR QUITE SOME TIME AND NEEDED A QUICK, NEEDED A LITTLE BIT OF A REFRESH TO BRING IT UP TO DATE.

NAMELY THE INITIAL POLICY THAT WAS PASSED BACK IN 2009.

THAT PARTICULAR BYLAW INCLUDED THE DECLARATION OF SPECIFIC PROPERTY PROPERTIES TO ENCOURAGE TAX REBATES FOR THOSE THAT HAVE MEMBERSHIP WHERE THEY'RE PRIMARILY VOLUNTEERS INVOLVED IN THE ORGANIZATION.

SO THAT WOULD INCLUDE PLACES LIKE SKIING AND GOLFING AND CURLING.

AS WITH THE CHANGE IN THE CURRENT ENVIRONMENT AND OUR DECLARED INVESTMENT AND INTEREST IN THE MOUNT DUFOR SKI HILL, THE BYLAW WITH ITS CURRENT WORDING IS UNNECESSARY AND WE CAN REVERT BACK TO A MORE SIMPLIFIED VERSION THAT WOULD MATCH MANY OTHER MUNICIPALITIES ACROSS THE PROVINCE. SO THE EXPANDED DEFINITION OF AN ELIGIBLE CHARITY IS NOT NECESSARY, IS NOT NECESSARY UNDER THE MUNICIPAL ACT, BUT THAT WAS USED AS A TOOL TO SUPPORT VOLUNTEER ORGANIZATIONS OVER THE YEARS.

AS WITH EVERY SINGLE.

ELIGIBLE CHARITY TAX REBATE.

ELIGIBLE CHARITIES STILL ARE REQUIRED TO DO THEIR DUE DILIGENCE AND PROVIDE THEIR APPLICATION DOCUMENTATION THAT SUPPORT THEIR STATUS AS AN ELIGIBLE CHARITY, THEIR ARTICLES OF INCORPORATION.

AND WE CAN ALSO ASK FOR THEIR MOST RECENT AUDITED FINANCIAL STATEMENTS.

THERE IS NO FINANCIAL IMPACT TO ADOPTING THIS AMENDED BYLAW, AND IT IS ESSENTIALLY A HOUSEKEEPING ITEM TO REVIEW AND UPDATE BYLAWS, POLICIES AND PROCEDURES FOR THE DEPARTMENT.

YES. ELIGIBLE CHARITIES ARE REQUIRED ANNUALLY TO REQUEST TO BE INCLUDED AS AN ELIGIBLE CHARITY, AND AS SUCH THE APPLICATIONS ARE ALSO MUST BE INCLUDE THEIR AUDITED FINANCIAL STATEMENTS PER THE MUNICIPAL ACT.

SO THAT'S OUR CHECK AND BALANCE ON OUR SIDE TO ENSURE THAT THEY'RE DOING THEIR DUE DILIGENCE AS AN ELIGIBLE CHARITY AS WELL.

RECENTLY APPROVED CHARITY TAX REBATE, BUT ALSO EXPRESSES COUNCIL'S DESIRE AND COUNCIL'S INTEREST TO DECLARE THAT MOUNT DUFOUR SKI AREA BE DECLARED AS MUNICIPAL CAPITAL FACILITY, THEREBY REMOVING THEIR REQUIREMENT TO PAY TAXATION ON THAT PROPERTY.

AS THIS IS A MUNICIPAL FACILITY THAT WE BELIEVE IN AND HAVE EXPRESSED OUR.

SUPPORT THROUGH THE MEMORANDUM OF UNDERSTANDING THAT WAS PASSED IN THE FALL OF 2023.

THERE ARE SPECIFIC LEGISLATION IN THE MUNICIPAL ACT THAT ALLOWS A MUNICIPALITY THE AUTHORITY TO DESIGNATE A FACILITY AS MUNICIPAL CAPITAL FACILITY.

THIS IS DONE IN NUMEROUS NEIGHBORING MUNICIPALITIES.

WHERE EVEN PRIVATELY OWNED PROPERTIES HAVE AN INTEREST FOR THE MUNICIPALITY TO SUSTAIN AND OFTEN RETAIN SERVICES, NAMELY FOR RECREATIONAL PURPOSES.

WE'LL SEE THIS IN OTHER MUNICIPALITIES, WHERE PRIVATE SWIMMING POOLS MIGHT BE THEN OPENED FOR PUBLIC USE.

IN PARTICULAR, I THINK OF A FEW EXAMPLES WHERE GOLF AND COUNTRY CLUBS HAVE BEEN USED TO PROVIDE PUBLIC SWIMMING LESSONS AND THAT SORT OF THING.

THERE ARE EXAMPLES OF THAT FROM ACROSS THE PROVINCE.

SO THIS HAS THE SAME FLAVOR WHERE WE ARE PROPOSING TO EXEMPT MOUNT DUFOUR SKI AREA FROM TAXATION AS MUNICIPAL CAPITAL FACILITY ON A GO FORWARD BASIS.

THE CURRENT LEASE AS AND MEMORANDUM OF UNDERSTANDING WITH MOUNT DUFOUR SKI AREA EXPIRES IN 2028 AND MUNICIPAL CAPITAL FACILITY WOULD REMAIN.

GIVEN THE RENEWAL OF THE RELEASE OF THE LEASE WITH THE CITY, AND THIS WOULD NEVER HAVE TO BE REVISITED GOING FORWARD.

THIS WOULD BE IN PERPETUITY, SO LONG AS THE MOUNT DUFOUR SKI AREA RETAINS THIS, THE LEASE AND THE AGREEMENT, AND SATISFIES THE REQUIREMENTS OF SAID LEASE WITH COUNCIL. OVER THE YEARS, THE CITY HAS PROVIDED MOUNT DUFOUR WITH A CREDIT TOWARDS TAXATION REPRESENTATIVE 75% OF THEIR GLOBAL TAX BILL UNDER THE CHARITY RELIEF TAX BYLAW AGENDA PACKAGE, PAGE 24 HIGHLIGHTS THE YEARS 2015 THROUGH 2023 AND PROVIDES DETAILS ON THAT TAX RELIEF, AS WELL AS A SYNOPSIS ON THE TAXES ACTUALLY CHARGED AND PAID, MEANING CASH RECEIVED BACK TO THE CITY.

THE 2024 OPERATING BUDGET INCLUDED THE PROVISION OF SUPPORT FOR THE MOUNT DUFOUR SKI AREA, IN LINE WITH THE MEMORANDUM OF UNDERSTANDING THAT WAS PASSED IN 2023, IN THE FALL. TO THAT EXTENT, IT'S RECOMMENDED THAT THE COUNCIL DESIGNATE THE LAND KNOWN AS MOUNT DUFOUR SKI AREA AS MUNICIPAL CAPITAL FACILITY, AND WE PASS THAT APPROPRIATE BYLAW TONIGHT AND PROCESS THOSE DOCUMENTS WITH MPAC IN TIME FOR THE 2025 ROLL.

IS THAT RIGHT? OR THROUGH YOUR WORSHIP, I BELIEVE THAT IS 100% CORRECT.

OKAY. MY GUT REACTION RIGHT NOW, IF YOU WOULD APPEASE ME OF THAT LIBERTY IS WE WOULD NOT NEED TO AMEND THAT BYLAW, BUT RATHER THAT THE MUNICIPAL STATING THE THAT MOUNT DUFOUR SKI AREA IS MUNICIPAL CAPITAL FACILITY WILL SUSTAIN ITSELF FOR THE DURATION OF THE LEASE, EVEN UPON RENEWAL.

SO IT WOULD BE IN PERPETUITY UNTIL SUCH TIME AS THERE WAS NO LEASE.

SO THE REPORT IS INCORRECT BY STATING THAT IT WAS A FIVE YEAR LEASE, BUT RATHER THAT SIX YEAR LEASE.
