TO PROVIDE COUNCIL WITH INFORMATION REGARDING THE SALE AND PORTION OF LAND ON TIMBER ROAD TO TIMBEROCK INCLUDING SITE CONTROL DETAILS IN SITE ACCESS AGREEMENT. CAN WE HAVE SOME DETAILS MS. VLAHOVICH. YES. SO THIS PROPOSAL WAS BROUGHT FORWARD TO THE MUNICIPALITY, I BELIEVE IN LATE 2018 AND STAFF BEGAN TO WORK ON OPTIONS FOR THIS. IT WAS POSTPONED FOR A LITTLE BIT AND BROUGHT BACK TO THE TABLE EARLY IN 2020. SO WE CONTINUE TO WORK ON IT. AND TODAY WE PROVIDED YOU AN AGREEMENT TO PURCHASE AND SALE FOR A POINT TWO FIVE ACRE PORTION OF PROPERTY TO TIMBEROCK. THE PROPERTY THAT IS IN QUESTION IS A SMALL PORTION OF THE PUBLIC WORKS YARD. THAT'S NOT VERY READILY USED. IT IS USED FOR A LITTLE BIT OF OUTDOOR STORAGE. BUT IN ORDER FOR TIMBEROCK TO EXPAND, THEY DO REQUIRE A BIT MORE LAND. AND BECAUSE THEY HAVE NEIGHBORS ON EITHER SIDE, THIS IS THE ONLY OPTION FOR THEM TO EXPAND THEIR PARKING LOT. THEY HAVE BEEN WORKING AT EXPANDING THEIR SHIFTS AND INCREASING SOME OF THEIR BUSINESS. SO THEY REQUIRE THIS POINT TWO FIVE ACRES FOR THE PARKING LOT. SO TODAY WE HAVE FOR YOU THE AGREEMENT OF PURCHASE AND SALE WHICH IS TEN THOUSAND DOLLARS PLUS APPLICABLE TAXES FOR THE POINT TWO FIVE ACRES. THE COST OF LEGAL FEES UP TO FIFTEEN HUNDRED DOLLARS WILL ALSO BE BORN BY THE PURCHASER. THE ONE AREA OF CONSIDERATION IS THE CLOSING DATE. ONE PORTION OF THE PROPERTY ALMOST 40 YEARS AGO WHEN THE CROWN HAD GIVEN THE LAND TO THE CITY, IT DID PUT A PROVISION ON THERE FOR A LAND CONDITION. SO WE NEED TO HAVE THAT RELEASED THAT IT WAS INTENDED FOR MUNICIPAL PURPOSES ONLY. AND THAT'S PART THREE. SO THE CITY HAS WORKED WITH TIMBEROCK TO SUBMIT AN APPLICATION OR A LETTER TO THE M AND R TO HAVE THAT LAND CONDITION RELEASED. SO RIGHT NOW, THE CLOSING IS TWO WEEKS AFTER THE CONDITION IS RELEASED. TWO OTHER PARTS ARE ALSO THAT TIMBEROCK ALREADY OWNS. THEY'RE ALSO REQUESTING THE RELEASE. SO THEY'RE ACTUALLY ON IT RIGHT NOW. SO WE DON'T FORESEE IT BEING AN ISSUE. WE JUST WEREN'T ABLE TO GET A TIMELINE FROM THE M AND R AT THIS POINT. SO THE CLOSING DATE WILL BE TWO WEEKS AFTER THAT RELEASE IS CONSIDERED. AND THEY HAVE ALSO SUPPLIED THE SITE PLAN CONTROL AGREEMENT, WHICH HAS A FIVE THOUSAND DOLLAR DEPOSIT. THERE'S NOT A LOT OF WORK THAT IS GOING TO BE DONE. THERE WILL BE GRADING, DITCHING AND REMOVAL OF AN ELECTRICAL POLE. THERE IS NOT PAVING FOR THIS. THE AGREEMENT OF PURCHASE AND SALE DOES HAVE AN EASEMENT FOR THE CITY IN PERPETUITY ON THE TOP CORNER PIECE BECAUSE THERE IS A LIFT STATION THERE. AND WE'VE ALSO INCLUDED THAT THE INTENT THE MUNICIPALITY HAS TO POTENTIALLY WORK ON THE WATERLINE THAT COMES UNDER ELLIOT LAKE. SO THERE WON'T BE PAVING THIS PARKING LOT PORTION BECAUSE WE MAY BE WORKING ON THAT LINE AND THEN WE WOULD JUST HAVE TO TEAR IT UP. SO THIS SITE PLAN CONTROL AGREEMENT, HAS ALSO BEEN APPROVED FOR YOU OR SORRY, SUPPLIED TODAY FOR YOU AS WELL AS AN ACCESS AGREEMENT. DUE TO THE CLOSING DATE BEING KIND OF UP IN THE AIR AT THIS POINT THEY WOULD LIKE TO GET GOING IN THIS CONSTRUCTION SEASON. SO SIMILAR TO WHAT WE HAVE DONE WITH OTHER SITES, THEY PROVIDED AN ACCESS AGREEMENT THAT WILL GRANT THEM ACCESS TO THE SITE AND THEY ARE SUPPLYING A CERTIFICATE OF INSURANCE, WHICH WILL LIST THE CITY AS AN ADDITIONAL INSURED SO THAT THEY CAN START WORKING ON THIS AND GET GOING.
