[1. CALL TO ORDER]
P.M. WE'LL CALL TO ORDER.ROLL CALL. ALL MEMBERS ARE PRESENT.
DECLARATIONS OF CONFLICT OF INTEREST.
[3. DECLARATIONS OF CONFLICT OF INTEREST]
I WILL BE DECLARING ON ITEM 17.4.SORRY. DO WE HAVE ANY OTHER CONFLICTS OF INTEREST? GOING ONCE.
ITEM FOUR, ADOPTION OF PREVIOUS MINUTES.
[4. ADOPTION OF PREVIOUS MINUTES]
MAY I HAVE A MOTION THAT THE FOLLOWING MINUTES BE ADOPTED FROM THE MAY 27TH, 2024 REGULAR MEETING.MOVER. COUNCILLOR MORRISSETTE.
DO WE HAVE ANY QUESTIONS OR COMMENTS? OKAY SEEING NONE.
THERE'S NO PUBLIC INPUT TONIGHT.
THERE ARE NO PUBLIC PRESENTATIONS.
[7. INTRODUCTION AND CONSIDERATION OF CORPORATE REPORTS]
ITEM SEVEN INTRODUCTION AND CONSIDERATION OF CORPORATE REPORTS 7.1 MEMO FROM THE MANAGER OF ECONOMIC DEVELOPMENT REGARDING AN AGREEMENT OF PURCHASE AND SALE OF 17 TIMBER ROAD.BE RECEIVED A MOVER COUNCILLOR FLINTOFF.
MAN. WELCOME, MR. ANTUNES. GO AHEAD.
GOOD TO SEE YOU ALL. VIRTUALLY.
THE SALE PRICE FOR THE PROPERTY IS $21,125.
COUNCIL, OF COURSE, IS AWARE OF THE INTENT OF THE PROPONENT, BUT FOR PUBLIC CONSUMPTION, WE WILL LEAVE THE PROPONENTS PRESENTATION OF HIS FINAL PRODUCT ON THE SITE TO FOLLOW HIS OWN MARKETING PLAN AND TO AVOID ANY ISSUES WITH COMPETITIVE ADVANTAGE TO THE PROPONENT BY GETTING INFORMATION OUT AHEAD OF HIS WISHES.
MR. MULLINS, BEEN A PLEASURE TO WORK WITH THROUGHOUT THIS PROCESS.
SO HAPPY TO ANSWER ANY QUESTIONS THAT COUNCIL MAY HAVE.
OKAY. THANK YOU, MR. ANTUNES. DO WE HAVE ANY QUESTIONS OR COMMENTS? NO, I THINK IT'S A GOOD OPPORTUNITY.
IT WAS SOUGHT AFTER BY MORE THAN A FEW PROPONENTS.
AND THIS PROPONENT IS THE WINNER, SO WE WISH HIM LUCK.
ALL IN FAVOR? NONE ARE OPPOSED.
7.2, MEMO FROM THE MANAGER OF ECONOMIC DEVELOPMENT REGARDING ZONING AMENDMENT BYLAW 80 DF AVENUE.
IT JUST ENDED, I THINK SIX MINUTES AGO.
THIS IS JUST A MEMO TO HAVE INTO THE RECORD FOR TONIGHT'S COUNCIL AGENDA, THAT THERE WILL BE A BYLAW LATER ON IN THIS EVENING'S AGENDA TO PUT THROUGH THE AMENDMENT FOR ADDF AVENUE.
AGAIN, STAFF ARE VERY EXCITED ON, ON THIS OPPORTUNITY, THIS AMENDMENT WILL MOVE US TO THE NEXT PHASE IN GETTING THE 23 RENTAL TOWNHOMES IN PLACE IN OUR COMMUNITY, WHICH IS GOING TO OFFER MUCH NEEDED RESIDENTIAL RENTAL CAPACITY IN OUR COMMUNITY.
[00:05:01]
SO STAFF ARE VERY PLEASED TO BRING THIS FORWARD AND VERY THANKFUL TO OUR PARTNERS AT JL RICHARD AND THE WHOLE TEAM IN THE CLERK'S DEPARTMENT THAT HAVE WORKED VERY HARD TO GET THIS MOVED AHEAD TO TODAY AND AND HOPEFULLY, AS WE HEARD FROM THE PROPONENT SHOVELS IN THE GROUND WITHIN THE NEXT AND COMPLETE WITHIN THE NEXT 14 TO 16 MONTHS.ANY QUESTIONS OR COMMENTS HERE? OKAY SEEING NONE.
ALL IN FAVOR? NONE ARE OPPOSED. THAT'S CARRIED.
[8. PRESENTATION OF COMMITTEE REPORTS]
09-44 ELIGIBLE CHARITIES TAX REBATE.AT THE JUNE 17TH FINANCE AND ADMINISTRATION COMMITTEE MEETING, THE FOLLOWING RESOLUTION WAS PASSED THAT BYLAW 09-44 BEING A BYLAW TO ESTABLISH A TAX REBATE PROGRAM FOR THE PURPOSE OF PROVIDING RELIEF OF TAXES ON ELIGIBLE PROPERTY OCCUPIED BY ELIGIBLE CHARITIES AND SIMILAR ORGANIZATIONS, BE AMENDED AND THAT THE APPROPRIATE BYLAW BE PASSED.
SO MAY I HAVE A MOTION THAT BYLAW 09-44 BEING A BYLAW TO ESTABLISH A TAX REBATE PROGRAM FOR THE PURPOSE OF PROVIDING RELIEF OF TAXES ON ELIGIBLE PROPERTY OCCUPIED BY ELIGIBLE CHARITIES AND SIMILAR ORGANIZATIONS, BE AMENDED AND THAT THE APPROPRIATE BYLAW BE PASSED.
A MOVER, COUNCILLOR MORRISSETTE SECONDED.
THANK YOU THROUGH YOUR WORSHIP.
THIS ITEM THAT WAS BROUGHT TO FNA ON LAST MONDAY IS A HOUSEKEEPING ITEM THAT WE'VE BEEN WORKING ON FOR SOME TIME AND HAVE FINALLY CLEANED UP.
NAMELY THE INITIAL POLICY THAT WAS PASSED BACK IN 2009.
THAT PARTICULAR BYLAW INCLUDED THE DECLARATION OF SPECIFIC PROPERTY PROPERTIES TO ENCOURAGE TAX REBATES FOR THOSE THAT HAVE MEMBERSHIP WHERE THEY'RE PRIMARILY VOLUNTEERS INVOLVED IN THE ORGANIZATION.
SO THAT WOULD INCLUDE PLACES LIKE SKIING AND GOLFING AND CURLING.
AS WITH THE CHANGE IN THE CURRENT ENVIRONMENT AND OUR DECLARED INVESTMENT AND INTEREST IN THE MOUNT DUFOR SKI HILL, THE BYLAW WITH ITS CURRENT WORDING IS UNNECESSARY AND WE CAN REVERT BACK TO A MORE SIMPLIFIED VERSION THAT WOULD MATCH MANY OTHER MUNICIPALITIES ACROSS THE PROVINCE. SO THE EXPANDED DEFINITION OF AN ELIGIBLE CHARITY IS NOT NECESSARY, IS NOT NECESSARY UNDER THE MUNICIPAL ACT, BUT THAT WAS USED AS A TOOL TO SUPPORT VOLUNTEER ORGANIZATIONS OVER THE YEARS.
ELIGIBLE CHARITIES STILL ARE REQUIRED TO DO THEIR DUE DILIGENCE AND PROVIDE THEIR APPLICATION DOCUMENTATION THAT SUPPORT THEIR STATUS AS AN ELIGIBLE CHARITY, THEIR ARTICLES OF INCORPORATION.
AND WE CAN ALSO ASK FOR THEIR MOST RECENT AUDITED FINANCIAL STATEMENTS.
THERE IS NO FINANCIAL IMPACT TO ADOPTING THIS AMENDED BYLAW, AND IT IS ESSENTIALLY A HOUSEKEEPING ITEM TO REVIEW AND UPDATE BYLAWS, POLICIES AND PROCEDURES FOR THE DEPARTMENT.
ANY QUESTIONS OR COMMENTS? COUNCILLOR MORRISSETTE.
THIS REBATE PROGRAM, IS IT SOMETHING THAT THEY'RE GOING TO HAVE TO APPLY YEARLY IF THEY WANT TO HAVE THIS REBATE APPLIED TO THEIR PROPERTY? THROUGH YOUR WORSHIP, THROUGH YOUR WORSHIP.
YES. ELIGIBLE CHARITIES ARE REQUIRED ANNUALLY TO REQUEST TO BE INCLUDED AS AN ELIGIBLE CHARITY, AND AS SUCH THE APPLICATIONS ARE ALSO MUST BE INCLUDE THEIR AUDITED FINANCIAL STATEMENTS PER THE MUNICIPAL ACT.
OKAY. ANY OTHER QUESTIONS? COUNCILLOR LEFEBVRE.
THANK YOU, YOUR WORSHIP THROUGH YOU.
JUST A QUESTION REGARDING SCHEDULE A, WHICH IS THE ACTUAL FORM.
SO I THINK IT'S JUST THE FORM NEEDS TO BE UPDATED.
FOR YOUR WORSHIP, I WILL TAKE THAT AS A NOTE AND THAT WILL BE AN ADMINISTRATIVE CORRECTION AS WELL.
THANK YOU. ANY OTHER QUESTIONS OR COMMENTS?
[00:10:05]
OKAY. ALL IN FAVOR? NONE ARE OPPOSED.AT THE JUNE 17TH FINANCE AND ADMINISTRATION COMMITTEE MEETING, THE FOLLOWING RESOLUTION WAS PASSED THAT COUNCIL DESIGNATE THE LAND KNOWN AS MOUNT DUFOUR SKI AREA AS A MUNICIPAL CAPITAL FACILITY AND THAT THE APPROPRIATE BYLAW BE PASSED.
A MOVER, COUNCILLOR SEIDEL SECONDED.
THROUGH YOU, YOUR WORSHIP. IN A TIMELY ADDITIONAL REPORT FROM FINANCE AND ADMINISTRATION.
RECENTLY APPROVED CHARITY TAX REBATE, BUT ALSO EXPRESSES COUNCIL'S DESIRE AND COUNCIL'S INTEREST TO DECLARE THAT MOUNT DUFOUR SKI AREA BE DECLARED AS MUNICIPAL CAPITAL FACILITY, THEREBY REMOVING THEIR REQUIREMENT TO PAY TAXATION ON THAT PROPERTY.
AS THIS IS A MUNICIPAL FACILITY THAT WE BELIEVE IN AND HAVE EXPRESSED OUR.
SUPPORT THROUGH THE MEMORANDUM OF UNDERSTANDING THAT WAS PASSED IN THE FALL OF 2023.
THIS IS DONE IN NUMEROUS NEIGHBORING MUNICIPALITIES.
WHERE EVEN PRIVATELY OWNED PROPERTIES HAVE AN INTEREST FOR THE MUNICIPALITY TO SUSTAIN AND OFTEN RETAIN SERVICES, NAMELY FOR RECREATIONAL PURPOSES.
THERE ARE EXAMPLES OF THAT FROM ACROSS THE PROVINCE.
SO THIS HAS THE SAME FLAVOR WHERE WE ARE PROPOSING TO EXEMPT MOUNT DUFOUR SKI AREA FROM TAXATION AS MUNICIPAL CAPITAL FACILITY ON A GO FORWARD BASIS.
THIS WOULD BE IN PERPETUITY, SO LONG AS THE MOUNT DUFOUR SKI AREA RETAINS THIS, THE LEASE AND THE AGREEMENT, AND SATISFIES THE REQUIREMENTS OF SAID LEASE WITH COUNCIL. OVER THE YEARS, THE CITY HAS PROVIDED MOUNT DUFOUR WITH A CREDIT TOWARDS TAXATION REPRESENTATIVE 75% OF THEIR GLOBAL TAX BILL UNDER THE CHARITY RELIEF TAX BYLAW AGENDA PACKAGE, PAGE 24 HIGHLIGHTS THE YEARS 2015 THROUGH 2023 AND PROVIDES DETAILS ON THAT TAX RELIEF, AS WELL AS A SYNOPSIS ON THE TAXES ACTUALLY CHARGED AND PAID, MEANING CASH RECEIVED BACK TO THE CITY.
THE 2024 OPERATING BUDGET INCLUDED THE PROVISION OF SUPPORT FOR THE MOUNT DUFOUR SKI AREA, IN LINE WITH THE MEMORANDUM OF UNDERSTANDING THAT WAS PASSED IN 2023, IN THE FALL. TO THAT EXTENT, IT'S RECOMMENDED THAT THE COUNCIL DESIGNATE THE LAND KNOWN AS MOUNT DUFOUR SKI AREA AS MUNICIPAL CAPITAL FACILITY, AND WE PASS THAT APPROPRIATE BYLAW TONIGHT AND PROCESS THOSE DOCUMENTS WITH MPAC IN TIME FOR THE 2025 ROLL.
OKAY. THANK YOU, MRS. OLDENBURGER. ANY QUESTIONS OR COMMENTS? COUNCILLOR FLINTOFF.
THANK YOU WORSHIP, THROUGH YOU MRS. SONNENBURG. I THINK NOW TELL ME IF I'M WRONG, BUT I THINK WE AMENDED THAT FIVE YEAR LEASE TO EXPIRE 2029 BECAUSE MOUNT DUFOUR WAS OF WAS APPLYING FOR A TRILLIUM GRANT.
IS THAT RIGHT? OR THROUGH YOUR WORSHIP, I BELIEVE THAT IS 100% CORRECT.
I CAN SEE MR. ANTUNES NODDING ON TELEVISION.
AND SO I JUST DON'T KNOW IF WE HAVE TO CHANGE THE BYLAW BEFORE WE VOTE TO PAIR IT UP OR NOT.
I. WE'LL TAKE A CURSORY GLANCE AT IT.
OKAY. MY GUT REACTION RIGHT NOW, IF YOU WOULD APPEASE ME OF THAT LIBERTY IS WE WOULD NOT NEED TO AMEND THAT BYLAW, BUT RATHER THAT THE MUNICIPAL STATING THE THAT MOUNT DUFOUR SKI AREA IS MUNICIPAL CAPITAL FACILITY WILL SUSTAIN ITSELF FOR THE DURATION OF THE LEASE, EVEN UPON RENEWAL.
SO IT WOULD BE IN PERPETUITY UNTIL SUCH TIME AS THERE WAS NO LEASE.
SO THE REPORT IS INCORRECT BY STATING THAT IT WAS A FIVE YEAR LEASE, BUT RATHER THAT SIX YEAR LEASE.
[00:15:01]
BECAUSE YOU ARE INDEED CORRECT, MY MEMORY DID NOT SERVE ME WHEN I WROTE THIS REPORT THAT THERE WAS THAT EXTENSION FOR THAT ADDITIONAL GRANT.IT HAD SOMETHING TO DO WITH THE GRANT.
THANK YOU. I'M JUST LOOKING AT THE BYLAW HERE.
IT DOESN'T REALLY SAY ANYTHING ABOUT ANYTHING ON THE LEASE.
IT'S JUST HAD TO HAVE THE LEASE.
SO I DON'T KNOW IF IT HAS TO BE CHANGED OR THE DATE NEEDS TO BE RIGHT.
IS THAT CORRECT, MR. GRAY? THAT'S CORRECT, YOUR WORSHIP.
ANY OTHER QUESTIONS OR COMMENTS? COUNCILOR OF THE FAITH.
JUST A COMMENT. I THINK THAT WOULD HAVE BEEN AN AMENDMENT TO THE ORIGINAL MOU.
SO IT'S CONSIDERED AN APPENDIX TO THE MOU.
SO THERE SHOULDN'T HAVE TO BE A CHANGE.
YEAH. THAT'S WHAT WE'RE AGREEING WITH.
THERE'S NO OUTSIDE BOARD AND COMMITTEE REPORTING.
THERE'S NO UNFINISHED BUSINESS.
THERE ARE NO PETITIONS, NO CORRESPONDENCE, NO NOTICES OF MOTION.
